A couple in California has sued their fertility doctor after discovering the wife was impregnated with donor sperm, rather than her husband’s as they had requested.<\/p>\n

Identified in the lawsuit as Jane and John Roe, the couple said<\/a> Dr. Hal Danzer medically raped Jane after they turned to him for fertility treatments. After the couple couldn’t conceive naturally, they turned to Danzer and the Los Angeles Fertility Institute, where they were told to try intrauterine insemination.<\/p>\n

Intrauterine insemination<\/a> is a process in which sperm is placed directly into the woman’s uterus during ovulation, in an effort to boost the chances of fertilization. They first conceived twins in April of 1984 but lost both of them after Jane went into premature labor. \u201cThe loss of their twins solidified Plaintiffs\u2019 deep desire for their own children and imbued their subsequent attempts to conceive with even greater gravity,\u201d the lawsuit said. The couple tried again, and successfully conceived twin girls, who were born healthy.<\/p>\n

But in January, the family was stunned after one of the twins took an Ancestry.com DNA test and discovered she had no biological connection to her father. Her sister took another test and got the same result: they had 50% Ashkenazi Jewish DNA, while their father is Greek. They also discovered 16 paternal half-siblings, all of whom were conceived in the Los Angeles area between 1971 – 1992.<\/p>\n

Unsurprisingly, the information had a serious impact on John. \u201c[H]e feels as though a key portion of his identity – that of being a father \u2014 has been stripped away overnight. Despite the fact that he knows his girls still love him, he feels left alone with no family,” the lawsuit said, noting that he also is worried about what Danzer did with the sperm he donated. \u201cIf Danzer could use the wrong sperm to inseminate Jane, might not he have used John\u2019s sperm to inseminate \u2014 perhaps even impregnate \u2014 someone else?\u201d<\/p>\n

The suit further added that Jane is struggling as well. \u201c[H]aving a trusted doctor medically rape her by impregnating her with a stranger\u2019s sperm without consent is a horror she feels she may never overcome,” the lawsuit said. “She also feels deeply ashamed, as if she let down her husband and her children by choosing to work with someone as careless as Danzer.”<\/p>\n

Tragically, this couple is far from alone. Many donor-conceived children and couples have learned in recent years that they were defrauded by the fertility industry. In this case, Danzer did not appear to have used his own sperm, that has been a regular occurrence with fertility doctors. One Detroit doctor was found to have fathered hundreds of children<\/a>; another pair of doctors fathered 75 children<\/a> between them.<\/p>\n
