Their younger son was able to get a student visa despite not even being in school yet, but six-year-old Luandre&#8217;s visa was denied. \u201cIt really hits a person in the gut,\u201d Ruan said, while Sonandi added, \u201cSomeone is sitting there stating that he\u2019s not as good as his brother, just based on paper. They [immigration officials] haven\u2019t met him, they haven\u2019t seen him.&#8221;<\/p>\n<p>Luandre&#8217;s case was rejected the same day Immigration Minister Erica Stanford gave a speech saying that the children of some migrants would not be permitted to stay. \u201cFrom 17 March, dependent children of temporary visa holders will no longer be eligible for student and visitor visas if they have a severe cognitive or development disorder that requires significant support,\u201d she said.<\/p>\n<blockquote class=\"tiktok-embed\" style=\"max-width: 605px; min-width: 325px;\" cite=\"https:\/\/www.tiktok.com\/@nzherald\/video\/7490676625877634310\" data-video-id=\"7490676625877634310\">\n<section><a title=\"@nzherald\" href=\"https:\/\/www.tiktok.com\/@nzherald?refer=embed\" target=\"_blank\" rel=\"noopener\">@nzherald<\/a>The 6-year-old child of a South African couple living in Waikato is being threatened with deportation because he has Down syndrome \u2013 a move his parents say is \u201cheartbreaking\u201d and \u201cdiscriminatory\u201d. Sonandi and Ruan Geldenhuys\u2019 son Luandre had his student visa declined despite his 2-year-old brother \u2013 who doesn\u2019t have the genetic condition and isn\u2019t at school yet \u2013 being given a visa by immigration officials. The announcement came mere days before World Down Syndrome Day, celebrated on March 21st.<\/p>\n<p>\u201cIt was a slap in the face to hear the minister actually change the rules to make it so hard for anybody with a disability to stand a chance of getting a visa in this country,\u201d Ruan said, adding, \u201cWe\u2019ve got firsthand experience of the discrimination against technically anybody with disabilities. We felt like instead of helping, they\u2019ve actually completely closed [the door] on anybody with any type of disability. That\u2019s just so unfair.\u201d<\/p>\n<p><center><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/d6GewCpuC30?si=2DAb6LuGRTZ5izbP\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/center>&nbsp;<\/p>\n<p>The Geldenhuys are not the first family to be affected by systemic ableism in New Zealand. <a href=\"https:\/\/archive.liveaction.org\/news\/down-syndrome-new-zealand-reprieve\/\" target=\"_blank\" rel=\"noopener\">Similar stories<\/a> have been told by numerous <a href=\"https:\/\/archive.liveaction.org\/news\/new-zealand-denies-family-down-syndrome\/\" target=\"_blank\" rel=\"noopener\">other families<\/a>\u00a0who likewise have been <a href=\"https:\/\/archive.liveaction.org\/news\/new-zealand-denied-residency-teenage-girl-syndrome\/\" target=\"_blank\" rel=\"noopener\">threatened<\/a> with deportation because their children have Down syndrome. It is so prevalent that the United Nations issued a report in 2022 criticizing New Zealand for its mistreatment of people with disabilities.<\/p>\n<p>\u201cThe committee is concerned about the acceptable standard of health requirements applied under the immigration rules of New Zealand, which allow for discrimination in practice against persons with disabilities in immigration,\u201d the report said. Disability rights adviser Juliana Carvalho further accused New Zealand of ignoring the recommendations from the United Nations.<\/p>\n<p>\u201cBy tightening health and education requirements for temporary visa holders, the Government is ignoring these [UN] recommendations and doubling down on its violation of rights,\u201d she said, adding, \u201cThis policy unfairly blames migrant families and their disabled children for the failures of an underfunded education system.
