The\u00a0<a href=\"https:\/\/www.hawley.senate.gov\/wp-content\/uploads\/2025\/05\/Hawley-Restoring-Safeguards-for-Dangerous-Abortion-Drugs-Act.pdf\" target=\"_blank\" rel=\"noopener\">legislation<\/a> would also prohibit importation of abortion drugs and enable women harmed by the abortion pill to sue for both physical and emotional distress.<\/p>\n<p>The proposal follows a move by the Trump DOJ to <a href=\"https:\/\/archive.liveaction.org\/news\/trump-doj-calls-dismissal-lawsuit-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">dismiss<\/a> an important abortion pill lawsuit \u2014\u00a0something Sen. Hawley <a href=\"https:\/\/x.com\/HawleyMO\/status\/1919729978796597494\" target=\"_blank\" rel=\"noopener\">called<\/a> a &#8216;mistake.&#8221;<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Today I\u2019m calling on the Justice Department to reverse their defense of Joe Biden\u2019s abortion policy. Hawley&#8217;s proposal seeks to remedy changes made to the abortion pill&#8217;s safety protocols; it would &#8220;require the Secretary of Health and Human Services to approve a risk evaluation and mitigation strategy for mifepristone that is identical to the strategy previously approved, and for other purposes.&#8221;<\/p>\n<p>The bill would require the following:<\/p>\n<p style=\"padding-left: 40px;\"><em>Not later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services shall: (1) withdraw approval of the risk evaluation and mitigation strategy pursuant to section 505\u20131 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 355\u20131) for the covered medication that is in effect on the date of enactment of this Act; and (2) approve a risk evaluation and mitigation strategy for the covered medication that is identical to the risk evaluation and mitigation strategy for such covered medication that was approved by such Secretary in June 2011.<\/em><\/p>\n<p>The legislation seeks to hold a &#8220;telehealth provider, pharmacy, or any other person who knowingly imports or transports a covered medication in interstate or foreign commerce in violation of section 1462 of title 18, United States Code [otherwise known as the <a href=\"https:\/\/archive.liveaction.org\/news\/federal-law-prohibit-abortion-drugs-mail-enforced\/\" target=\"_blank\" rel=\"noopener\">Comstock Act<\/a>]&#8230; liable&#8230; to any individual who suffers bodily injury or harm to mental health (including any physical, psychological, emotional, or physiological harm) that is attributable, in whole or in part, to the individual\u2019s use&#8221; of the abortion pill.<\/p>\n<p>In addition, &#8220;An individual who suffers bodily injury or harm to mental health&#8221; attributable to the abortion pill may file a private right of action and &#8220;bring a civil action against the covered entity in an appropriate district court of the United States or a State court of competent jurisdiction for\u2014(1) compensatory damages; (2) punitive damages; and (3) attorney\u2019s fees and costs,&#8221; the proposal states.<\/p>\n<p>Last month, Hawley &#8220;<a href=\"https:\/\/outreach.senate.gov\/iqextranet\/iqClickTrk.aspx?&amp;cid=SenHawley&amp;crop=14414QQQ9839614QQQ8550706QQQ8019990&amp;report_id=&amp;redirect=https%3a%2f%2fwww.hawley.senate.gov%2fhawley-calls-on-fda-to-reinstate-abortion-drug-safety-regulations-the-time-to-act-is-now%2f&amp;redir_log=933953943146828\" target=\"_blank\" rel=\"noreferrer noopener\">sent<\/a> a letter to FDA Commissioner Marty Makary, directing his attention to the new mifepristone study&#8230;and urging action to reinstate safeguards,&#8221; his office stated.<\/p>\n<div class=\"video-container\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">I\u2019m calling on the FDA to reinstate safety regulations on the chemical abortion drug immediately. New data out today show a massive number of severe medical side effects <a href=\"https:\/\/t.co\/mimdopobrG\">pic.twitter.com\/mimdopobrG<\/a><\/p>\n<p>&mdash; Josh Hawley (@HawleyMO) <a href=\"https:\/\/twitter.com\/HawleyMO\/status\/1916937209350852747?ref_src=twsrc%5Etfw\">April 28, 2025<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<p><strong>FDA&#8217;s REMS Safety Requirements<\/strong><\/p>\n<p>Shortly after the abortion pill was approved in 2000, the <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-dangerous-safety-requirement\/\" target=\"_blank\" rel=\"noopener\">reporting<\/a> of deaths began, causing the manufacturer to issue letters of warning to health care professionals. The cause of the deaths and ensuing adverse events drew concerns from the U.S. Food and Drug Administration (FDA). By April 2011, the FDA had <a href=\"https:\/\/web.archive.org\/web\/20111124185318\/https:\/\/www.fda.gov\/downloads\/Drugs\/DrugSafety\/PostmarketDrugSafetyInformationforPatientsandProviders\/UCM263353.pdf\" target=\"_blank\" rel=\"noopener\">reported<\/a> over 2,200 adverse effects and post-marketing reports <a href=\"https:\/\/web.archive.org\/web\/20111124185318\/https:\/\/www.fda.gov\/downloads\/Drugs\/DrugSafety\/PostmarketDrugSafetyInformationforPatientsandProviders\/UCM263353.pdf\" target=\"_blank\" rel=\"noopener\">showed<\/a> 14 women&#8217;s deaths*, 612 hospitalizations, 339 blood transfusions, and several hundred reported cases of infection \u2014\u00a0some severe \u2014 related to the abortion pill <a href=\"https:\/\/archive.liveaction.org\/news\/mifepristone-miscarriage-cushing-syndrome\/\" target=\"_blank\" rel=\"noopener\">mifepristone (200mg<\/a>).<\/p>\n<p>It was in this year\u00a0that the FDA\u00a0<a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/appletter\/2011\/020687s014ltr.pdf\" target=\"_blank\" rel=\"noopener\">determined<\/a> a <a href=\"https:\/\/www.accessdata.fda.gov\/scripts\/cder\/rems\/index.cfm?event=RemsDetails.page&amp;REMS=390\" target=\"_blank\" rel=\"noopener\">REMS<\/a> (Risk Evaluation and Mitigation Strategy), was <em>necessary<\/em> for mifepristone. The <a href=\"https:\/\/www.fda.gov\/drugs\/drug-safety-and-availability\/risk-evaluation-and-mitigation-strategies-rems\" target=\"_blank\" rel=\"noopener\">FDA<\/a> defines this as &#8220;a drug safety program that the U.S. Food and Drug Administration (FDA) can require for certain medications with serious safety concerns to help ensure the benefits of the medication outweigh its risks,&#8221; which &#8220;are designed to reinforce medication use behaviors and actions that support the safe use of that medication.&#8221;<\/p>\n<p>While all medications have labeling that informs health care stakeholders about medication risks,&#8221; the FDA says, &#8220;only a few medications require a REMS.&#8221;<\/p>\n<p>In 2016, the Obama administration FDA\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/biden-fda-commissioner-expanded-abortion-pill-obama\/\" target=\"_blank\" rel=\"noopener\">weakened the REMS<\/a>\u00a0by\u00a0<em>removing<\/em> two requirements: 1) that the drug be taken in front of a clinician in-person at the location of a certified prescriber, and 2) that the manufacturer report the drug\u2019s <em>non-fatal adverse events\u00a0<\/em>(complications). The drug\u2019s allowed use was also extended for use on preborn children up to\u00a0<a href=\"https:\/\/babyolivia.liveaction.org\/assets\/img\/Download-Bundle\/Week-7\/Olivia-Week07-3.jpg\" target=\"_blank\" rel=\"noopener\">10 weeks (70 days)<\/a>\u00a0of pregnancy.<\/p>\n<p>In 2020, the abortion industry rolled out a \u2018<a href=\"https:\/\/archive.liveaction.org\/news\/no-test-abortion-pill-protocol-access-safety\/\">no-test<\/a>\u2018 abortion pill protocol, removing the requirement for pre-abortion labs, testing, and bloodwork needed to accurately date a pregnancy and <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-abortion-pill-fda-ectopic\/\" target=\"_blank\" rel=\"noopener\">rule out<\/a> potentially fatal ectopic pregnancies. Rapid expansion of the abortion pill continued in the following years, with the abortion industry openly <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-industry-abortion-pill-fda-limits\/\" target=\"_blank\" rel=\"noopener\">flouting FDA gestational limits and safety regulations<\/a> and encouraging <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-conceal-abortion-pill-complications\/\" target=\"_blank\" rel=\"noopener\">women to lie<\/a> to ERs about their abortion pill complications.<\/p>\n<p>In April <a href=\"https:\/\/archive.liveaction.org\/news\/fda-letter-permits-abortion-pill-by-mail-during-the-covid-19\/\" target=\"_blank\" rel=\"noopener\">2021<\/a>, under the guise of the\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-industry-covid-19-expand-2020\/\" target=\"_blank\" rel=\"noopener\">COVID-19 pandemic<\/a>, the Biden administration FDA <a href=\"https:\/\/archive.liveaction.org\/news\/pharmacy-partnerships-emerge-ship-abortion-pills-mail\/\">expanded<\/a> the REMS and temporarily enabled abortion pill distribution by\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-pharmacy-operates-used-car-dealership\/\">mail-order pharmacy<\/a>\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/california-pharmacy-first-us-ship-abortion-pill\/\">distribution<\/a>. By December 2021, the Biden FDA had further <a href=\"https:\/\/archive.liveaction.org\/news\/fda-permanently-loosens-abortion-pill-safety-measure\/\" target=\"_blank\" rel=\"noopener\">weakened<\/a>\u00a0the\u00a0<a href=\"https:\/\/www.fda.gov\/drugs\/drug-safety-and-availability\/risk-evaluation-and-mitigation-strategies-rems\" target=\"_blank\" rel=\"noopener\">REMS<\/a>\u00a0by eliminating the\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/fda-removes-abortion-pill-safety-protocols-drug\/\" target=\"_blank\" rel=\"noopener\">in-person dispensing requirement<\/a> and allowing the drug to be permanently <a href=\"https:\/\/archive.liveaction.org\/news\/fda-permanently-loosens-abortion-pill-safety-measure\/\" target=\"_blank\" rel=\"noopener\">shipped by mail<\/a>.<\/p>\n<p>The Biden FDA further gutted the REMS in January 2023, <a href=\"https:\/\/archive.liveaction.org\/news\/fda-retail-pharmacies-abortion-pills-prescription\/\" target=\"_blank\" rel=\"noopener\">allowing retail pharmacies to dispense the drug<\/a>. According to the <a href=\"https:\/\/archive.liveaction.org\/news\/fda-report-casualties-abortion-pill-climb\/\">FDA<\/a>, between 2000 and December 2024, \u201capproximately\u00a0<strong>7.5 million women<\/strong>\u201d used the drug to end preborn babies&#8217; lives. In addition, 36 deaths* of women associated with the drug were also reported.<\/p>\n<p><strong>Banning Import of the Drug<\/strong><\/p>\n<p>Hawley&#8217;s proposal seeks to amend &#8220;Section 801 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 381) by inserting mifepristone, and adding that &#8220;Notwithstanding any other provision of law, no person may import the drug mifepristone into the United States, including by mailing such drug to individuals.\u2019\u2019<\/p>\n<p>Prior to\u00a0<em>Roe v. Wade<\/em>, abortion advocates\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/thousands-women-werent-dying-abortion\/\" target=\"_blank\" rel=\"noopener\">portrayed<\/a>\u00a0so-called self-abortions as\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/politifact-abortion-expert-debunked-illegal-statistcs\/\" target=\"_blank\" rel=\"noopener\">dangerous<\/a>. But once Big Abortion began <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-industry-capitalize-covid-19-expand\/\" target=\"_blank\" rel=\"noopener\">toying with the idea<\/a> of \u2018no-test\u2019 abortion pill protocols and mail-order telabortion schemes (including an over-the-counter abortion pill push), suddenly, self-managed abortion became \u201csafe.\u201d Today, Big Abortion is <a href=\"https:\/\/archive.liveaction.org\/news\/big-abortion-avoids-buries-pill-complications\/\" target=\"_blank\" rel=\"noopener\">unconcerned<\/a> about the harms of\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/self-managed-abortion-safety-narrative-changes\/\" target=\"_blank\" rel=\"noopener\">self-managed abortions<\/a>, keeping silent as\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-underground-preps-post-roe-america\/\" target=\"_blank\" rel=\"noopener\">underground<\/a>\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-vigilante-dispense-drugs\/\" target=\"_blank\" rel=\"noopener\">abortion pill vigilantes<\/a>\u00a0and \u2018<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-shadow-network-countless-break-law\/\" target=\"_blank\" rel=\"noopener\">shadow networks<\/a>&#8216; <a href=\"https:\/\/archive.liveaction.org\/news\/skirting-state-laws-abortion-pill-basements\/\" target=\"_blank\" rel=\"noopener\">assemble<\/a> abortion pills stored on ping-pong tables in basements, where they could be <a href=\"https:\/\/archive.liveaction.org\/news\/dea-warns-fake-prescriptions-deadly-abortion-pills\/\" target=\"_blank\" rel=\"noopener\">laced<\/a> with harmful substances, and import them into the U.S.<\/p>\n<p>Groups like Aid Access openly imported abortion pills into the U.S. <a href=\"https:\/\/twitter.com\/CBSMornings\/status\/1658829197949784064?s=20\" target=\"_blank\" rel=\"noopener\">through India<\/a>\u00a0<em>without<\/em> FDA approval, and in <a href=\"https:\/\/archive.liveaction.org\/news\/funded-bill-gates-abortion-pill-worldwide\/\" target=\"_blank\" rel=\"noopener\">2019<\/a>, the FDA <a href=\"https:\/\/www.fda.gov\/inspections-compliance-enforcement-and-criminal-investigations\/warning-letters\/aidaccessorg-575658-03082019\">issued<\/a> the group a\u00a0<a href=\"https:\/\/www.fda.gov\/inspections-compliance-enforcement-and-criminal-investigations\/warning-letters\/aidaccessorg-575658-03082019\" target=\"_blank\" rel=\"noopener\">warning letter<\/a> to cease shipments \u2014 but, until recently, this went ignored. Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/gates-funded-abortion-pill-supplier-manufacturer-shoddy\/\" target=\"_blank\" rel=\"noopener\">previously documented<\/a> how the Gates-funded DKT International, which <a href=\"https:\/\/archive.liveaction.org\/news\/funded-bill-gates-abortion-pill-worldwide\/\">sells millions of abortion pills globally<\/a>, may be shipping abortion drugs into the U.S., manufactured by the Delhi-based Synokem Pharmaceuticals Ltd \u2014\u00a0alleged to have a \u201cshoddy quality record,\u201d according to <a href=\"https:\/\/www.bloomberg.com\/news\/features\/2023-08-01\/abortion-pill-provider-buys-from-indian-manufacturer-with-bad-quality-record#xj4y7vzkg\" target=\"_blank\" rel=\"noopener\">Bloomberg<\/a>.<\/p>\n<p>Hawley&#8217;s proposal seeks to end this deliberate violation of FDA safety regulations by banning the import of unapproved abortion drugs into the U.S. This is not a new concept; the drug was on the <a href=\"https:\/\/web.archive.org\/web\/20170817162154\/https:\/\/digital.library.unt.edu\/ark:\/67531\/metacrs1360\/m1\/1\/high_res_d\/RL30866_2001Feb23.pdf\">prohibited import list<\/a> (Import\u00a0Alert <a href=\"http:\/\/web.archive.org\/web\/20000304063251\/https:\/\/www.fda.gov\/ora\/fiars\/ora_import_ia6647.html\" target=\"_blank\" rel=\"noopener\">66-47<\/a>) around the time of its U.S. approval.<\/p>\n<p>&#8220;Questions have been raised about the abortifacient product, RU486 or &#8216;Mifepristone&#8217; (Import Bulletin 66-B13 9\/26\/88) and whether the agency should use its discretion, pursuant to the Regulatory Procedures Manual chapter 9-71, &#8216;Coverage of Personal Importations&#8217; (12\/11\/89), or otherwise, to allow its importation for personal use,&#8221; the original <a href=\"https:\/\/web.archive.org\/web\/20000824034140\/http:\/\/www.fda.gov\/ora\/fiars\/ora_import_ia6647.html\" target=\"_blank\" rel=\"noopener\">import ban<\/a> seen in the image below stated. &#8220;&#8230; The intended use of such drugs could pose a risk to the safety of the user&#8230; Automatically detain all shipments of unapproved abortifacient drugs,&#8221; the ban stated at that time.<\/p>\n<div id=\"attachment_330901\" style=\"width: 704px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-330901\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-330901 size-full\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/05\/FDA-Import-Ban-on-abortion-pill-RU486-1980s.jpg\" alt=\"FDA Import Ban on abortion pill RU486 1980s\" width=\"694\" height=\"1179\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/05\/FDA-Import-Ban-on-abortion-pill-RU486-1980s.jpg 694w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/05\/FDA-Import-Ban-on-abortion-pill-RU486-1980s-177x300.jpg 177w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/05\/FDA-Import-Ban-on-abortion-pill-RU486-1980s-412x700.jpg 412w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/05\/FDA-Import-Ban-on-abortion-pill-RU486-1980s-500x849.jpg 500w\" sizes=\"(max-width: 694px) 100vw, 694px\" \/><p id=\"caption-attachment-330901\" class=\"wp-caption-text\">FDA Import Ban on abortion pill RU486 1980s<\/p><\/div>\n<p><strong>Reactions<\/strong><\/p>\n<p>Medical malpractice attorney Michael Seibel, who successfully sued the infamous <a href=\"https:\/\/archive.liveaction.org\/news\/two-abortionists-estimated-killed-300000-human-beings\/\" target=\"_blank\" rel=\"noopener\">serial abortionist<\/a>\u00a0Curtis Boyd after the <a href=\"https:\/\/archive.liveaction.org\/news\/amber-thurman-pro-abortion-state-keisha-atkins\/\" target=\"_blank\" rel=\"noopener\">abortion-related death<\/a> of patient Keisha Atkins, praised Hawley&#8217;s move.<\/p>\n<p>&#8220;This bill will finally give relief to the millions of women suffering the emotional effects from <a href=\"https:\/\/www.liveaction.org\/i-saw-my-baby\/\" target=\"_blank\" rel=\"noopener\">seeing<\/a> their baby after an abortion,&#8221; Seibel told Live Action News, adding that this proposal would also &#8220;give private attorneys an enforcement provision against the abortion industry which understates the extreme psychological risk of the chemical abortion pill.&#8221;<\/p>\n<p>Removing in-person dispensing of the abortion pill has placed all responsibility onto the woman to play the role of doctor, nurse, and pathologist. Today, women report experiencing <a href=\"https:\/\/archive.liveaction.org\/news\/women-unprepared-abortion-pill-pain-blood-clots\/\" target=\"_blank\" rel=\"noopener\">excruciating pain<\/a> and being <a href=\"https:\/\/archive.liveaction.org\/news\/traumatized-wish-never-abortion-pill-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">traumatized<\/a> when witnessing the bodies of their dead babies in the toilet after self-managed abortions. In addition, a <a href=\"https:\/\/archive.liveaction.org\/news\/womans-death-septic-abortion-pill-lawsuit\/\" target=\"_blank\" rel=\"noopener\">wrongful death lawsuit<\/a>\u00a0filed in the State of Nevada after a 24-year-old mother allegedly died from a \u2018septic abortion\u2019 just days after obtaining the abortion pill at Planned Parenthood, revealed how harmful taking these drugs can be on women.<\/p>\n<p>Abortion drugs are intended to violently end the lives of innocent babies. In <a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/10.1111\/psrh.12294\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onlinelibrary.wiley.com\/doi\/10.1111\/psrh.12294&amp;source=gmail&amp;ust=1744238194801000&amp;usg=AOvVaw0YyLaelc6LiuNGLsQFnp83\">February of 2025,<\/a> the Guttmacher Institute <a href=\"https:\/\/archive.liveaction.org\/news\/new-report-abortion-numbers-end-roe\/\" target=\"_blank\" rel=\"noopener\">estimated<\/a> that in 2023, <strong>648,500 <\/strong>abortion pill abortions were committed in states which legally permitted them. This translates to at least <strong>54,042<\/strong> preborn lives lost to abortion pills monthly, <strong>1,777<\/strong>\u00a0daily,\u00a0<strong>74<\/strong> hourly, and one <strong>every 49 seconds<\/strong>.<\/p>\n<h5>*The FDA has received reports of serious adverse events in patients who took mifepristone. As of December 31, 2024, there were <a href=\"https:\/\/www.fda.gov\/media\/185245\/download?attachment\">36 reports<\/a> of deaths in patients associated with mifepristone since the product was approved in September 2000.
