{"id":327387,"date":"2025-03-07T14:41:45","date_gmt":"2025-03-07T20:41:45","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=327387"},"modified":"2025-03-06T22:36:00","modified_gmt":"2025-03-07T04:36:00","slug":"former-planned-parenthood-attorney-wisconsin-supreme-court","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/former-planned-parenthood-attorney-wisconsin-supreme-court\/","title":{"rendered":"Former Planned Parenthood attorney seeks seat on Wisconsin Supreme Court"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>On April 1, Wisconsin voters will go to the polls to elect the state&#8217;s newest Wisconsin Supreme Court justice \u2014 and the election has stirred up debate surrounding the issue of abortion and recusal.<\/p>\n<p>County Court Judge Susan Crawford and County Court Judge Brad Schimel, the former state attorney general, are both running.\u00a0 Whoever is voted into the vacant justice position will have a long-term effect on the court and the cases it decides. Currently, the court leans liberal, but as a liberal justice is stepping down, there is an opportunity for a conservative judge to step in and give conservatives the <a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/03\/03\/wisconsin-supreme-court-trump-musk\/\" target=\"_blank\" rel=\"noopener\">majority<\/a> once again. If liberals continue to hold the majority, they could do so until 2028.<\/p>\n<p>Crawford previously <a href=\"https:\/\/www.pinesbach.com\/blog\/2015\/03\/aclu-reproductive-rights-project\/\" target=\"_blank\" rel=\"noopener\">worked<\/a> as an attorney with Planned Parenthood Federation of America and the ACLU Reproductive Rights Project, helping to obtain a permanent block on the 2011 Wisconsin law requiring abortionists to have admitting privileges at a hospital within 30 miles of their abortion facility. Pro-lifers are concerned that this relationship \u2014 though the case took place a decade ago \u2014 would present a conflict of interest for Crawford on any upcoming abortion-related cases at the state Supreme Court. They are concerned that, should she win, she would choose not to recuse herself from such cases.<\/p>\n<p><center><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/Y3besWlxHhc?si=FBCz6brJ8UZU_t9P\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/center>&nbsp;<\/p>\n<p>When asked about this, Crawford stated, &#8220;The law does not require judges to automatically recuse just because they have done some kind of legal work in the past as a lawyer.&#8221;<\/p>\n<p>According to the <a href=\"https:\/\/docs.legis.wisconsin.gov\/misc\/lc\/study\/2010\/special_committee_on_judicial_discipline_and_recusal\/050_september_16_2010_meeting\/memono4_judi#:~:text=Generally%2C%20the%20code%20provision%20requires,standards%20and%20the%20justice%20system\" target=\"_blank\" rel=\"noopener\">Wisconsin Legislative Council<\/a>, a judge should consider recusal &#8220;when a direct, personal, substantial, pecuniary interest exists.&#8221; It adds, &#8220;Also, there may be circumstances in which experience teaches that the probability of bias is too high to be constitutionally tolerable.&#8221;<\/p>\n<p>The Wisconsin Supreme Court is currently deciding a <a href=\"https:\/\/statecourtreport.org\/our-work\/analysis-opinion\/wisconsin-justices-appear-hostile-175-year-old-abortion-law\" target=\"_blank\" rel=\"noopener\">case<\/a> concerning an 1849 law that prohibits abortion with a few exceptions. When <em>Roe v. Wade<\/em> was overturned by the U.S. Supreme Court in 2022, abortionists in the state <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-wisconsin-stopped-scheduling-abortions\/\" target=\"_blank\" rel=\"noopener\">stopped committing abortion<\/a> because of that law, which states that &#8220;any person, other than the mother, who intentionally destroys the life of the unborn child&#8221; could be guilty of a felony and face up to 15 years in prison unless the mother&#8217;s life was determined to be at risk. Abortion advocates argue that the law only applies when the mother has not consented to the abortion.<\/p>\n<p>According to <a href=\"https:\/\/www.nytimes.com\/2025\/01\/27\/us\/politics\/wisconsin-supreme-court-race.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a>, Crawford&#8217;s supporters claim that &#8220;electing her will preserve abortion rights in the state.&#8221;<\/p>\n<p>Writing for the <a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/03\/03\/wisconsin-supreme-court-trump-musk\/\" target=\"_blank\" rel=\"noopener\">Washington Post<\/a>, Patrick Marley noted, &#8220;Democrats in Wisconsin in recent years have been better than Republicans at getting voters to show up for low-turnout court elections, leading to some blowout races.
