{"id":329051,"date":"2025-04-04T10:45:12","date_gmt":"2025-04-04T15:45:12","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=329051"},"modified":"2025-04-04T06:59:32","modified_gmt":"2025-04-04T11:59:32","slug":"anti-life-new-mexico-abortionists-fail-infants","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/anti-life-new-mexico-abortionists-fail-infants\/","title":{"rendered":"ANTI-LIFE: New Mexico shields abortionists from scrutiny, fails to protect infants or health workers"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">At a time when Planned Parenthood is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/reject-planned-parenthood-failure-protect-patient-privacy\/\"><span style=\"font-weight: 400;\">under scrutiny from the Trump administration<\/span><\/a><span style=\"font-weight: 400;\">, New Mexico is expanding protections for Planned Parenthood, the University of New Mexico (UNM), and other abortionists in the state \u2014 while transparency for taxpayers further dwindles.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During the 2025 Regular Session, radical pro-abortion state legislators disregarded bills that would protect preborn children, expand the state\u2019s Safe Haven Laws to include baby boxes (saving the lives of born infants), and preserve medical professionals&#8217; right to refuse participation in unethical or life-ending procedures.\u00a0<\/span><span style=\"font-weight: 400;\">Instead, in a state that already allows abortion up to birth, the sole concern of these politicians is to shield abortionists from public scrutiny and accountability as they continue to end preborn human lives.<\/span><\/p>\n<p><strong>Top priority: Protect the abortion industry<\/strong><\/p>\n<p><a href=\"https:\/\/www.nmlegis.gov\/Legislation\/Legislation?Chamber=S&amp;LegType=B&amp;LegNo=57&amp;year=25\"><span style=\"font-weight: 400;\">Senate Bill (SB) 57<\/span><\/a><span style=\"font-weight: 400;\">, which passed the state legislature and is expected to be signed into law by Governor Michelle Lujan Grisham, amends the <\/span><a href=\"https:\/\/nmdoj.gov\/get-help\/inspection-of-public-records-act\/\"><span style=\"font-weight: 400;\">Inspection of Public Records Act (IPRA)<\/span><\/a>, <span style=\"font-weight: 400;\">creating an exemption from the disclosure of \u201c&#8230; any record containing personal identifying information or sensitive information related to the practice of a medical provider who performs medical services related to abortion.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The bills\u2019 main sponsor, Senator Peter Wirth, spoke in support of the bill in committee hearings, as did so-called expert witnesses<\/span><a href=\"https:\/\/hsc.unm.edu\/directory\/hofler-lisa.html\"> <span style=\"font-weight: 400;\">Dr. Lisa Hofler<\/span><\/a><span style=\"font-weight: 400;\"> (Executive Medical Director of UNM Hospital Women&#8217;s Services) and<\/span> <a href=\"https:\/\/hsc.unm.edu\/directory\/espey-eve.html\"><span style=\"font-weight: 400;\">Dr. Eve Espey<\/span><\/a><span style=\"font-weight: 400;\"> (Chair of the Department of Obstetrics and Gynecology, Professor and Fellowship Director at UNM).\u00a0<\/span><\/p>\n<div id=\"attachment_299380\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-299380\" decoding=\"async\" loading=\"lazy\" class=\"size-large wp-image-299380\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/GettyImages-1241514023-lisa-hofler-UNM-700x379.jpg\" alt=\"\" width=\"700\" height=\"379\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/GettyImages-1241514023-lisa-hofler-UNM-700x379.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/GettyImages-1241514023-lisa-hofler-UNM-300x163.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/GettyImages-1241514023-lisa-hofler-UNM-768x416.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/GettyImages-1241514023-lisa-hofler-UNM-500x271.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/GettyImages-1241514023-lisa-hofler-UNM.jpg 1200w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><p id=\"caption-attachment-299380\" class=\"wp-caption-text\">ALBUQUERQUE, NM &#8211; JUNE 21, 2022: Dr. Lisa Hofler, the clinical vice chair of the Department of Obstetrics and Gynecology at the University of New Mexico&#8230; (Gina Ferazzi \/ Los Angeles Times via Getty Images)<\/p><\/div>\n<p><a href=\"https:\/\/archive.liveaction.org\/news\/amber-thurman-pro-abortion-state-keisha-atkins\/\"><span style=\"font-weight: 400;\">Drs. Hofler<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/shocking-aborted-babies-born-alive-university-new-mexico-hospital\/\"><span style=\"font-weight: 400;\">Espey<\/span><\/a><span style=\"font-weight: 400;\">, along with<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/unm-body-parts-19-week-aborted-florida\/\"><span style=\"font-weight: 400;\">UNM<\/span><\/a><span style=\"font-weight: 400;\"> itself, <\/span><span style=\"font-weight: 400;\">have been at the core of years&#8217; worth of disturbing allegations, including unethical fetal parts trafficking. These allegations led to <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-facility-responsible-keisha-atkins-death-settlement\/\">congressional investigations<\/a><\/span><span style=\"font-weight: 400;\">. Wirth disclosed that SB 57 was created solely to protect abortionist Dr. Espey \u2013 a point that Elisa Martinez, president and founder of New Mexico Alliance for Life, noted when testifying against SB 57.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Martinez further stated that it took a congressional subpoena for her to obtain public records exposing &#8220;reckless abortion practices&#8221; and the &#8220;disturbing truth&#8221; of the harvesting of fetal parts. Martinez noted that this harvesting was &#8220;in violation of both human research laws, and women&#8217;s right to informed consent.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Highlighting the importance of IPRA, Martinez further testified that the congressional investigation \u201cled to criminal referrals, the suspension of a doctor, and the resignation of nearly everyone involved.\u201d\u00a0<\/span><\/p>\n<p><b>Beyond protecting abortionists: What about the data?<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Over numerous committee hearings and debates on the chamber floors, several Republican senators claimed SB 57 would stifle transparency and access to abortion data from publicly funded abortionists.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During debate on the Senate floor, Sen. William Sharer claimed that information requests would be hindered when attempting to obtain aggregated data, stating<\/span>, <span style=\"font-weight: 400;\">&#8220;How many abortions were there? How many of these were from medication?&#8230; That&#8217;s information the citizens ought to know\u2026 I believe it&#8217;s important for multiple reasons, but it is our job as a state to provide information through transparency.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pointing out discrepancies in transparency between other public offices and departments compared to the protections SB 57 creates for abortionists, Sen. Sharer added:\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">The Secretary of State provides information, the Department of Health provides information, the Environmental department, the Governor&#8217;s office provides information.<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">Why would this special interest group, a single special interest group, not have to provide information when they are still being funded by taxpayers?\u00a0<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Lawmakers attempted to offer several amendments to SB 57 to address some of these concerns. One of Sharer\u2019s amendments aimed to clarify that the legislation would not &#8220;extend to information and aggregated data related to abortion services provided by a public body.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sen. Sharer cited the need for aggregated information on infants born alive during failed abortions to be available to the public. &#8220;Here we have a living human being outside the womb that we kill. Why wouldn&#8217;t we want to know about that?\u201d he asked. \u201cWe&#8217;re not talking about the clump of cells argument here; we know we have a baby because we can see it. We know that she has arms and legs and a heartbeat. We can see it.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He continued, &#8220;I&#8217;m frightfully concerned that we are evolving into something, something very bad, and when we get to this, leaving a child on the table to die, that&#8217;s child sacrifice; that&#8217;s not an abortion.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The disturbing reality is that whether a child is ripped apart limb by limb, suffocated, starved, or left to die of neglect after surviving an abortion, <em>all<\/em> of these things <em>intentionally kill<\/em> a human child.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-weight: 400;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/zVk1qM1El9o?si=Yu3tAkdPJjILugP8\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe>\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Sadly, Sen. Sharer&#8217;s concerns about infants left to die from failed abortions are not far-fetched.<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/shocking-aborted-babies-born-alive-university-new-mexico-hospital\/\"><span style=\"font-weight: 400;\">Live Action News previously reported<\/span><\/a> <span style=\"font-weight: 400;\">that congressional investigations into UNM&#8217;s OB\/GYN department, led by Dr. Espey, detailed how babies born alive were denied life-saving care and left to die after failed abortions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Several Republican legislators voiced their concerns that the lack of transparency instituted by SB 57 could ultimately lead to future lawsuits.\u00a0<\/span><\/p>\n<p><b>Slippery slope of anti-life policies<\/b><\/p>\n<p>Below is a timeline showing New Mexico&#8217;s slide down the slippery slope of increasingly anti-life policies:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/digitalrepository.unm.edu\/cgi\/viewcontent.cgi?article=3504&amp;context=nrj\"><b>1963<\/b><\/a><span style=\"font-weight: 400;\"> &#8211; NM law allows for abortion if the procedure is deemed \u201cnecessary to preserve the life of the woman or to prevent serious and permanent bodily injury.\u201d (<\/span><a href=\"https:\/\/www.youtube.com\/watch?v=5TmomK2RB2A\"><span style=\"font-weight: 400;\">More here<\/span><\/a><span style=\"font-weight: 400;\"> about why induced abortion \u2013 the intentional and direct killing of a preborn child \u2013 is not medically necessary.)\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/digitalrepository.unm.edu\/cgi\/viewcontent.cgi?article=3504&amp;context=nrj\"><b>1969<\/b><\/a> <span style=\"font-weight: 400;\">&#8211; NM law allows for abortion if it is deemed that the pregnancy \u201c1. is likely to result in the death of the woman or the grave impairment of the physical or <\/span><b><i>mental health<\/i><\/b><span style=\"font-weight: 400;\"> (emphasis added) of the woman; or 2. The child <\/span><b><i>probably<\/i><\/b> <span style=\"font-weight: 400;\">(emphasis added) will have a grave physical or mental defect, or 3. The pregnancy resulted from rape\u2026, or 4. The pregnancy resulted from incest.\u201d\u00a0<\/span><span style=\"font-weight: 400;\">Requirements remain in place requiring parent\/guardian consent for minors to access abortions, for <\/span><span style=\"font-weight: 400;\">licensing of medical professionals, and for abortions to be done in accredited hospitals. Grisham&#8217;s desk, the<\/span> <a href=\"https:\/\/www.nmlegis.gov\/Legislation\/Legislation?Chamber=S&amp;LegType=B&amp;LegNo=347&amp;year=25\"><span style=\"font-weight: 400;\">Healthcare Workers Conscience Protection Act<\/span><\/a> <span style=\"font-weight: 400;\">(SB 347) sits in the Senate Health and Public Affairs Committee awaiting a hearing. SB 347 seeks to <em>reinstate protections<\/em> for medical providers who wish to abstain from committing abortion procedures based on religious or moral beliefs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During a press conference held by <\/span><a href=\"https:\/\/nmsenategop.com\/2025\/03\/20\/senate-republicans-host-press-conference-on-medical-provider-conscience-protection-safe-haven-baby-boxes-new-10-million-abortion-clinic\/\"><span style=\"font-weight: 400;\">NM State Republicans<\/span><\/a><span style=\"font-weight: 400;\">, Sen. Gabriel Ramos, an SB 347 sponsor, stated, &#8220;The left believes that choice is important, but what happens to the doctors&#8217; and nurses&#8217; choice?&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sen. Ramos added, &#8220;We need to make sure that we pass a bill that gives them the choice to religious freedoms, and make sure that they are able to do what they wish, and save people, not go backwards.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Senator Pat Boone spoke in support of SB 347, stating, &#8220;I believe that the conscience and the beliefs and the work of these medical people needs to be protected just like the life of that child.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The<\/span> <a href=\"https:\/\/www.nmlegis.gov\/Sessions\/25%20Regular\/AgencyAnalysis\/SB0347_665.pdf\"><span style=\"font-weight: 400;\">Department of Health&#8217;s<\/span><\/a><span style=\"font-weight: 400;\"> analysis of the bill acknowledged the blatant infringement of the rights of New Mexican healthcare workers:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><em><span style=\"font-weight: 400;\">If SB347 is not enacted, medical practitioner individuals and entities will not be allowed to refuse to participate in or pay for any health care service that violates the medical practitioner&#8217;s, health care institution&#8217;s, or health care payer&#8217;s conscience, and they would continue to be held civilly, criminally or administratively liable for the exercise of \u2018conscience\u2019 rights created by the bill.\u00a0<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">While New Mexican medical workers&#8217; constitutional rights are infringed upon and the lives of tens of thousands of preborn children are ended in New Mexico, SB 57 will <\/span><b>only protect abortionists<\/b> once it is law<span style=\"font-weight: 400;\">. The priorities of Gov. Grisham and the radically pro-abortion members of the New Mexico state legislature are clear.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/actnow.io\/Vety0KE\"><img decoding=\"async\" loading=\"lazy\"
