{"id":331079,"date":"2025-05-12T15:38:32","date_gmt":"2025-05-12T20:38:32","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=331079"},"modified":"2025-05-12T13:47:41","modified_gmt":"2025-05-12T18:47:41","slug":"texas-ban-obscene-material-educational-purposes","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/texas-ban-obscene-material-educational-purposes\/","title":{"rendered":"Texas bill would ban &#8216;obscene&#8217; material used with children for &#8216;educational&#8217; purposes"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">A bipartisan bill (<a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=SB412\">SB 412<\/a>) passed by the Texas State Legislature, &#8220;<a href=\"https:\/\/capitol.texas.gov\/tlodocs\/89R\/billtext\/pdf\/SB00412F.pdf#navpanes=0\">An Act<\/a> <\/span>relating to defenses to prosecution for certain offenses involving material or conduct that is obscene or otherwise harmful to children,&#8221; has been sent to the governor&#8217;s desk for his signature.<\/p>\n<p>Currently, Texas exempts educators and schools from laws intended to protect children from harmful exposure to sexual content. This bill will close that loophole, known as an &#8220;affirmative defense&#8221; loophole, <span style=\"font-weight: 400;\">written into<\/span> <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/PE\/pdf\/PE.43.pdf\"><span style=\"font-weight: 400;\">Texas state penal code 43.25<\/span><\/a><span style=\"font-weight: 400;\"> in the late 1970s and heavily influenced by &#8220;<a href=\"https:\/\/archive.liveaction.org\/news\/alfred-kinsey-pedophilic-research-school-sex-ed\/\">Father of the Sexual Revolution<\/a>&#8221; Alfred Kinsey. Kinsey&#8217;s well-known\u00a0&#8216;research&#8217; involved the gathering of &#8216;data&#8217; obtained by pedophiles as they sexually abused infants and children.<\/span><\/p>\n<p>Since that time, these Kinsey-inspired exemptions have allowed sexually perverse content to make its way into books and curriculum used for explicit sex-ed programs taught to children \u2014 without legal ramifications, since it was all allegedly promoted for reasons of &#8220;a bona fide educational, medical, psychological, psychiatric, judicial, law enforcement, or legislative purpose.&#8221; This bill would remove that language from the law.<\/p>\n<p><span style=\"font-weight: 400;\">Current Texas code and similar codes in other states were instituted by the <a href=\"https:\/\/www.ali.org\/\">American Law Institute&#8217;s<\/a> Model Penal Code, <a href=\"https:\/\/www.pbs.org\/wgbh\/americanexperience\/features\/kinsey-timeline\/#:~:text=Citing%20Kinsey%2C%20the%20American%20Law,legalizing%20homosexual%20and%20anal%20sex.&amp;text=August%2025:%20Alfred%20Kinsey%20dies,Clara%20will%20live%20until%201982.\">published in 1955<\/a>, citing Kinsey&#8217;s disputed &#8216;research.&#8217; According to <a href=\"https:\/\/thetexan.news\/issues\/criminal-justice\/texas-legislature-removes-education-exception-for-pornography-sexual-performance-of-a-child\/article_81a79258-fd96-48e1-b6d3-111882ebff06.html\">The Texan<\/a>, Texas joins five other states that have removed these dangerous loopholes to protect children from pornographic content and explicit materials found in books and other materials used in schools.\u00a0<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/sex-ed-leader-prenatal-development-stigmatize-abortion\/\"><em>Sex ed \u2018leader\u2019 slams prenatal development education because it might \u2018stigmatize\u2019 abortion<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Many of these explicit books and materials not only graphically detail and encourage casual sex, incest, rape, and murder \u2014\u00a0as<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-coalition-sexually-graphic-books-schools\/\"><span style=\"font-weight: 400;\">Live Action News previously<\/span><\/a><span style=\"font-weight: 400;\"> reported \u2014 but also promote abortions. Currently, Texas still allows schools to use the &#8220;national sex education standards,&#8221; which are set by <a href=\"https:\/\/archive.liveaction.org\/news\/where-todays-sex-ed-came-from-matters\/\">sex miseducators<\/a> who are part of the Future of Sex Education (FoSE) coalition \u2014 groups such as Planned Parenthood, SIECUS, and Advocates for Youth.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Live Action News previously reported how the American Library Association and the National Coalition Against Censorship \u00a0promote sexually explicit books in collaboration with the<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-coalition-sexually-graphic-books-schools\/\"><span style=\"font-weight: 400;\">FoSE<\/span><\/a><a href=\"https:\/\/archive.liveaction.org\/news\/defund-planned-parenthood-extremist-coalition-sex-miseducators\/\"><span style=\"font-weight: 400;\"> coalition<\/span><\/a><span style=\"font-weight: 400;\">. Planned Parenthood has openly admitted that its support of such books <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-coalition-sexually-graphic-books-schools\/\">serves as a way<\/a> for children to gain access to the materials, even if they live in states that do not promote explicit sex education.<\/span><\/p>\n<p>A different bill, <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=SB1396\"><span style=\"font-weight: 400;\">SB 1396<\/span><\/a>, <span style=\"font-weight: 400;\">aims to prohibit &#8220;the adoption or use of national sex education standards&#8221; in Texas schools.
