{"id":327728,"date":"2025-03-16T11:51:08","date_gmt":"2025-03-16T16:51:08","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=327728"},"modified":"2025-03-14T12:24:27","modified_gmt":"2025-03-14T17:24:27","slug":"montana-judge-medicaid-pay-abortions-non-physicians","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/montana-judge-medicaid-pay-abortions-non-physicians\/","title":{"rendered":"Montana judge allows Medicaid to pay for all abortions, and non-physicians to commit them"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>A district court judge in Montana has <a href=\"https:\/\/aboutblaw.com\/bhul\">struck down<\/a> two 2023 laws and a Montana Department of Public Health and Human Services (DPHHS) rule that restricted abortion in the state.<\/p>\n<p>Among the <a href=\"https:\/\/truthout.org\/articles\/montana-judge-rules-medicaid-recipients-have-protected-access-to-abortion\/\" target=\"_blank\" rel=\"noopener\">laws overturned<\/a> by Judge Mike Menahan include:<\/p>\n<ul>\n<li><a href=\"https:\/\/archive.legmt.gov\/bills\/2023\/billhtml\/HB0544.htm\" target=\"_blank\" rel=\"noopener\">HB 544<\/a>, which states that only physicians can commit abortions. That law also required &#8220;pre authorization&#8221; paperwork before a woman could receive an abortion.<\/li>\n<li><a href=\"https:\/\/archive.legmt.gov\/bills\/2023\/billhtml\/HB0862.htm\" target=\"_blank\" rel=\"noopener\">HB 862<\/a>, which prohibited Medicaid-funded abortions unless the pregnancy was the result of rape or incest, or the mother was &#8220;in danger of death.&#8221;<\/li>\n<li>A DPHHS rule requiring that a pregnant woman receive pre-authorization approval, including an in-person examination prior to receiving an abortion. This rule, which holds the same weight in the state as a law, restricted a woman from receiving the abortion pill via telehealth appointment or through the mail.<\/li>\n<\/ul>\n<p>\u201cThe undisputed facts likewise establish that the prior authorization requirements in the rule and HB 544 do not address a medically acknowledged, bona fide health risk. The unrequited testimony establishes that the requirements would require patients to make an extra in-person visit to a healthcare provider for a physical examination,\u201d Menahan <a href=\"https:\/\/dailymontanan.com\/2025\/03\/12\/state-court-strikes-down-two-abortion-laws-passed-in-23\/\" target=\"_blank\" rel=\"noopener\">wrote in his opinion<\/a>. \u201cThe physical examination would result in delays that harm patient health; and would in practice ban direct-to-patient medication abortions which have been done safely via telehealth for years without the need for any in-person visit.&#8221;<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/zVk1qM1El9o?si=4EXbKHybjav9GAYX\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>Despite the judge&#8217;s statements, an in-person, physical examination prior to a chemical abortion was the standard of care for 16 years, until 2016, when the Obama administration removed &#8220;the requirements that women or teen girls take the first drug in front of a clinician, in-person at the location of a certified prescriber and that the manufacturer report the drug\u2019s <em>non-fatal adverse events\u00a0<\/em>(complications). The drug\u2019s allowed use was also extended for use on preborn children up to\u00a0<a href=\"https:\/\/babyolivia.liveaction.org\/assets\/img\/Download-Bundle\/Week-7\/Olivia-Week07-3.jpg\" target=\"_blank\" rel=\"noopener\">10 weeks (70 days)<\/a> of pregnancy,&#8221; as Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/fda-abortion-pill-timeline-events\/\">previously reported<\/a>.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/cpdY97GOK2I?si=rzHL12WA47ev3upZ\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p>In other words, for nine years, there has been neither an in-person requirement to obtain the abortion pill, <em>nor<\/em> the reporting of non-fatal (yet potentially extremely serious) adverse events resulting from the pill regimen to the manufacturer; as some have pointed out, removing safeguards and then removing the requirement to report related injuries is highly questionable.<\/p>\n<p>Prior to 2016, an in-person visit was considered necessary to determine the preborn child&#8217;s gestational age, as well as to rule out an ectopic pregnancy or any other risk factors. An undiagnosed ectopic pregnancy could be fatal for the mother, and a failure to accurately assess gestational age could result in a <a href=\"https:\/\/archive.liveaction.org\/news\/no-test-abortion-pill-women-health-interventions\/\">higher chance of a failed or incomplete abortion<\/a>\u00a0(a potential infection risk), and\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/no-test-abortion-pill-rh-testing-children\/\">more<\/a>.<\/p>\n<p>Menahan further noted that Medicaid cannot preclude a person from accessing the &#8220;healthcare&#8221; of abortion.<\/p>\n<p>\u201cHowever, the relevant inquiry is not whether the right of privacy requires the State to fund abortions, but whether, having elected to participate in a medical assistance program, the State may selectively exclude from such benefits otherwise eligible persons solely because they make constitutionally protected healthcare decisions with which the State disagrees,&#8221; he <a href=\"https:\/\/aboutblaw.com\/bhul\">wrote<\/a>.<\/p>\n<p>Live Action News has repeatedly <a href=\"https:\/\/archive.liveaction.org\/news\/rep-ann-wagner-hits-back-at-planned-parenthood-abortion-is-not-healthcare-kills-children\/\" target=\"_blank\" rel=\"noopener\">demonstrated<\/a> that <a href=\"https:\/\/archive.liveaction.org\/news\/pro-life-docs-abortion-healthcare\/\" target=\"_blank\" rel=\"noopener\">abortion<\/a> is not health care.
