{"id":325896,"date":"2025-02-09T11:46:11","date_gmt":"2025-02-09T17:46:11","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=325896"},"modified":"2025-02-12T23:58:01","modified_gmt":"2025-02-13T05:58:01","slug":"hope-prolife-crusaders-goal-law-ending-abortion","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/hope-prolife-crusaders-goal-law-ending-abortion\/","title":{"rendered":"&#8216;Every rebellion starts with hope&#8217;: Pro-life &#8216;crusaders&#8217; use existing law with goal of ending abortion"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>American reformer Anthony Comstock&#8217;s &#8220;<a href=\"https:\/\/postalmuseum.si.edu\/exhibition\/behind-the-badge-postal-inspection-service-duties-and-history-history\/anthony-comstock\">crusade against vice<\/a>&#8221; came about when he witnessed &#8220;the degradation of society in the 1860s&#8221; and put together a &#8220;set of moral laws&#8221; to combat it, <a href=\"https:\/\/www.instagram.com\/p\/DFa1H8Ky3Zx\/?img_index=2&amp;igsh=MXhtNmlwcjhrcTl2dQ%3D%3D\" target=\"_blank\" rel=\"noopener\">according to<\/a> pro-life attorney Mike Seibel. This set of moral laws became known as The Comstock Act. It was backed by Congress and eventually signed into law by President Ulysses S. Grant on March 3, 1873 \u2014 and 150 years later, some &#8216;crusaders&#8217; see it as a possible path to end the deadly vice of abortion.<\/p>\n<p>Rarely pictured without his backward black baseball cap, Mark Lee Dickson has been dubbed by some as a modern-day Anthony Comstock, due to his efforts to resurrect the Comstock Act in an effort to end abortion in America. Shortly after the <em>Dobbs<\/em> decision overturned <em>Roe v. Wade<\/em> in 2022, Dickson partnered with attorneys Jonathan Mitchell and Mike Seibel to lay out a plan to enforce this federal law. However, &#8220;[s]ome of these laws have been updated over the years,&#8221; Seibel told Live Action News, noting that in the case of contraceptives and profanity, some restrictions in Comstock &#8220;have been overturned&#8221; and are &#8220;not going to be enforceable.&#8221;<\/p>\n<p>But one of the major things in the Comstock Act that hasn&#8217;t been overruled by the Supreme Court, Seibel said, &#8220;is the abortion law, because <em>Roe v. Wade<\/em> went into effect prior to the Supreme Court ruling on Comstock.&#8221; When <em>Roe<\/em> was overturned, the federal Comstock Act was brought back into play.<\/p>\n<p>&#8220;Lawmakers amended the law in 1971 to remove the prohibition on mailing contraceptives,&#8221; <a href=\"https:\/\/wng.org\/roundups\/this-150-year-old-law-could-save-babies-from-abortion-1736889315\" target=\"_blank\" rel=\"noopener\">WNG.org<\/a> reported. &#8220;The U.S. Supreme Court\u2019s <em>Roe v. Wade\u00a0<\/em>decision in 1973 rendered the remainder of the law ineffective, but it has continued to go unenforced even after the 2022\u00a0<em>Dobbs v. Jackson Women\u2019s Health Organization\u00a0<\/em>ruling overturned\u00a0<em>Roe<\/em>.&#8221;<\/p>\n<p>The Smithsonian&#8217;s National Postal Museum <a href=\"https:\/\/postalmuseum.si.edu\/exhibition\/behind-the-badge-postal-inspection-service-duties-and-history-history\/anthony-comstock\" target=\"_blank\" rel=\"noopener\">wrote<\/a> that &#8220;The first federal law to deal with obscenity in the mail had been passed in 1865. Comstock\u2019s law strengthened punishments and widened definitions of obscenity (adding information about abortion or contraception to the list of indecent matter). Shortly after the bill was signed, Comstock received a commission as a Special Agent of the U.S. Post Office, giving him the power to enforce his law.&#8221;<\/p>\n<p>The museum added, &#8220;Comstock continued his crusade and remained a special agent for the Post Office Department until his death in 1915. Bits and pieces of his Act were challenged and eliminated over the years. Birth control advocate Margaret Sanger was an influential force in successfully challenging some of that legislation.&#8221; In 1965, &#8220;the Supreme Court decision&#8230; lifted all restrictions on the use of contraceptives by married couples.&#8221;<\/p>\n<p>The remaining section on abortion (18 U.S.C. \u00a7 1461) essentially <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/1461\">prohibits<\/a>\u00a0the mailing of \u201cany article, instrument, substance, drug, medicine, or thing [that] may, or can, be used or applied for producing abortion[.]\u201d<\/p>\n<p>Alliance Defending Freedom&#8217;s (ADF) Senior Counsel Erik Baptist <a href=\"https:\/\/archive.liveaction.org\/news\/biden-doj-political-opinion-mailing-abortion-drugs\/\" target=\"_blank\" rel=\"noopener\">previously<\/a> explained:<\/p>\n<p style=\"padding-left: 40px;\"><em>These longstanding federal laws prohibit the distribution of chemical abortion drugs by mail, common carrier, or express company. That means only the chemical drug manufacturer may deliver and distribute these drugs to abortionists around the country. <\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>The manufacturer cannot use the U.S. Postal Service, FedEx, UPS, or any third-party courier to distribute chemical abortion drugs to abortionists, pharmacies, or women in the United States.<\/em><\/p>\n<p><a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title18-section1461&amp;num=0&amp;edition=prelim\" target=\"_blank\" rel=\"noopener\">The Comstock Act<\/a> does not prohibit the mailing of drugs to be used in cases of miscarriage, to save the life of a mother, or for other medical purposes. The law does not prohibit the shipping of the second drug in the abortion pill regimen, misoprostol, when the drug is to be used to treat medical problems including miscarriage and gastric ulcers, for example, as Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-pro-life-coalition-petition\/\" target=\"_blank\" rel=\"noopener\">previously<\/a> reported.<\/p>\n<p>In addition, Congress has consistently upheld the Comstock Act\u2019s prohibition on abortion pill trafficking, and according to a joint report on the abortion pill <a href=\"https:\/\/aul.org\/wp-content\/uploads\/2025\/01\/abortion-pill-policy_formatted_R2_web-ready_compressed.pdf\" target=\"_blank\" rel=\"noopener\">published<\/a> by Americans United for Life (AUL) and Live Action, &#8220;Congress and President Clinton acted in 1996 to expand Section 1462\u2019s application to &#8216;interactive computer services,&#8217; making it illegal to use the internet to ship or receive abortifacients.&#8221;<\/p>\n<h3><strong>Modern Day &#8216;Vice&#8217; Crusaders<\/strong><\/h3>\n<p>For years, the media and pro-abortion organizations have viewed pro-life crusaders like Mark Lee Dickson \u2014 with his Sanctuary City for the Unborn Ordinances and Comstock Act inclusions \u2014 as a significant threat.<\/p>\n<p>Inaccurately associating this pro-life effort with the &#8220;MAGA&#8221; movement, Rolling Stone <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/maga-plan-attack-birth-control-surveil-women-ban-abortion-pill-1234934807\" target=\"_blank\" rel=\"noopener\">reported<\/a> in 2023, &#8220;Renewing enforcement of Comstock is an idea that has been promoted on the vanguard of the anti-abortion movement by activists like Mark Lee Dickson \u2014 one of the chief figures behind local ordinances banning abortion and abortion &#8216;trafficking&#8217; \u2014 who has touted Comstock\u2019s potential as a &#8216;de facto abortion ban.&#8217;\u201d<\/p>\n<div id=\"attachment_326034\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-326034\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-326034 size-large\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/02\/Mark-Lee-Dickson-the-Modern-Day-Anthony-Comstock-700x467.jpg\" alt=\"Pro-life crusader Mark Lee Dickson dubbed the modern Day Anthony Comstock (Image: Facebook) \" width=\"700\" height=\"467\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/02\/Mark-Lee-Dickson-the-Modern-Day-Anthony-Comstock-700x467.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/02\/Mark-Lee-Dickson-the-Modern-Day-Anthony-Comstock-300x200.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/02\/Mark-Lee-Dickson-the-Modern-Day-Anthony-Comstock-768x512.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/02\/Mark-Lee-Dickson-the-Modern-Day-Anthony-Comstock-500x333.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/02\/Mark-Lee-Dickson-the-Modern-Day-Anthony-Comstock-360x240.jpg 360w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2025\/02\/Mark-Lee-Dickson-the-Modern-Day-Anthony-Comstock.jpg 1080w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><p id=\"caption-attachment-326034\" class=\"wp-caption-text\">Pro-life &#8216;crusader&#8217; Mark Lee Dickson, dubbed the modern-day Anthony Comstock (Image: Facebook)<\/p><\/div>\n<p>Authors Reva Siegel and Mary Ziegler detailed the modern use of Comstock in \u201cComstockery: How Government Censorship Gave Birth to the Law of Sexual and Reproductive Freedom, and May Again Threaten It,\u201d set to publish in the Yale Law Journal.<\/p>\n<p>A <a class=\"ext\" title=\"(opens in a new window)\" href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4761751&amp;emci=c92faf22-f021-ef11-86d2-6045bdd9e096&amp;emdi=4cf9a692-6122-ef11-86d2-6045bdd9e096&amp;ceid=522022\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/click.everyaction.com\/k\/86222332\/477235908\/1366476885?abstract_id%3D4761751%26nvep%3Dew0KICAiVGVuYW50VXJpIjogIm5ncHZhbjovL3Zhbi9TTldTUi9TTldTUi8xLzEwNTEzMSIsDQogICJEaXN0cmlidXRpb25VbmlxdWVJZCI6ICI0Y2Y5YTY5Mi02MTIyLWVmMTEtODZkMi02MDQ1YmRkOWUwOTYiLA0KICAiRW1haWxBZGRyZXNzIjogImluZm9AYXptaXJyb3IuY29tIg0KfQ%253D%253D%26hmac%3DcEAEh_-6eay2ymxF2T15FN1N5ypcPFRxZMUvjtp4AdM%3D%26emci%3Dc92faf22-f021-ef11-86d2-6045bdd9e096%26emdi%3D4cf9a692-6122-ef11-86d2-6045bdd9e096%26ceid%3D522022&amp;source=gmail&amp;ust=1717609016384000&amp;usg=AOvVaw2i0kK4Nk_KJtY-eDFG3HOi\" data-extlink=\"\">82-page draft article<\/a> located online highlighted Dickson and Mitchell, stating:<\/p>\n<p style=\"padding-left: 40px;\"><em>The idea for reinventing the Comstock Act began in a search for creative public-private enforcement strategies. In 2019, Mark Lee Dickson, a Texas activist and preacher, collaborated with Mitchell to develop a private enforcement mechanism, initially with the primary aim of preventing federal courts from adjudicating the constitutionality of the law.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>The two created a model for what they called \u201csanctuary cities for the unborn\u201d through ordinances that banned abortion within county or city limits, and authorized anyone, no matter how disconnected from an abortion, to sue a physician and anyone aiding or abetting them.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>These ordinances became a blueprint for a state law, SB8, passed by Texas in 2021 and upheld by the Supreme Court later that year. Beyond exploring private enforcement, Mitchell came to his ideas about the Comstock Act by exploring related ideas in his 2018 law review article, The Writ-of-Erasure Fallacy, in which he argued that were a court to reverse an earlier opinion, that liberated the executive to &#8216;resume enforcing the statute, both against those who will violate it in the future and against those who have violated it in the past.'&#8221;<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Mitchell proposed that Comstock could be read as a de facto ban on all abortion procedures, not just those involving pills sent through the mail.<\/em><\/p>\n<p>The authors added, &#8220;And any abortion, Dickson and Mitchell reasoned, required the use of something sent in the mail.&#8221;<\/p>\n<p>Mitchell explained, \u201cEven though the Comstock law does not ban abortion literally, it bans the shipment or receipt of any abortion related equipment.\u201d<\/p>\n<p>Seibel agreed, pointing out that the law could essentially end all abortions. &#8220;The Comstock Act prevents the distribution of any abortion-causing agents or abortion paraphernalia through the mail and interstate commerce. So that would include abortion pills and equipment and thwart mail order abortion distribution,\u201d he <a href=\"https:\/\/archive.liveaction.org\/news\/biden-doj-political-opinion-mailing-abortion-drugs\/\" target=\"_blank\" rel=\"noopener\">previously<\/a> told Live Action News.<\/p>\n<p>According to Seibel, &#8220;the majority of abortions are being done by the [abortion] pill,&#8221; which is why Comstock is so important; not only is Comstock a way to stop the mailing of abortion-inducing drugs, it is also &#8220;a way to stop abortion in states where abortion is legal up to the date of birth,&#8221; because &#8220;this is a federal law that trumps the state law&#8230; and all state Constitutions.&#8221;<\/p>\n<h3><strong>Modern-Day Abortion Fight<\/strong><\/h3>\n<p>Seibel <a href=\"https:\/\/www.facebook.com\/skip.canvasback\/posts\/pfbid0UEuQarM4JSjPhFEyx3gHqKCXL4fEG7ZeEuPXN6vPSSncW3DH44Jy4ZbZaHpteGkel?__cft__[0]=AZVY1YrfCb-OHN_x0gfqiofgqDyRDAbmVvC7ml0z7_4t5w0-glwz69tm04m4huobbj1kucevHl4A4BAP0co060qpKXRyk_MusmaEkts4hr42aWTN3FAdMoIaVIVc2vvRPhE&amp;__tn__=%2CO%2CP-R\" target=\"_blank\" rel=\"noopener\">wrote<\/a> on Facebook, &#8220;Just after the decision in Dobbs v Jackson Women\u2019s Health, I was talking with Mark Lee Dickson in Washington DC. We were still in the fight to make <a href=\"https:\/\/archive.liveaction.org\/news\/two-abortionists-estimated-killed-300000-human-beings\/\" target=\"_blank\" rel=\"noopener\">Curtis Wayne Boyd\u2019s<\/a> hometown of Athens, Texas, a Sanctuary City for the unborn. Mark Lee Dickson brought up an Act and a plan to revive a 150 year old law I had not thought about for 20 years. The Comstock Act. The pro-life Superlawyer Jonathan Mitchell designed ordinances that sought to enforce the Federal Comstock Act at the local level I worked as local counsel,&#8221; Seibel added. &#8220;Soon after that time we worked with Jonathan Mitchell to introduce ordinances in Hobbs and Clovis, New Mexico in September of 2022. On November 7, 2022, the City of Hobbs passed an ordinance containing provisions which sought to enforce provisions of the Comstock Act. This set the stage for other organizations to start to petition for a Comstock to be enforceable.&#8221;<\/p>\n<p>&#8220;Shortly after Dobbs, Dickson and Mitchell proposed a new brand of &#8216;sanctuary city&#8217; ordinance in Hobbs, New Mexico, that required abortion clinics operating within city lines to get a license; the licensing requirements, in turn, required compliance with Mitchell and Dickson\u2019s interpretation of the Comstock Act. Other ordinances citing the Comstock Act would follow,&#8221; Yale Law authors Siegel and Ziegler wrote.<\/p>\n<h3><strong>Legal Cases In Play<\/strong><\/h3>\n<p>&#8220;Every rebellion starts with hope,&#8221; wrote Seibel shortly after a <a href=\"https:\/\/archive.liveaction.org\/news\/new-mexico-supreme-court-ruling-sanctuary-unborn\/\" target=\"_blank\" rel=\"noopener\">New Mexico legal ruling,<\/a> which could end up as a direct Supreme Court challenge to the federal Comstock Act.<\/p>\n<p>Despite the federal Comstock Act remaining active, abortion pills are flooding into states that either restrict abortion or fully protect preborn children except when the life of the mother is at risk. As such, states are struggling to enforce their own laws, and pro-lifers have vowed to use the Comstock Act to fight back.<\/p>\n<p>Now that <em>Roe v. Wade<\/em> has been overturned, abortion providers in\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/showdown-abortion-laws-supreme-court-battle-comstock\/\" target=\"_blank\" rel=\"noopener\">multiple states<\/a>\u00a0are <i>openly <\/i>shipping these drugs \u201cunlawfully\u201d into states that prohibit them or restrict telehealth dispensing. In fact, abortion pills are flooding into states which restrict abortion, sent illegally from abortion providers in outside states who are protected under so-called \u2018shield laws.\u2019 As of August 2024, the Williams Institute <a href=\"https:\/\/williamsinstitute.law.ucla.edu\/publications\/shield-laws-fact-sheets\/\" target=\"_blank\" rel=\"noopener\">claimed<\/a>\u00a0there are \u201c23 states and Washington, D.C.\u201d which \u201chave shield law protections related to reproductive health care.\u201d<\/p>\n<p><strong><em>Alliance for Hippocratic Medicine (AHM)<\/em>:<\/strong> During oral\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=3gAHaGpADvk\" target=\"_blank\" rel=\"noopener\">arguments<\/a>\u00a0in the\u00a0<em>Alliance for Hippocratic Medicine (AHM) v. Food and Drug Administration (FDA)<\/em>\u00a0lawsuit, which\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/separating-fact-fiction-supreme-court-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">challenged<\/a> the legitimacy of the FDA\u2019s recent expansions of the abortion pill, at least two U.S. Supreme Court justices <a href=\"https:\/\/archive.liveaction.org\/news\/four-shocking-admissions-supreme-court-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">hinted<\/a> that the Comstock Act could be in play. While not ruling on the merits of that case, the Court\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-doctors-fda-abortion-pill-safety\/\" target=\"_blank\" rel=\"noopener\">later ruled<\/a>\u00a0that the Plaintiffs (the physicians) did not have standing to bring suit.<\/p>\n<p>Since that decision, three states, who likely do have standing, have been approved to intervene in the lawsuit.<\/p>\n<p><strong><em>State of Missouri; State of Kansas; State of Idaho v. FDA<\/em>: <\/strong>Earlier this year, U.S. District Judge Matthew Kacsmaryk <a href=\"https:\/\/assets.aclu.org\/live\/uploads\/2023\/06\/177117394490.pdf\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that the states of Missouri, Kansas, and Idaho could intervene and file a complaint in the AHM abortion pill lawsuit originally filed by a group of pro-life physicians. The three states filed their petition in October of 2024, claiming their \u201csovereign\u201d interest in \u201cprotecting\u2026 citizens\u201d was violated by the FDA&#8217;s decision to allow mail-order abortion pill dispensing. The plaintiffs <a href=\"https:\/\/s3.documentcloud.org\/documents\/25222818\/mifepristone-complaint.pdf\" target=\"_blank\" rel=\"noopener\">requested<\/a> that the Courts enforce the Comstock Act and grant them the ability to \u201cvindicate [their] sovereign, quasi-sovereign, and proprietary interests, including [their] interests in protecting [their] citizens.\u201d<\/p>\n<p><strong><em>State of New Mexico v. Board of County Commissioners for Lea County&#8230; Roosevelt County, and City of Hobbs<\/em>: <\/strong>This lawsuit originated in 2023 after the cities of <a href=\"https:\/\/archive.liveaction.org\/news\/new-mexico-clovis-63rd-sanctuary-city-unborn\/\" target=\"_blank\" rel=\"noopener\">Clovis<\/a>\u00a0and\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/hobbs-first-sanctuary-city-unborn-new-mexico\/\" target=\"_blank\" rel=\"noopener\">Hobbs<\/a>\u00a0passed\u00a0<a href=\"https:\/\/sanctuarycitiesfortheunborn.org\/comstock-ordinances\" target=\"_blank\" rel=\"noopener\">Sanctuary Cities for the Unborn Ordinances<\/a><a href=\"https:\/\/sanctuarycitiesfortheunborn.org\/comstock-ordinances\" target=\"_blank\" rel=\"noopener\">,<\/a> requiring abortion providers to comply with federal law \u2014\u00a0namely the Comstock Act.\u00a0Days ago, a <a href=\"https:\/\/archive.liveaction.org\/news\/new-mexico-supreme-court-ruling-sanctuary-unborn\/\" target=\"_blank\" rel=\"noopener\">New Mexico Supreme Court ruling<\/a>, which appeared to go against pro-life Sanctuary City Ordinances in the state, \u201c<a href=\"https:\/\/archive.liveaction.org\/news\/new-mexico-supreme-court-ruling-sanctuary-unborn\/\" target=\"_blank\" rel=\"noopener\">thrilled<\/a>\u201d pro-life advocates and legal representatives who passed the pro-life measures, because the ruling\u00a0<em>acknowledged the validity of the federal Comstock Act<\/em>, which prohibits the mailing of abortion-inducing drugs and other devices.<\/p>\n<p>The Court <a href=\"https:\/\/law.justia.com\/cases\/new-mexico\/supreme-court\/2025\/s-1-sc-39742.html\" target=\"_blank\" rel=\"noopener\">ruled against<\/a>\u00a0Lea and Roosevelt counties and the cities of Clovis and Hobbs, claiming their passage of pro-life \u2018<a href=\"https:\/\/sanctuarycitiesfortheunborn.org\/\" target=\"_blank\" rel=\"noopener\">Sanctuary Cities for the Unborn<\/a>\u2018 ordinances \u201cexceeded their authority by enacting ordinances preempted by state law.\u201d<\/p>\n<p>Following the New Mexico Supreme Court ruling, Dickson, Mitchell, and Seibel responded.<\/p>\n<ul>\n<li>&#8220;Every rebellion starts with hope.
