{"id":323544,"date":"2024-12-24T10:32:58","date_gmt":"2024-12-24T16:32:58","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=323544"},"modified":"2024-12-23T16:12:41","modified_gmt":"2024-12-23T22:12:41","slug":"family-sues-wrongful-assisted-suicide","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/family-sues-wrongful-assisted-suicide\/","title":{"rendered":"Canadian family sues over man&#8217;s wrongful assisted suicide death"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">A Canadian family is suing a number of governmental and medical authorities after their 52-year-old family member, known as J.M.M. for privacy reasons, obtained access to MAiD in 2022 while on a day pass from the psychiatric hospital where he lived.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The family&#8217;s claim states that J.M.M. was not eligible for MAiD under the current Canadian laws and that the MAiD operations <\/span><a href=\"https:\/\/bc.ctvnews.ca\/providing-maid-to-man-on-day-pass-from-b-c-psychiatric-ward-was-unlawful-family-alleges-1.7151287\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">violate the Canadian Charter of Rights and Freedoms<\/span><\/a><span style=\"font-weight: 400;\">: &#8220;Accordingly, the MAID Framework infringes sections 7 and 15 of the Charter by depriving the vulnerable group of their rights to life, security of the person, and equal protection under the law.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Currently, in Canada, patients \u201cwhose sole medical condition is mental illness <\/span><a href=\"https:\/\/vancouversun.com\/news\/family-bc-man-received-maid-wrongful-death-lawsuit\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">will remain ineligible under MAiD until at least March 2027<\/span><\/a><span style=\"font-weight: 400;\">,\u201d according to the Vancouver Sun. However, if there is another physical condition that the person is suffering from, the door is open for them to obtain assisted suicide. The family said that \u201cthis failure exposes the vulnerable group, including J.M.M., to a heightened risk of premature death facilitated by the state and discriminates against them by denying equal protection under the law.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">J.M.M. was diagnosed with bipolar disorder in 2013 and was later deemed unfit to make decisions without guardians and was then committed to a psychiatric hospital by his family. The only other medical condition he was known to have was chronic back pain, but this \u201cwas neither grievous nor irremediable and therefore <\/span><a href=\"https:\/\/nationalpost.com\/news\/bc-psychiatric-patient-euthanized\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">did not meet the statutory eligibility criteria for MAiD<\/span><\/a><span style=\"font-weight: 400;\">.\u201d The claim also noted that there was financial stress that J.M.M. was under which compounded his desire for assisted suicide. Although he had been approved for MAiD earlier in the year before he was committed to the psych hospital, the claim writes that J.M.M. later stated, \u201che did not wish to proceed with the procedure and wished to pursue other means to relieve any suffering he had including rehabilitation.\u201d\u00a0<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/guardian-promote-free-expanded-abortion-nsw\/\" target=\"_blank\" rel=\"noopener\"><em>Authors at The Guardian promote \u2018free\u2019 and expanded abortion access in New South Wales<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">His doctors at St. Paul\u2019s Hospital Psych Ward specifically stated, \u201cJ.M.M. should not receive MAiD due to his mental illness, which impaired his capacity to consent.\u201d This also would have <\/span><a href=\"https:\/\/www.cbc.ca\/news\/canada\/british-columbia\/mental-physical-medical-assisted-death-1.7412923\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">disqualified him<\/span><\/a><span style=\"font-weight: 400;\"> from opting for MAiD<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the defendants \u201cnegligently or recklessly\u201d allowed him to leave the psychiatric ward on a day pass during which he visited Dr. Weibe\u2019s MAiD facility and died <em>that same day<\/em> by assisted suicide. His family states they were not informed of J.M.M.\u2019s decision until after he had already been killed.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The defendants targeted by the claim include Dr. Weibe, Willow Reproductive Health Centre, Provincial Health Services Authority, Vancouver Coastal Health Authority, Providence Health Care Society, the Canadian Minister of Health, and the Attorney General of Canada. Dr. Weibe runs Willow Reproductive Health Centre where she conducts abortions when she is not administering euthanasia drugs to kill born people. Dr. Weibe has had the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/canadian-euthanasia-rewarding-work\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">spotlight on her<\/span><\/a><span style=\"font-weight: 400;\"> recently for another lawsuit that involved the emergency halt to the assisted suicide of a 53-year-old Alberta woman.
