{"id":330186,"date":"2025-04-25T12:40:02","date_gmt":"2025-04-25T17:40:02","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=330186"},"modified":"2025-04-30T14:16:58","modified_gmt":"2025-04-30T19:16:58","slug":"texas-life-mother-act-undergoes-clarifying-revisions","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/texas-life-mother-act-undergoes-clarifying-revisions\/","title":{"rendered":"Texas Senate unanimously passes &#8216;Life of the Mother Act&#8217;"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><strong>Update 4\/30\/25<\/strong>: The Texas Senate unanimously <a href=\"https:\/\/www.texastribune.org\/2025\/04\/29\/texas-senate-abortion-ban-clarification-bill\/\" target=\"_blank\" rel=\"noopener\">approved<\/a> the state&#8217;s <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/history.aspx?LegSess=89R&amp;Bill=SB31\" target=\"_blank\" rel=\"noopener\">Life of the Mother Act<\/a> on Tuesday, a bill that aims to clarify when doctors can commit abortions in the state. The bill doesn&#8217;t expand on the exceptions to abortion that exist in Texas, but rather, clarifies them so that doctors understand when they are legally allowed to intentionally end the life of a preborn child.<\/p>\n<p>The version of the bill that passed the Senate states that a woman must be facing a life-threatening condition caused or exacerbated by pregnancy, but that her death does not need to be imminent before the doctor can commit the abortion. Induced abortion \u2014 the direct and intentional killing of a preborn child \u2014 is not medically necessary. In an emergency, a preterm delivery or an emergency C-section can end the pregnancy without intentionally killing the baby.<\/p>\n<p>The bill will now head to the House.<\/p>\n<p><span style=\"font-weight: 400;\"><strong>4\/25\/25<\/strong>: On Tuesday, April 22, the Texas State Affairs committee <a href=\"https:\/\/senate.texas.gov\/videoplayer.php?vid=21848&amp;lang=en\">voted favorably<\/a> for a revised version of\u00a0Texas<\/span> <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/history.aspx?LegSess=89R&amp;Bill=SB31\"><span style=\"font-weight: 400;\">Senate Bill (SB) 31<\/span><\/a><span style=\"font-weight: 400;\"> (companion <\/span><a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=HB44\"><span style=\"font-weight: 400;\">House Bill &#8211; HB 44<\/span><\/a>), <span style=\"font-weight: 400;\">the Life Of the Mother Act. The goal of the Act is to clarify current state abortion law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">SB 31\/HB 44, initiated because of<\/span>\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/propublica-planned-agenda-problem-blame-pro-life\/\"><span style=\"font-weight: 400;\">erroneous and misleading claims<\/span><\/a><span style=\"font-weight: 400;\"> made by pro-abortion activists <a href=\"https:\/\/archive.liveaction.org\/news\/texas-medical-board-heartbeat-act-author-dismantle-lies\/\">about state laws<\/a> protecting preborn children, would change the existing state code, aiming to clarify the current &#8220;exception for medical emergency.&#8221; The legislation would require physicians to take at least one approved course under continuing education requirements at no cost, as previously reported by<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/life-mother-act-clarify-texas-abortion-law\/\"><span style=\"font-weight: 400;\">Live Action News<\/span><\/a><span style=\"font-weight: 400;\">. Additionally, attorneys in the state would have access to a free educational course.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The legislation, authored by <\/span><a href=\"https:\/\/www.senate.texas.gov\/member.php?d=1\"><span style=\"font-weight: 400;\">Senator Bryan Hughes<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.house.texas.gov\/members\/99\"><span style=\"font-weight: 400;\">Representative Charlie Geren<\/span><\/a><span style=\"font-weight: 400;\">, recently caused alarm among some pro-life advocacy groups and individuals by its removal of the words &#8220;life-threatening&#8221; from the current pro-life laws. <\/span><span style=\"font-weight: 400;\">However, a committee substitute replacing the critical language along with a clarifying definition of what constitutes \u201clife-threatening\u201d aims to address these concerns.\u00a0<\/span><\/p>\n<p><strong>Pro-lifers express concern prior to bill&#8217;s recent revisions<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Prior to the updated verbiage changes \u2014 re-inserting \u201clife-threatening\u201d provisions along with the definitions found in the updated bill language \u2014\u00a0concerns were raised regarding the removal of specific verbiage from current law in the legislation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Since Live Action News&#8217;<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/life-mother-act-clarify-texas-abortion-law\/\"><span style=\"font-weight: 400;\">previous reporting on SB 31\/HB 44<\/span><\/a><span style=\"font-weight: 400;\">, the bills have received committee hearings in both the Texas House and Senate, with ample testimony both for and against them.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During testimony in the House<\/span> <span style=\"font-weight: 400;\">Public Affairs Committee hearing<\/span><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/firstliberty.org\/space-force\/\"><span style=\"font-weight: 400;\">pro-life Attorney Jace Yarbrough<\/span><\/a><span style=\"font-weight: 400;\"> implied that the majority Democratic <a href=\"https:\/\/legiscan.com\/TX\/sponsors\/HB44\/2025\">sponsors<\/a> of the bill were beholden to advancing abortion, and that the bill&#8217;s language at that time simply could not be trusted. &#8220;<\/span><span style=\"font-weight: 400;\">Instead of clarifying the law, it changes it; instead of preventing expansion, it fuels it,&#8221; he said. &#8220;It fuels it by deleting a single phrase, &#8216;life-threatening,&#8217; from the Human Life Protection Act, but without that single phrase, any impairment of a bodily function, including even mental health, can be, has been, and no doubt will be used to justify the ending of an unborn baby&#8217;s life.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Yarbrough further argued:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">HB 44 implicitly acknowledges this danger by referencing Texas&#8217;s Supreme Court decisions. Those decisions upheld the current law by focusing on the current phrase &#8220;life-threatening physical condition.&#8221; As the court put it, the Human Life Protection Act requires that the mother have a life-threatening physical condition. But courts can&#8217;t apply that reasoning if the very language of which the court relied&#8230; is stripped from the statute. <\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">As introduced, HB 44 would do just that. Texas Courts are overwhelmingly textualist; they interpret statutory changes to reflect legislative intent; removing &#8220;life-threatening&#8221; would unquestionably broaden the law allowing abortion even when the mother&#8217;s life is not at risk.<\/span><\/i><\/p>\n<p><a href=\"https:\/\/txvalues.org\/texas-values-announces-new-director-of-policy\/\"><span style=\"font-weight: 400;\">Jonathan Covey<\/span><\/a><span style=\"font-weight: 400;\"> with Texas Values testified as neutral on the legislation and had also shared concerns about the removal of &#8220;life-threatening,&#8221; citing potentially broadening the exceptions for which abortions would be allowed.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/5TmomK2RB2A?si=jCxi1fKLTxyHheTO\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p><strong>Other pro-lifers and abortion supporters testify in favor before recent revisions<\/strong><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/texasrighttolife.com\/\">Texas Right to Life<\/a> president<\/span> <a href=\"https:\/\/texasrighttolife.com\/meet-our-new-president\/\"><span style=\"font-weight: 400;\">John Seago<\/span><\/a><span style=\"font-weight: 400;\"> testified in favor of the legislation even prior to the revisions, noting the massive campaign of misinformation and outright &#8220;malicious lies about Texas pro-life laws&#8221; pushed by pro-abortion activists and medical professionals. <\/span><span style=\"font-weight: 400;\">Seago believes these lies and distortions about the law&#8217;s provisions are the cause of doctors&#8217; confusion, necessitating clarification he claims the bill provides.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the time, Seago stated, &#8220;The fact is that Texas bans elective abortions. However, Texas law has always, and today, allows medical intervention to save a mother&#8217;s life and avoid impairment of a major bodily function. Similarly, our law does not prevent treating a woman who is experiencing the heartbreaking situation of ectopic pregnancy or miscarriage.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Executive Director of Texas Alliance for Life, <\/span><a href=\"https:\/\/www.texasallianceforlife.org\/joe-pojman\/\"><span style=\"font-weight: 400;\">Dr. Joe Pojman<\/span><\/a><span style=\"font-weight: 400;\">, also testified in favor of the legislation prior to its revisions, and cited data reported by the Department of Health and Human Services of the 151 abortions labeled under the &#8220;medically necessary&#8221; exception from the overturning of <em>Roe<\/em> through November 2024.\u00a0<\/span><span style=\"font-weight: 400;\">Dr. Pojman stated, &#8220;No doctor has been prosecuted, sued, or sanctioned for any of those 151 abortions. No woman has lost her life for lack of an exception.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Others testifying in support of the legislation included the pro-abortion group<\/span> <a href=\"https:\/\/texasimpact.org\/abortion-in-texas\/\"><span style=\"font-weight: 400;\">Texas Impacts<\/span><\/a><span style=\"font-weight: 400;\"> and the pro-life organization<\/span> <a href=\"https:\/\/www.texlife.org\/\"><span style=\"font-weight: 400;\">Texans for Life<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><b>Revisions made in hopes of alleviating concerns<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Hoping to reassure pro-life supporters that necessary verbiage changes to SB 31\/HB 44 have now been made through the negotiated committee substitute, John Seago told Live Action News, &#8220;<\/span><span style=\"font-weight: 400;\">With the education requirements and clarifying language in SB 31, Texas will prove a Pro-Life state can both ensure expecting mothers receive the best medical treatment in emergencies while protecting babies from the violence of abortion.&#8221;<\/span><\/p>\n<p><a href=\"https:\/\/us20.campaign-archive.com\/?e=%5BUNIQID%5D&amp;u=d4db97bc0f6b3cc032144a0af&amp;id=e7d6104783\"><span style=\"font-weight: 400;\">Texas Right to Life<\/span><\/a><span style=\"font-weight: 400;\"> further explains that \u201cthe committee substitute does the following\u201d:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">Restores the provision that all medical emergencies be \u201clife-threatening\u201d in order to qualify for the exception to Pro-Life laws;\u00a0<\/span><\/i><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">Explains that a threat to a woman\u2019s life does not have to first cause her harm before medical professionals can intervene to prevent future injury; (in other words, the harm does not need to be imminent, only foreseeable);\u00a0<\/span><\/i><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">Defines the term \u201clife-threatening\u201d used in Texas\u2019 Pro-Life laws;\u00a0<\/span><\/i><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">Asserts that amendments made to state laws in the bill are not intended to be used to prosecute women seeking abortions; and\u00a0<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">Elaborates that all changes made to state laws in the bill are intended to be consistent with recent Pro-Life rulings from the<\/span><\/i><a href=\"https:\/\/texasrighttolife.com\/texas-supreme-court-protects-babies-with-disabilities-maintains-objective-definitions-in-state-pro-life-laws\/\"> <i><span style=\"font-weight: 400;\">Supreme Court of Texas<\/span><\/i><\/a><i><span style=\"font-weight: 400;\"> on the topic.<\/span><\/i><\/li>\n<\/ul>\n<p><a href=\"https:\/\/markleedickson.com\/\"><span style=\"font-weight: 400;\">Mark Lee Dickson<\/span><\/a>, founder of Sanctuary Cities for the Unborn Initiative, <span style=\"font-weight: 400;\">had previously expressed concerns over the verbiage but now shares confidence in the updated language provided in the committee substitute. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;I trust Senator Bryan Hughes and House Speaker Dustin Burrows,&#8221; Dickson said. &#8220;Both men have played a vital role in passing some of the strongest pro-life laws in our nation. Neither one of them would want to do anything to jeopardize the end goal of an abortion-free America. <\/span><span style=\"font-weight: 400;\">With these appropriate changes made, I believe SB31\/HB44 will be a bill that unquestionably strengthens our pro-life laws.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The committee substitute is currently awaiting a scheduled date for a vote on the Senate floor.
