Congressman Chip Roy (R-Texas) sent a letter to FBI Director Christopher Wray and Attorney General Merrick Garland demanding that the Department of Justice (DOJ) leave the records and files pertaining to the prosecution of pro-life activists when the Biden-Harris administration leaves office.<\/p>\n

In the letter<\/a>, Roy accused the DOJ of weaponizing the Freedom of Access to Clinic Entrances (FACE) Act to persecute pro-life Americans. “Serious questions remain about the disparity in prosecutions between Americans supporting life and the perpetrators of violent attacks on pregnancy resource centers and houses of worship that occurred in the wake of the leak of the draft Supreme Court opinion in Dobbs v. Jackson Women\u2019s Health Organization<\/em>,” Roy wrote, pointing out that Wray admitted<\/a> during testimony before the Senate Homeland Security Committee that 70% of violence was being committed by pro-abortion activists against<\/em> the pro-life movement.<\/p>\n

“However, since January 2021, the Civil Rights Division has brought a total of 24 FACE Act cases against 55 defendants, with only two of these cases\u2014consisting of five defendants\u2014concerning attacks on pregnancy resource centers,” Roy continued. “Congress has a sacred duty to preserve the rights of the American people, including the First Amendment, against any overreach by the Executive Branch. As we examine how to best protect Americans\u2019 fundamental freedoms, the Subcommittees must first understand how the DOJ and FBI enforce the FACE Act. As our country transitions to a new administration, it is imperative that the DOJ and FBI preserve all documents and communications relating to enforcement of the FACE Act.”<\/p>\n

Roy sent a similar request<\/a> in October, which was ignored by the FBI. He also demanded<\/a> in August an investigation into whether or not the FBI was actually investigating the increase in pro-abortion violence. While 22 FACE Act violation charges were brought against pro-lifers in 22 cases since 2021, just two<\/em> were brought against abortion activists.<\/p>\n

As previously noted<\/a> by Live Action News, a report from the Daily Caller found that from 1994 to 2024, 205 cases were brought against pro-lifers; in that time span, at least 55 (27%) of those cases were prosecuted by the Biden-Harris DOJ alone… meaning that in under four years, the Biden-Harris DOJ prosecuted more than one-fourth of all FACE Act cases<\/em> since the Act came into existence 30 years ago.<\/p>\n

In addition, a detailed account<\/a> of the Biden-Harris DOJ’s prosecution of pro-lifers under the FACE Act since the just prior to the fall of Roe v. Wade<\/em> in 2022 noted, “From March 2022 through August 2024, at least 49 FACE Act violation charges were brought against more than 30 pro-lifers carrying out common protest efforts.” Notably, “All but two of the arrested pro-lifers who have since gone to trial have been found guilty of violating the FACE Act,\u00a0Conspiracy Against Rights<\/a>, or both, and many are\u00a0currently incarcerated<\/a>, with the longest sentence set at\u00a0just under five years<\/a>. Meanwhile,\u00a0only seven<\/em>\u00a0pro-abortion\u00a0activists<\/a>\u00a0have faced<\/a>\u00a0charges<\/a> for attacks against pro-life organizations since the wave of attacks began in May of 2022 \u2014 less than a quarter of the number of pro-lifers charged” despite FBI director Wray’s admission that pro-abortion activists have committed the lion’s share of offenses.<\/p>\n
