FDA,<\/em><\/a> claiming the states do not have jurisdiction to file their case in Texas.<\/p>\n<p>&#8220;The Trump administration\u2019s request makes no mention of the merits of the case, which have not yet been considered by the courts. Rather, echoing the argument that the Biden administration made shortly before Mr. Trump took office, the court filing asserts that the case does not meet the legal standard to be heard in the federal district court in which it was filed,&#8221; <a href=\"https:\/\/www.nytimes.com\/2025\/05\/05\/health\/trump-abortion-pill-case.html#:~:text=Abortion%20pills%20are%20prescribed%20up,set%20by%20Roe%20v.%20Wade.\" target=\"_blank\" rel=\"noopener\">wrote<\/a> the New York Times (NYT).<\/p>\n<p>In the 2024 <a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-supreme-court-abortion-pill-access\/\" target=\"_blank\" rel=\"noopener\">presidential debate<\/a>, Trump made it clear that he had no intentions of restricting the abortion pill, and some speculate whether this move was motivated by that position.<\/p>\n<div class=\"video-container\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The FDA has no authority to approve or allow companies to market drugs intended to kill human beings. <a href=\"https:\/\/t.co\/m1BA4jodWm\">https:\/\/t.co\/m1BA4jodWm<\/a><\/p>\n<p>&mdash; Live Action (@LiveAction) <a href=\"https:\/\/twitter.com\/LiveAction\/status\/1919549538374713431?ref_src=twsrc%5Etfw\">May 6, 2025<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<p><strong>What is the Lawsuit?<\/strong><\/p>\n<p>The lawsuit was originally filed in Amarillo, Texas, by plaintiff doctors in the Alliance for Hippocratic Medicine (AHM); however, last year, the U.S. Supreme Court <a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-supreme-court-abortion-pill-access\/\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that those plaintiff doctors <em>did not have standing to sue<\/em>. Then in <a href=\"https:\/\/archive.liveaction.org\/news\/judge-rules-states-intervene-abortion-pill-lawsuit\/\" target=\"_blank\" rel=\"noopener\">January<\/a>, Judge Kacsmaryk <a href=\"https:\/\/assets.aclu.org\/live\/uploads\/2023\/06\/177117394490.pdf\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that the states of Missouri, Kansas, and Idaho could intervene and file a complaint in the lawsuit.<\/p>\n<p>In their <a href=\"https:\/\/s3.documentcloud.org\/documents\/25222818\/mifepristone-complaint.pdf\" target=\"_blank\" rel=\"noopener\">October 2024 petition<\/a>, the three states argued that their \u201csovereign\u201d interest in \u201cprotecting\u2026 citizens\u201d was violated by the Food and Drug Administration\u2019s (FDA) decision to allow mail-order abortion pill dispensing.<\/p>\n<p>&#8220;In rolling back safeguard after safeguard, the FDA has turned a blind eye to the known harms of abortion drugs to the detriment of women and girls,&#8221; they claimed.<\/p>\n<p><strong>Abortion Pill Timeline<\/strong><\/p>\n<p>In 1994, with the\u00a0<a href=\"https:\/\/archive.hhs.gov\/news\/press\/1994pres\/940516.txt\">encouragement<\/a>\u00a0of the Clinton administration, Roussel-Uclaf assigned the\u00a0<a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/appletter\/2000\/20687appltr.pdf\">U.S. rights<\/a>\u00a0of marketing and\u00a0<a href=\"http:\/\/www.fda.gov\/downloads\/Drugs\/DrugSafety\/PostmarketDrugSafetyInformationforPatientsandProviders\/ucm086149.pdf\" target=\"_blank\" rel=\"noopener\">distribution<\/a>\u00a0of the abortion pill (known then as RU-486) to the eugenics-founded\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/population-council-founded-eugenicists-promoting-abortion-turns-65\/\" target=\"_blank\" rel=\"noopener\">Population Council<\/a>. The right to distribute the drugs was\u00a0<a href=\"http:\/\/www.nytimes.com\/2000\/09\/30\/us\/abortion-pill-distributor-energized-by-new-mission.html\">later<\/a>\u00a0handed over to Danco Laboratories, a\u00a0<a href=\"http:\/\/caselaw.findlaw.com\/ny-supreme-court-appellate-division\/1151610.html\">sub-licensee<\/a>\u00a0of the Population Council.\u00a0Then, by\u00a01996, the Population Council (funded in part with\u00a0<a href=\"https:\/\/twitter.com\/CaroleNovielli\/status\/1628441678490005509\" target=\"_blank\" rel=\"noopener\">investments<\/a>\u00a0from the Buffett and Packard Foundations) submitted its\u00a0<a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/nda\/2000\/20687_Mifepristone_approvableltr.pdf\" target=\"_blank\" rel=\"noopener\">application<\/a>\u00a0for the drug to the FDA, and a series of clinical trials began.<\/p>\n<p>In <a href=\"https:\/\/archive.liveaction.org\/news\/fda-abortion-pill-timeline-events\/\" target=\"_blank\" rel=\"noopener\">2000<\/a>, the U.S. FDA <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/appletter\/2000\/20687appltr.pdf\" target=\"_blank\" rel=\"noopener\">approved<\/a> mifepristone (200mg) as an abortion pill for use <a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/label\/2011\/020687s014lbl.pdf\" target=\"_blank\" rel=\"noopener\">up to seven (7) weeks of pregnancy<\/a>\u00a0in a regimen along with the drug misoprostol.<\/p>\n<p>In 2016, the Obama administration FDA <a href=\"https:\/\/archive.liveaction.org\/news\/biden-fda-commissioner-expanded-abortion-pill-obama\/\" target=\"_blank\" rel=\"noopener\">weakened the REMS<\/a>\u00a0by\u00a0<em>removing<\/em>\u00a0the requirements that women or teen girls take the first drug in front of a clinician, in-person at the location of a certified prescriber and that the manufacturer report the drug\u2019s\u00a0<em>non-fatal adverse events\u00a0<\/em>(complications). The drug\u2019s allowed use was also extended for use on preborn children up to\u00a0<a href=\"https:\/\/babyolivia.liveaction.org\/assets\/img\/Download-Bundle\/Week-7\/Olivia-Week07-3.jpg\" target=\"_blank\" rel=\"noopener\">10 weeks (70 days)<\/a>\u00a0of pregnancy.<\/p>\n<p>Then, in 2019, the FDA approved <a href=\"https:\/\/archive.liveaction.org\/news\/generic-abortion-pill-genbiopro-nationwide-market\/\" target=\"_blank\" rel=\"noopener\">GenBioPro (GBP)<\/a> (which was <a href=\"https:\/\/archive.liveaction.org\/news\/generic-abortion-pill-manufacturer-economic-interests-lawsuit\/\" target=\"_blank\" rel=\"noopener\">recently granted<\/a> permission to join the lawsuit) to become the <a href=\"https:\/\/archive.liveaction.org\/news\/women-die-abortion-pill-fda-generic\/\" target=\"_blank\" rel=\"noopener\">generic manufacturer<\/a> of mifepristone.<\/p>\n<p>In 2020, the abortion industry rolled out a \u2018<a href=\"https:\/\/archive.liveaction.org\/news\/no-test-abortion-pill-protocol-access-safety\/\">no-test<\/a>\u2018 abortion pill protocol which removed important labs, testing, and bloodwork needed to accurately date a pregnancy and <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-abortion-pill-fda-ectopic\/\" target=\"_blank\" rel=\"noopener\">rule out<\/a> potentially fatal ectopic pregnancies before administering the abortion pill. Rapid expansion of the abortion pill continued in the ensuing years, even as the abortion industry openly <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-industry-abortion-pill-fda-limits\/\" target=\"_blank\" rel=\"noopener\">flouted FDA gestational limits and safety regulations<\/a> and encouraged <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-conceal-abortion-pill-complications\/\" target=\"_blank\" rel=\"noopener\">women to lie<\/a>\u00a0about abortion pill complications.<\/p>\n<p>In April of <a href=\"https:\/\/archive.liveaction.org\/news\/fda-letter-permits-abortion-pill-by-mail-during-the-covid-19\/\" target=\"_blank\" rel=\"noopener\">2021<\/a>, under the guise of the\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-industry-covid-19-expand-2020\/\" target=\"_blank\" rel=\"noopener\">COVID-19 pandemic<\/a>, the Biden administration FDA temporarily enabled abortion pill distribution and\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/pharmacy-partnerships-emerge-ship-abortion-pills-mail\/\">expanded<\/a>\u00a0the REMS to limited\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-pharmacy-operates-used-car-dealership\/\">mail-order pharmacy<\/a>\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/california-pharmacy-first-us-ship-abortion-pill\/\">distribution<\/a>.\u00a0By\u00a0December of 2021, the Biden FDA had further\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/fda-permanently-loosens-abortion-pill-safety-measure\/\" target=\"_blank\" rel=\"noopener\">weakened<\/a>\u00a0the\u00a0<a href=\"https:\/\/www.fda.gov\/drugs\/drug-safety-and-availability\/risk-evaluation-and-mitigation-strategies-rems\" target=\"_blank\" rel=\"noopener\">REMS<\/a>\u00a0by eliminating the\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/fda-removes-abortion-pill-safety-protocols-drug\/\" target=\"_blank\" rel=\"noopener\">in-person dispensing requirement<\/a>\u00a0and enabling the abortion pill to be permanently\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/fda-permanently-loosens-abortion-pill-safety-measure\/\" target=\"_blank\" rel=\"noopener\">shipped by mail<\/a>.<\/p>\n<p>In January 2023, the Biden FDA further gutted the REMS by announcing it would <a href=\"https:\/\/archive.liveaction.org\/news\/fda-retail-pharmacies-abortion-pills-prescription\/\" target=\"_blank\" rel=\"noopener\">allow retail pharmacies to dispense the drug<\/a>. The FDA <a href=\"https:\/\/archive.liveaction.org\/news\/fda-report-casualties-abortion-pill-climb\/\" target=\"_blank\" rel=\"noopener\">recently documented<\/a> that between 2000 and December 2024 \u201capproximately <strong>7.5 million women\u201d <\/strong>have used the drug to end their pregnancies.<\/p>\n<p><strong>DOJ&#8217;s Request for Dismissal\u00a0<\/strong><\/p>\n<p>&#8220;The States do not dispute that their Amended Complaint, standing alone, does not establish venue in this District,&#8221; DOJ&#8217;s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.370067\/gov.uscourts.txnd.370067.247.0.pdf\" target=\"_blank\" rel=\"noopener\">response<\/a> to Danco&#8217;s motion to dismiss stated. &#8220;Instead, they contend that &#8216;[b]ecause venue was valid when the States intervened, it has been satisfied.&#8217;\u201d<\/p>\n<p>&#8220;Essentially, the States argue that they can piggyback on the original Alliance plaintiffs\u2019 venue, notwithstanding that those plaintiffs were held to lack standing and have now voluntarily dismissed their claims. As explained previously, that approach is contrary to binding precedent requiring a jurisdictionally valid suit with proper venue for an intervenor to continue litigating in the original forum,&#8221; the DOJ&#8217;s claim read.<\/p>\n<p>Later, the DOJ claimed, &#8220;Because the original plaintiffs\u2019 suit was effectively never filed, the States cannot rely on any purported jurisdiction in the original suit to justify adjudication of the States\u2019 claims in this forum.&#8221;<\/p>\n<p>&#8220;Aside from this litigation, the States do not dispute that their claims have no connection to the Northern District of Texas,&#8221; the DOJ&#8217;s reply states. &#8220;At bottom, the States cannot keep alive a lawsuit in which the original plaintiffs were held to lack standing, those plaintiffs have now voluntarily dismissed their claims, and the States\u2019 own claims have no connection to this District. The States are free to pursue their claims in a District where venue is proper&#8230; but the States\u2019 claims before this Court must be dismissed or transferred pursuant to the venue statute\u2019s mandatory command.&#8221;<\/p>\n<p>&#8220;Regardless of the merits of the States\u2019 claims, the States cannot proceed in this Court. The States\u2019 Amended Complaint should be dismissed or transferred for lack of venue,&#8221; the DOJ <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.370067\/gov.uscourts.txnd.370067.247.0.pdf\" target=\"_blank\" rel=\"noopener\">added<\/a>.<\/p>\n<p><strong>Statute of Limitation<\/strong><\/p>\n<p>The DOJ argued that \u201cEven apart from improper venue, the States\u2019 Amended Complaint here should be dismissed for additional threshold reasons. The States lack Article III standing; they failed to exhaust their claims; and their challenge to FDA\u2019s 2016 actions is outside the six-year statute of limitations,\u201d they wrote.<\/p>\n<p>In other words, while claims made by AHM may have been filed under the six-year statute of limitations \u2013 it appears the DOJ is suggesting that the lawsuit by intervening Plaintiffs (three states) may not have been filed within the six-year statute of limitations to have a claim against the 2016 expansion of the drug. However, changes made by the FDA in 2021 (mail-order expansions as well as 2023 pharmacy expansion) should still apply.<\/p>\n<p>However, Supreme Court rulings in <em>Loper Bright Enterprises v. Raimondo <\/em>and <em>Corner Post <\/em>decisions suggest that the six-year statute of limitations could be more broadly decided. As Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-ruling-bureaucratic-power-impact-abortion\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>:<\/p>\n<p style=\"padding-left: 40px;\"><em>A\u00a0companion ruling in a separate case known as <\/em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-1008_1b82.pdf\">Corner Post, Inc. v. Board of Governors of the Federal Reserve System<\/a><em> could also impact the AHM case, according to the American Journal of Managed Care (AJMC): \u201c[T]he combination of the\u00a0Chevron\u00a0overturn, and\u00a0<a href=\"https:\/\/www.cnn.com\/2024\/07\/01\/politics\/corner-post-sec-supreme-court\/index.html\" target=\"_blank\" rel=\"nofollow noreferrer noopener\">the\u00a0<\/a><\/em><a href=\"https:\/\/www.cnn.com\/2024\/07\/01\/politics\/corner-post-sec-supreme-court\/index.html\" target=\"_blank\" rel=\"nofollow noreferrer noopener\">Corner Post<\/a><em><a href=\"https:\/\/www.cnn.com\/2024\/07\/01\/politics\/corner-post-sec-supreme-court\/index.html\" target=\"_blank\" rel=\"nofollow noreferrer noopener\">\u00a0ruling<\/a>\u00a0could open up a new set of challenges such that a court might entertain conflicting evidence that second-guesses the FDA\u2019s approval\u201d of the abortion pill mifepristone (200mg), the Journal wrote.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>The\u00a0<\/em>Corner Post <em><a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/corner-post-inc-v-board-of-governors-of-the-federal-reserve-system\/\" target=\"_blank\" rel=\"noopener\">ruling<\/a>\u00a0followed the Supreme Court ruling in\u00a0<\/em>Loper<em>.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>\u201c\u2026 [T]hey basically said that the effective date, the statute of limitations effectively for an APA case was not six years from a final regulation but six years from the date that it had an impact on an injured plaintiff. Meaning\u2026 you could have regulations that have been on the books for years and years and years, but when they\u2019re applied to a new class or a new plaintiff entity, they could be challenged anew\u2026 Read\u00a0Corner Post\u00a0hand in hand with\u00a0Loper Bright,\u201d Dean Rosen, Partner, Mehlman Consulting and former Chief Healthcare Advisor to Senate Majority Leader Bill Frist, stated in a July 2024\u00a0<a href=\"https:\/\/www.kff.org\/other\/event\/july-25-virtual-event-beyond-chevron-how-the-courts-decision-will-change-health-policy-legislating-and-rulemaking\/\" target=\"_blank\" rel=\"noopener\">webinar<\/a>\u00a0organized by KFF.org.<\/em><\/p>\n<p><strong>Impact a Ruling on Comstock Act<\/strong><\/p>\n<p>Ironically, the abortion pill lawsuit was also set to address the federal Comstock Act which restricts the shipment or mailing of \u201cabortifacient matter through express companies, common carriers, or interactive computer services.\u201d<\/p>\n<p>At least two U.S. Supreme Court Justices previously\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/four-shocking-admissions-supreme-court-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">hinted<\/a>\u00a0that the Comstock Act could be in play during oral\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=3gAHaGpADvk\" target=\"_blank\" rel=\"noopener\">arguments<\/a> in the\u00a0<em>AHM v. FDA <\/em>lawsuit.<\/p>\n<p>Today, even though abortion providers in <a href=\"https:\/\/archive.liveaction.org\/news\/showdown-abortion-laws-supreme-court-battle-comstock\/\" target=\"_blank\" rel=\"noopener\">multiple states<\/a>\u00a0are\u00a0<em>admittedly<\/em> shipping abortion drugs \u201cunlawfully\u201d into states that prohibit them or restrict telehealth dispensing, President Trump <a class=\" js-tealium-tracking \" href=\"https:\/\/www.youtube.com\/watch?v=dmfGRdlBq38\" target=\"_blank\" rel=\"noopener\" data-tracking=\"mpos=&amp;mid=&amp;lindex=&amp;lcol=\" aria-label=\" (Opens in a new window)\">told CBS News<\/a> that he would not use Comstock to ban mail delivery of the drugs, as <a href=\"https:\/\/www.politico.com\/news\/2024\/08\/20\/trump-comstock-enforcement-00175068\" target=\"_blank\" rel=\"noopener\">Politico<\/a> reported.<\/p>\n<p>\u201cThe federal government should have nothing to do with this issue,\u201d Trump stated last summer.<\/p>\n<p>In the current abortion pill litigation, the three states <a href=\"https:\/\/archive.liveaction.org\/news\/judge-rules-states-intervene-abortion-pill-lawsuit\/\" target=\"_blank\" rel=\"noopener\">argued<\/a>:<\/p>\n<p style=\"padding-left: 40px;\"><em>The FDA\u2019s 2021\/2023 Removal of the In-Person Dispensing Protection violates the federal laws that expressly prohibit the mailing or delivery by any letter carrier, express company, or other common carrier, or by interactive computer service, of any substance or drug intended for producing abortion\u201d by \u201cimpermissibly remov[ing] the in-person dispensing requirement for abortion drugs and, accordingly, authorized the downstream distribution of abortion drugs by mail, express company, other common carriers, and interactive computer service.<\/em><\/p>\n<p>&#8220;Because a federal agency cannot permit what federal law expressly prohibits, the FDA lacked legal authority when issuing the 2021\/2023 Removal of the In-Person Dispensing Protection,\u201d the lawsuit claimed. That decision \u201cfailed to account for or address the federal laws that prohibit the distribution of abortion drugs by postal mail, express company, or common carrier and by interactive computer service.&#8221;<\/p>\n<p>The FDA permitted and sometimes even encouraged these <a href=\"https:\/\/archive.liveaction.org\/news\/big-abortion-avoids-buries-pill-complications\/\" target=\"_blank\" rel=\"noopener\">illegal activities<\/a>.
