{"id":322406,"date":"2024-12-01T16:33:28","date_gmt":"2024-12-01T22:33:28","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=322406"},"modified":"2024-11-30T20:15:04","modified_gmt":"2024-12-01T02:15:04","slug":"ohio-attorney-general-pro-life-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/ohio-attorney-general-pro-life-law\/","title":{"rendered":"Ohio Attorney General fights to reinstate portions of pro-life law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>Ohio Attorney General Dave Yost has appealed a court decision that overturned the state&#8217;s pro-life &#8220;heartbeat law,&#8221; which protected preborn children from abortion after about six weeks.<\/p>\n<p>Yost, along with Ohio Department of Health director Bruce Vanderhoff and the State Medical Board of Ohio\u2019s Kim Rothermel and Bruce Saferin, filed his notice of appeal, seeking to overturn Hamilton County Judge Christian Jenkins\u2019 October ruling. Jenkins <a href=\"https:\/\/archive.liveaction.org\/news\/ohio-judge-permanently-blocks-heartbeat-law\/\" target=\"_blank\" rel=\"noopener\">placed a permanent injunction<\/a> on the law, citing the state&#8217;s constitutional amendment which now establishes abortion as a constitutional &#8220;right.&#8221;<\/p>\n<p>In his appeal, Yost acknowledged that due to the amendment, the law restricting abortion would no longer be enforceable. However, he noted that other provisions of the law, <a href=\"https:\/\/www.reuters.com\/legal\/government\/ohio-seeks-revive-parts-abortion-law-despite-amendment-2024-11-26\/\" target=\"_blank\" rel=\"noopener\">including<\/a> a requirement that doctors first check for a fetal heartbeat and inform patients when the child has a heartbeat and is viable, along with a 24-hour waiting period, should still be legally upheld since they do not conflict with the amendment. Yost said that those provisions should remain &#8220;untouched,&#8221; since the plaintiffs who sued over the state&#8217;s heartbeat law didn&#8217;t specifically challenge those portions of the law.<\/p>\n<p>\u201cSeeking appellate review is a necessary and appropriate step,&#8221; <a href=\"https:\/\/www.cincinnati.com\/story\/news\/politics\/2024\/11\/26\/ohio-attorney-general-dave-yost-to-appeal-abortion-ban-case\/76589671007\/\" target=\"_blank\" rel=\"noopener\">said<\/a> Yost spokesperson Bethany McCorkle. &#8220;The state respects the will of the people regarding the six-week abortion ban, but the state is also obligated to protect provisions in Senate Bill 23, as passed by the General Assembly and signed by the governor, that the constitutional amendment does not address.
