{"id":324532,"date":"2025-01-14T12:56:15","date_gmt":"2025-01-14T18:56:15","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=324532"},"modified":"2025-03-12T21:21:09","modified_gmt":"2025-03-13T02:21:09","slug":"planned-parenthood-failed-follow-law-federal-funds","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/planned-parenthood-failed-follow-law-federal-funds\/","title":{"rendered":"Planned Parenthood has failed to follow the law, yet it gets hundreds of millions in federal funds"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Planned Parenthood, which continues to receive the bulk of its taxpayer dollars through Medicaid reimbursements and the Title X Family Planning Program, has repeatedly failed to abide by mandatory reporting laws regarding child sexual abuse. Yet, both Medicaid and Title X require participants to comply with state and federal laws regarding the reporting of abuse.<\/p>\n<h3><strong>Planned Parenthood&#8217;s primary funding sources: Medicaid and Title X<\/strong><\/h3>\n<p>When legislation was proposed in <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-defund-cheaper\/\" target=\"_blank\" rel=\"noopener\">2015<\/a> to defund Planned Parenthood, the <a href=\"https:\/\/www.cbo.gov\/publication\/50825\" target=\"_blank\" rel=\"noopener\">Congressional Budget Office<\/a> (CBO) found that Planned Parenthood <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-60m-battle-defund\/\" target=\"_blank\" rel=\"noopener\">received<\/a> approximately $450 million annually in just\u00a0<b><u>federal<\/u><\/b>\u00a0funds.<\/p>\n<p>CBO broke the funding down to two main sources: Medicaid and Title X. CBO found:<\/p>\n<ul>\n<li>$390 million is provided through the Medicaid program and less than $1 million is provided through the Children\u2019s Health Insurance Program (CHIP) and the Medicare program combined.<\/li>\n<li>Approximately $60 million is provided through the National Family Planning Program, which operates under Title X of the Public Health Service Act (commonly referred to as Title X).<\/li>\n<\/ul>\n<p><strong>2013 &#8211; 2015:<\/strong> Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-60m-battle-defund\/\" target=\"_blank\" rel=\"noopener\">previously<\/a> documented a 2018 Government Accountability Office (GAO) <a href=\"https:\/\/www.gao.gov\/products\/GAO-18-204R\" target=\"_blank\" rel=\"noopener\">report<\/a> detailing direct federal funding from government agencies to Planned Parenthood between years 2013-2015. The pro-life Family Research Council <a href=\"https:\/\/downloads.frc.org\/EF\/EF15F70.pdf\" target=\"_blank\" rel=\"noopener\">analyzed<\/a>\u00a0the\u00a0<a href=\"https:\/\/www.gao.gov\/products\/GAO-18-204R\" target=\"_blank\" rel=\"noopener\">GAO report<\/a> and concluded that federal government agency dollars (including Title X) to Planned Parenthood averaged out to approximately $500 million each year, ($288 million in federal grants, contracts, and reimbursements and $1.2 billion in Medicaid.)<\/p>\n<p><strong>2016-2018:<\/strong> GAO reports published in the past few years have revealed that from <a href=\"https:\/\/archive.liveaction.org\/news\/three-abortion-groups-whopping-2-billion-taxpayers\/\" target=\"_blank\" rel=\"noopener\">2016-2018<\/a>, Planned Parenthood Federation of America (PPFA) received $1.6 billion in federal taxpayer dollars from Health and Human Services (HHS), averaging $533 million per year ($304 million through grants or cooperative agreements and $1.3 billion from Medicare, Medicaid, and CHIP).<\/p>\n<p><strong>2019-2021:<\/strong> GAO reports from <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-groups-2b-taxpayer-funding-3-years\/\" target=\"_blank\" rel=\"noopener\">2019-2021<\/a> showed that PPFA received $1.78 billion in federal taxpayer funding in just those three years, an average of $592 million federal dollars passed to Planned Parenthood \u2014 while Planned Parenthood abortions totaled 1.1 million within those same three years.<\/p>\n<p>According to the report, between 2021 ($5.71 million) and 2022 ($27.06 million), the Biden Administration\u2019s HHS obligations to Planned Parenthood <strong>increased nearly 374%<\/strong>.<\/p>\n<p>Over $1.53 billion in reimbursements from Medicare ($3.28M), Medicaid ($1535.27M) as well as CHIP ($50K) went to Planned Parenthood, and Planned Parenthood received nearly $149 million in grants and cooperative agreements, according to the GAO report.<\/p>\n<p><strong>2024:<\/strong> Members of Congress <a href=\"https:\/\/archive.liveaction.org\/news\/congress-gao-report-federal-funding-abortion-providers\/\" target=\"_blank\" rel=\"noopener\">recently requested<\/a>\u00a0for the GAO to provide them with updated numbers for the years 2022-2024.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/EheaLupeUOk?si=RTRXC5-6eWPsi1lC\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<h3><b>Title X funds Planned Parenthood\u00a0<\/b><\/h3>\n<p><strong>Republicans initiated Title X<\/strong><\/p>\n<p>Title X was enacted in 1970, and as Live Action News has previously <a href=\"https:\/\/archive.liveaction.org\/news\/history-of-george-h-w-bushs-relationship-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">documented<\/a>, one of the\u00a0chief co-sponsors of the\u00a0<a href=\"http:\/\/www.hhs.gov\/opa\/title-x-family-planning\/title-x-policies\/title-x-funding-history\/\" target=\"_blank\" rel=\"noopener\">Title X statute<\/a>\u00a0<a href=\"http:\/\/www.gao.gov\/products\/GAO-15-270R\" target=\"_blank\" rel=\"noopener\">allocating<\/a>\u00a0millions of federal tax dollars to Planned Parenthood was Rep. George H.W. Bush (R-Texas), who later became our nation\u2019s 41st president.\u00a0In 1970, the United States House of Representatives voted 298 to 32 to approve the\u00a0<a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/STATUTE-84\/pdf\/STATUTE-84-Pg1504.pdf\" target=\"_blank\" rel=\"noopener\">Family Planning Services and Population Research Act, Title X of the Public Health Service Act,<\/a> authorizing federal dollars to pay for \u201cfamily planning\u201d services for low-income women.<\/p>\n<p>Live Action News has\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/nixon-bush-planned-parenthood-family-planning\/\" target=\"_blank\" rel=\"noopener\">published<\/a>\u00a0additional information indicating that the push for federal population control dollars by\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/history-of-george-h-w-bushs-relationship-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">Congressman Bush<\/a>\u00a0was actually initiated by Planned Parenthood and its \u201c<a href=\"https:\/\/archive.liveaction.org\/news\/how-independent-is-guttmacher-from-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">special affiliate<\/a>,\u201d the Guttmacher Institute, and\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/population-control-recruited-president\/\" target=\"_blank\" rel=\"noopener\">enacted<\/a>\u00a0under the Richard Nixon Administration. (Read about that\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/nixon-bush-planned-parenthood-family-planning\/\" target=\"_blank\" rel=\"noopener\">here<\/a>).<\/p>\n<p>Bush\u2019s grandfather, Prescott Bush, had been a board member of Planned Parenthood and, at that time, prior to Planned Parenthood&#8217;s decision to <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-first-abortion-center\/\" target=\"_blank\" rel=\"noopener\">commit abortions<\/a>, approved of the organization\u2019s goals.<\/p>\n<p>Title X is\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/tell-hhs-planned-parenthood-defunded\/\" target=\"_blank\" rel=\"noopener\">administered<\/a> through the Office of Population Affairs (OPA) under HHS. The <a href=\"https:\/\/archive.liveaction.org\/news\/tell-hhs-planned-parenthood-defunded\/\" target=\"_blank\" rel=\"noopener\">federal program<\/a>\u00a0consists\u00a0of \u201c<a href=\"https:\/\/opa.hhs.gov\/grant-programs\/archive\/title-x-directory-archive\" target=\"_blank\" rel=\"noopener\">grantees<\/a>,\u201d or \u201cdirect recipient[s]\u201d of Title X funds, <a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=c1cbd72e13f7230f1e8328fa52b57899&amp;mc=true&amp;node=sp42.1.59.a&amp;rgn=div6\" target=\"_blank\" rel=\"noopener\">defined<\/a>\u00a0as \u201cthe entity that receives Federal financial assistance by means of a grant, and assumes legal and financial responsibility and accountability for the awarded funds, for the performance of the activities approved for funding and for reporting required information to the Office of Population Affairs.\u201d<\/p>\n<p>Funding can also go to \u201csub-recipients,\u201d which,\u00a0<a href=\"https:\/\/www.hhs.gov\/opa\/guidelines\/program-guidelines\/program-requirements\/index.html\" target=\"_blank\" rel=\"noopener\">according<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.hhs.gov\/opa\/sites\/default\/files\/ogc-cleared-final-april.pdf\" target=\"_blank\" rel=\"noopener\">requirements<\/a>, are \u201c[t]hose entities that provide family planning services with Title X funds under a written agreement with a grantee. May also be referred to as delegates or contract agencies.\u201d The facilities where grantee or sub-recipients are located are called \u201cservice sites.\u201d<\/p>\n<p>Today,\u00a0<a href=\"https:\/\/www.liveaction.org\/aidingabusers\/\" target=\"_blank\" rel=\"noopener\">Planned Parenthood<\/a>, known for violating requirements to report sexual abuse, is one of the largest recipients of those tax dollars, securing about $60 million a year from taxpayers. In 2015, 474 of Planned Parenthood\u2019s nearly 650 facilities were Title X recipients, according to a <a href=\"https:\/\/www.guttmacher.org\/sites\/default\/files\/report_pdf\/publicly_funded_contraceptive_services_2015_3.pdf\" target=\"_blank\" rel=\"noopener\">Guttmacher Institute<\/a>\u00a0report.<\/p>\n<p>While the federal Hyde Amendment prohibits federal taxpayer dollars from funding abortion\u00a0<em>directly<\/em>, money is\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/yes-your-tax-dollars-fund-abortions-at-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">fungible<\/a>. Money given to Planned Parenthood helps to pay for salaries, facility rent, and general overhead of the same facilities and employees who also participate in abortions.<\/p>\n<p>This is why, in 2019, President Donald Trump implemented the \u2018<a href=\"https:\/\/archive.liveaction.org\/news\/biden-hhs-undo-trump-protect-life-titlex\/\" target=\"_blank\" rel=\"noopener\">Protect Life Rule<\/a>,\u2019 a rule change which blocked facilities that received federal <a href=\"https:\/\/archive.liveaction.org\/news\/title-x-curb-population-people\/\" target=\"_blank\" rel=\"noopener\">Title X family planning funds<\/a> from providing or referring for abortion, including Planned Parenthood. At that time, HHS Secretary Alex Azar noted in a <a href=\"https:\/\/www.foxnews.com\/video\/6050745685001#sp=show-clips\" target=\"_blank\" rel=\"noopener\">FOX interview<\/a>, \u201cCancer screenings and preventative services [at Planned Parenthood facilities] are down 60 percent over the last eight years.\u201d<\/p>\n<p>Rather than stop committing abortions, according to a press release <a href=\"https:\/\/www.hhs.gov\/about\/news\/2019\/09\/30\/hhs-issues-supplemental-grant-awards-to-title-x-recipients.html\" target=\"_blank\" rel=\"noopener\">published<\/a>\u00a0by\u00a0the Office of Population Affairs (OPA), Planned Parenthood and other abortion advocacy or abortion-sympathetic recipients <a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-departure-title-x-reroutes-33m\/\" target=\"_blank\" rel=\"noopener\">relinquished<\/a> $33.6 million in Title X grants. In\u00a0<a href=\"https:\/\/www.hhs.gov\/opa\/grants-and-funding\/recent-grant-awards\/index.html\" target=\"_blank\" rel=\"noopener\">2019<\/a>, Planned Parenthood <strong>made up just <a href=\"https:\/\/archive.liveaction.org\/news\/five-facts-planned-parenthood-family-planning\/\" target=\"_blank\" rel=\"noopener\">nine percent<\/a> (9%)<\/strong> of the 90 HHS-approved Title X Family Planning grant recipients.<\/p>\n<p>Shortly after taking office in <a href=\"https:\/\/archive.liveaction.org\/news\/title-x-dollars-abortion-businesses-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">2021<\/a>, President Joe Biden issued an executive order instructing HHS to review the rule enacted by the previous administration. In October of that year, the Biden-Harris administration revoked Trump\u2019s protections, <a href=\"https:\/\/www.hhs.gov\/about\/news\/2021\/10\/04\/hhs-issues-final-regulation-aimed-at-ensuring-access-to-equitable-affordable-client-centered-quality-family-planning-services.html\" target=\"_blank\" rel=\"noopener\">announcing<\/a>\u00a0their intention to fully restore the funding to abortion businesses beginning November 8, 2021.<\/p>\n<p>And they did.<\/p>\n<p>Between 2022 and 2024, OPA <em>allocated<\/em> nearly $60 million to Planned Parenthood. Monies allocated are different from dollars sent to a Title X recipient during a specific year, and they break down as follows:<\/p>\n<ul>\n<li>In <a href=\"https:\/\/opa.hhs.gov\/grant-programs\/title-x-service-grants\/current-title-x-service-grant-recipients\/fy2022-title-X-service-grant-awards\" target=\"_blank\" rel=\"noopener\">2022<\/a>,\u00a0 OPA awarded funding to 89 Title X grant recipients, directly <strong>allocating over $16.8 million to 13 Planned Parenthood recipients<\/strong>. Planned Parenthood <strong>made up 15%<\/strong> of Title X recipients.<\/li>\n<li>In<a href=\"https:\/\/opa.hhs.gov\/grant-programs\/title-x-service-grants\/current-title-x-service-grant-recipients\/fy2023-title-X-service-grant-awards\" target=\"_blank\" rel=\"noopener\"> 2023<\/a>, OPA awarded funding to 86 Title X grant recipients, directly <strong>allocating nearly $20.8 million to 13 Planned Parenthood recipients<\/strong>. Planned Parenthood <strong>made up nearly 16%<\/strong> of Title X recipients.<\/li>\n<li>In <a href=\"https:\/\/opa.hhs.gov\/grant-programs\/title-x-service-grants\/current-title-x-service-grant-recipients\/fy2024-title-X-service-grant-awards\" target=\"_blank\" rel=\"noopener\">2024<\/a>, OPA awarded funding to 86 Title X grant recipients, directly <strong>allocating nearly $20.6 million to 13 Planned Parenthood recipients<\/strong>. Planned Parenthood again <strong>made up nearly 16% <\/strong>of Title X recipients.<\/li>\n<\/ul>\n<p>The recipients include Planned Parenthood affiliates, which means the federal dollars are being funneled to multiple Planned Parenthood centers under each affiliate&#8217;s control.<\/p>\n<h3><strong>Planned Parenthood violates Title X requirements to report child sexual abuse<\/strong><\/h3>\n<p>Title X makes it mandatory for recipients to report child sexual abuse, protect patient privacy, and refrain from discriminating based on race and other characteristics \u2014 all of which Planned Parenthood has failed to do.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/H9zYI2HM6PA?si=I-qdEEXhp5psfiaw\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>A May 2008 <a href=\"https:\/\/aidsetc.org\/sites\/default\/files\/resources_files\/Day%201-May%2028%2C%202008%20-%20ABCs%20of%204TCs%20%28S.%20Moskosky%29.pdf\" target=\"_blank\" rel=\"noopener\">presentation<\/a> by Susan B. Moskosky, Director of the Office of Family Planning\/Office of Population Affairs at HHS, also made it <a href=\"https:\/\/archive.liveaction.org\/news\/regulation-remove-title-x-funding-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">clear<\/a>\u00a0that Title X recipients are\u00a0expected\u00a0to report child sexual abuse.<\/p>\n<p>As Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/regulation-remove-title-x-funding-planned-parenthood\/\" target=\"_blank\" rel=\"noopener\">previously<\/a> documented, on April 25, 2014, OPA released <a href=\"https:\/\/www.hhs.gov\/opa\/title-x-family-planning\/about-title-x-grants\/program-policy-notices\/confidential-services-adolescents.html\" target=\"_blank\" rel=\"noopener\">Title X Family Planning Guidelines<\/a>, which clarified that \u201call Title X providers must comply with State laws requiring notification or the reporting of child abuse, child molestation, sexual abuse, rape, or incest.\u201d This was reiterated in the 2014\u00a0<a href=\"https:\/\/www.hhs.gov\/opa\/sites\/default\/files\/ogc-cleared-final-april.pdf\" target=\"_blank\" rel=\"noopener\">Program Requirements for Title X Funded Family Planning Project<\/a><a href=\"https:\/\/www.hhs.gov\/opa\/sites\/default\/files\/ogc-cleared-final-april.pdf\">s<\/a>.<\/p>\n<p>According to a March 2016 report by the\u00a0<a href=\"https:\/\/fas.org\/sgp\/crs\/misc\/RL33644.pdf\" target=\"_blank\" rel=\"noopener\">Congressional Research Service,<\/a>\u00a0reporting suspicion of child sexual abuse is expected of Title X providers. The report stated that, \u201cAlthough minors are to receive confidential services,\u00a0<strong>Title X providers are not exempt from state notification and reporting laws on child abuse, child molestation, sexual abuse, rape, or incest<\/strong>.\u201d<\/p>\n<p>More <a href=\"https:\/\/opa.hhs.gov\/grant-programs\/title-x-service-grants\/about-title-x-service-grants\/title-x-program-expectations\" target=\"_blank\" rel=\"noopener\">currently<\/a>, OPA&#8217;s July 2022 Title X <a href=\"https:\/\/web.archive.org\/web\/20250114191517\/https:\/\/opa.hhs.gov\/sites\/default\/files\/2022-08\/title-x-program-handbook-july-2022-508-updated.pdf\" target=\"_blank\" rel=\"noopener\">handbook<\/a> is clear: \u201cNotwithstanding any other provision of law, <strong>no provider of services under title X of the PHS Act shall be exempt from any State law requiring notification or the reporting of child abuse, child molestation, sexual abuse, rape, or incest<\/strong>.&#8221; The handbook, <a href=\"https:\/\/opa.hhs.gov\/sites\/default\/files\/2025-01\/Title%20X%20Program%20Handbook_Dec%202024_FINAL.pdf\">updated in December of 2024<\/a>, contains the same language.<\/p>\n<p>It also reiterates that Title X funds cannot pay for abortions:<\/p>\n<p style=\"padding-left: 40px;\"><em>That amounts provided to said projects under such title shall not be expended for abortions, that all pregnancy counseling shall be nondirective, and that such amounts shall not be expended for any activity (including the publication or distribution of literature) that in any way tends to promote public support or opposition to any legislative proposal or candidate for public office.<\/em><\/p>\n<p>Under the heading &#8220;Project Administration&#8221; in the 2022 Title X handbook, it is also clear that recipients must protect patient privacy and they cannot discriminate on the basis of race, religion, or sex, etc.:<\/p>\n<ul>\n<li style=\"font-weight: 400;\">&#8220;<b style=\"font-weight: 400;\">Provide services in a manner that does not discriminate against any client <\/b>based on religion,<b style=\"font-weight: 400;\"> race,<\/b> color, national origin, <b style=\"font-weight: 400;\">disability<\/b>, age, sex, sexual orientation, gender identity, sex characteristics, number of pregnancies, or marital status. (42 CFR \u00a7 59.5(a)(4))\u201d<\/li>\n<li style=\"font-weight: 400;\">Ensure that all information as to personal facts and circumstances obtained by the project staff about individuals receiving services <b>must be held confidential and must not be disclosed without the individual\u2019s documented consent<\/b>, except as may be necessary to provide services to the patient or as required by law, with appropriate safeguards for confidentiality. Information may otherwise be disclosed only in summary, statistical, or other form that does not identify the individual. <b>Reasonable efforts to collect charges without jeopardizing client confidentiality must be made<\/b>. Recipients must inform the client of any potential for disclosure of their confidential health information to policyholders where the policyholder is someone other than the client.
