{"id":322776,"date":"2024-12-09T12:45:16","date_gmt":"2024-12-09T18:45:16","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=322776"},"modified":"2024-12-08T23:01:25","modified_gmt":"2024-12-09T05:01:25","slug":"idaho-court-doctors-state-abortion","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/idaho-court-doctors-state-abortion\/","title":{"rendered":"Court rules Idaho can&#8217;t prosecute doctors who refer women for out-of-state abortions"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">A court ruled last week that Idaho&#8217;s Attorney General of Idaho <\/span><a href=\"https:\/\/www.reuters.com\/legal\/government\/idaho-cannot-prosecute-doctors-out-of-state-abortion-referrals-court-rules-2024-12-04\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">will not be able<\/span><\/a><span style=\"font-weight: 400;\"> to prosecute doctors who refer for out-of-state abortions in violation of Idaho\u2019s laws.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The 9th Circuit Court of Appeals\u2019 <\/span><a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2024\/12\/04\/23-35518.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ruling<\/span><\/a><span style=\"font-weight: 400;\"> on Wednesday left in place a lower judge\u2019s 2023 decision that Idaho cannot prosecute doctors who refer for out-of-state abortions under a law that prohibits them from \u201cassist[ing] in performing or attempting to perform an abortion.\u201d The court found this to be viewpoint discrimination, a violation of free speech protected under the First Amendment. The decision is being hailed as a victory for Planned Parenthood.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe Attorney General\u2019s interpretation of \u00a7 18-622(1) in the Opinion Letter was a content-based restriction on speech because it silences healthcare providers on the specific topic of abortion. The interpretation forbids the expression of a particular viewpoint\u2014that abortion services in another state would likely help a patient,\u201d wrote Circuit Judge William Fletcher.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2023\/04\/labrador-idaho-opinion-letter.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">letter<\/span><\/a><span style=\"font-weight: 400;\"> in question that influenced the judge\u2019s ruling was one that Attorney General Labrador sent to a state legislator, dated March 27th, suggesting that the state would enforce the law against doctors referring for abortions. The section in question reads:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><em><span style=\"font-weight: 400;\">The plain meaning of assist is to give support or aid. An Idaho health care professional who refers a woman across state lines to an abortion provider or who prescribes abortion pills for the woman across state lines has given support or aid to the woman in performing or attempting to perform an abortion and has thus violated the statute.<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">Attorney General Labrador later rescinded the letter, saying it was a private communication. Prosecutors pointed out to the court that the Attorney General would not disavow the intent expressed in the letter with regard to prosecution.<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/preventable-pro-abortion-media-weaponizing-maternal-deaths\/\" target=\"_blank\" rel=\"noopener\"><em>\u2018PREVENTABLE\u2019: How pro-abortion media is weaponizing reporting on maternal deaths<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Currently, Idaho protects most preborn children from abortion. As Live Action News has reported, abortion giant Planned Parenthood has targeted the state with <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-pushes-out-state-abortions-billboards\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">advertising<\/span><\/a><span style=\"font-weight: 400;\"> and lawsuits in an attempt to promote abortion in the state any way it can, to undermine the state&#8217;s pro-life laws.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abortion supporters were pleased with the ruling. \u201cProviders shouldn\u2019t face the threat of punishment for helping their patients obtain the abortion care they need in states where abortion is legal,\u201d the ACLU and Planned Parenthood said in a statement.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As of Thursday, the state was still \u201creviewing the details of the decision and considering our options for appeal,\u201d according to a statement emailed to the <\/span><a href=\"https:\/\/www.idahostatesman.com\/news\/politics-government\/state-politics\/article296576244.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Idaho Statesman<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The setback for pro-lifers in Idaho comes after some positive news, however, as a court allowed Idaho\u2019s <\/span><a href=\"https:\/\/www.ortl.org\/2024\/12\/idaho-can-enforce-pro-life-law-against-abortion-trafficking-federal-court-rules\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">abortion-trafficking law to go into effect<\/span><\/a><span style=\"font-weight: 400;\">, allowing the state to prosecute any adult who helps a minor procure or obtain an abortion without parental consent. The crime is classified as a <\/span><a href=\"https:\/\/idahocapitalsun.com\/2024\/12\/06\/attorneys-in-idaho-abortion-trafficking-case-call-court-decision-major-victory\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">felony<\/span><\/a><span style=\"font-weight: 400;\"> punishable by two to five years in prison.
