{"id":331403,"date":"2025-05-15T18:43:12","date_gmt":"2025-05-15T23:43:12","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=331403"},"modified":"2025-05-15T17:05:23","modified_gmt":"2025-05-15T22:05:23","slug":"south-carolina-supreme-court-heartbeat-6-weeks","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/south-carolina-supreme-court-heartbeat-6-weeks\/","title":{"rendered":"South Carolina Supreme Court unanimously rules &#8216;heartbeat law&#8217; protects at 6 weeks"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/www.lc.org\/newsroom\/details\/051525-sc-supreme-court-rules-abortion-ban-stays-at-six-weeks\">Liberty Counsel<\/a>) [On May 14] the South Carolina Supreme Court unanimously <a href=\"https:\/\/www.sccourts.org\/media\/opinions\/HTMLFiles\/SC\/28280.pdf\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that the state\u2019s \u201cFetal Heartbeat and Protection from Abortion Act\u201d protects unborn children when a heartbeat is detected, which is usually at six weeks gestation.<\/p>\n<p>After the state supreme court previously <a href=\"https:\/\/www.lc.org\/newsroom\/details\/082323-sc-supreme-court-reverses-previous-stance-and-upholds-prolife-law\" target=\"_blank\" rel=\"noopener\">upheld<\/a> the law\u2019s constitutionality in August 2023, Planned Parenthood then challenged the law again arguing it should be a nine-week ban rather than a six-week ban because the heart is not fully formed before nine weeks. It argued that an unborn baby does not have a \u201cheart\u201d and cannot have a \u201cfetal heartbeat\u201d until all four chambers of the heart are formed at about nine weeks gestation. However, the Justices confirmed the law\u2019s intent was to ban abortion when electrical impulses, often called a fetal heartbeat, are first detectable, which in most instances is at six weeks.<\/p>\n<p>The disputed definition of \u201cfetal heartbeat\u201d reads, \u201ccardiac activity, or the steady and repetitive rhythmic contraction of the fetal heart, within the gestational sac.\u201d\u00a0Planned Parenthood suggested the definition wasn\u2019t clear because medical practitioners do not use standardized terms when talking about cardiac development.<\/p>\n<p>While the court did find that this definition is \u201cambiguous and does not convey a clear or definitive meaning,\u201d the Justices chose to strictly examine the \u201cplain meaning\u201d of the language and no more. They did so in the context of the litany of medical and scientific knowledge presented in the case, such as journals from\u00a0the American Pregnancy Association, which led to the South Carolina\u2019s \u201cfetal heartbeat\u201d definition and to other states passing similar \u201cheartbeat\u201d laws at six weeks.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/k0WNRR-epPI?si=qg11nwlKxnOtqsqk\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p>In the unanimous opinion, Justice John Cannon Few wrote, \u201cTracking the language of the 2023 Act, we hold the term \u2018fetal heartbeat\u2019 refers to \u2018a biologically identifiable moment in time\u2019 at which a medical professional may objectively determine to have occurred by the existence of the \u2018cardiac activity\u2019 of electrical impulses detectable as a \u2018sound\u2019 with diagnostic medical technology such as a transvaginal ultrasound device.\u201d<\/p>\n<p>The court referred to that \u201cmoment in time\u201d as the point in time upon when a heartbeat is detected, which medical data suggests 95 percent of unborn children are likely to reach live birth after the heartbeat is detected.<\/p>\n<p>\u201cThe only point in the progression of a pregnancy when cardiac activity goes from \u2018cannot be detected\u2019 to \u2018detected\u2019 is the point in time\u2026 when the [legislature] intended to ban most abortions,\u201d the decision reads. \u201cWhile we do not frame our holding today in the shorthand terms of a number of weeks, the biologically identifiable moment in time we hold is the \u2018fetal heartbeat\u2019 under the 2023 Act occurs in most instances at approximately six weeks of pregnancy.\u201d<\/p>\n<p>The court also noted that throughout all of its litigation against the South Carolina\u2019s \u201cfetal heartbeat\u201d law, Planned Parenthood never said anything about a nine-week timeframe until now. In addition to stating that the law\u2019s text was \u201creliable evidence\u201d of legislative intent, the court also took into account how legislators referred to the law itself as a \u201csix-week ban\u201d at least 60 times during the legislative process.<\/p>\n<p>The law\u2019s plain meaning and universal reference as a \u201csix-week ban\u201d demonstrates \u201cconclusively\u201d that the legislature did not intend to allow abortions beyond six weeks as Planned Parenthood now argued, concluded Justice Few.<\/p>\n<p>Liberty Counsel\u2019s Founder and Chairman Mat Staver said, \u201cHuman life is a gift from our Creator.
