Mark Gordon has said that Monday&#8217;s ruling to strike down the state&#8217;s pro-life law is &#8220;frustrating&#8221; and that the state will appeal the decision.<\/p>\n<p class=\"_1uhbe1z1 _1uhbe1z0\">\u201cI have directed the Attorney General to review the opinion and prepare an appeal to the Wyoming Supreme Court,\u201d <a href=\"https:\/\/cowboystatedaily.com\/2024\/11\/19\/wyoming-will-appeal-frustrating-ruling-to-block-abortion-bans-gordon-says\/\" target=\"_blank\" rel=\"noopener\">wrote<\/a> Gordon in a statement on Tuesday. He added, &#8220;I remain committed to defending the constitutionality of this law and the sanctity of life.&#8221;<\/p>\n<p><strong>11\/20\/2024<\/strong>: A Wyoming judge on Monday <a href=\"https:\/\/www.nbcconnecticut.com\/news\/national-international\/judge-strikes-down-wyoming-abortion-laws\/3436539\/\" target=\"_blank\" rel=\"noopener\">overturned<\/a> two laws protecting preborn children in the state on the basis that they are &#8220;unconstitutional.&#8221; The ruling means that abortion is legal in the state up until the point of &#8220;<a href=\"https:\/\/archive.liveaction.org\/news\/legal-viability-humanity-preborn-children\/\">fetal viability<\/a>,&#8221; a subjective standard which is not solely based on gestational age.<\/p>\n<p>With the ruling, Teton County District Judge Melissa Owens placed an injunction on the Life Act and restrictions on the abortion pill, saying the state &#8220;has enacted laws that impede the fundamental right to make health care decisions for an entire class of people, pregnant women.\u201d The measures had largely outlawed abortion in the state, including by use of the abortion pill. Both laws were challenged in a lawsuit by the abortion industry; Monday&#8217;s ruling marks the <a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/judge-strikes-wyomings-abortion-bans-saying-violate-state-constitution-rcna180731\" target=\"_blank\" rel=\"noopener\">third time<\/a> Owens has blocked the state&#8217;s laws put in place to protect the lives of preborn human beings from homicide by abortion.<\/p>\n<p>\u201cThe Court concludes that the Abortion Statutes suspend a woman\u2019s right to make her own health care decisions during the entire term of a pregnancy and are not reasonable or necessary to protect the health and general welfare of the people,\u201d Owens wrote.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/S-lQOooYAs8?si=avsINQnWuGjupJuB\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>Majority Floor Leader Rep. Chip Neiman <a href=\"https:\/\/cowboystatedaily.com\/2024\/11\/19\/wyoming-will-appeal-frustrating-ruling-to-block-abortion-bans-gordon-says\/\" target=\"_blank\" rel=\"noopener\">said<\/a> he was &#8220;saddened and appalled&#8221; at the ruling, noting that livestock in the state are granted more protections than preborn human beings. Cowboy State Daily reported:<\/p>\n<p style=\"padding-left: 40px;\"><em>&#8220;We go out of our way to protect and mount the forces and come to Wyoming and tell us how to protect a wolf \u2014 and we\u2019ll scatter the ashes of a grizzly bear over the valley in respect and deep remorse over the loss of this animal,\u201d said Neiman, referencing Wyoming residents\u2019 and outsiders\u2019 grief <a title=\"https:\/\/cowboystatedaily.com\/2024\/04\/03\/outrage-over-torment-of-wyoming-wolf-could-inflame-hunting-debate\/\" href=\"https:\/\/cowboystatedaily.com\/2024\/04\/03\/outrage-over-torment-of-wyoming-wolf-could-inflame-hunting-debate\/\" target=\"_blank\" rel=\"noopener noreferrer\">over a slain wolf<\/a>\u00a0and\u00a0<a title=\"https:\/\/cowboystatedaily.com\/2024\/11\/03\/vigil-for-grizzly-399-draws-more-than-200-to-jackson-from-across-the-country\/\" href=\"https:\/\/cowboystatedaily.com\/2024\/11\/03\/vigil-for-grizzly-399-draws-more-than-200-to-jackson-from-across-the-country\/\" target=\"_blank\" rel=\"noopener noreferrer\">famous grizzly bear<\/a> that died in the past year. \u201cAnd yet we don\u2019t have a problem with a judge that looks at innocent human life and says, \u2018Nope, no rights here?\u2019 <\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>&#8230; [T]o take a human baby and look at it and say it\u2019s not valuable \u2014 we give more respect to livestock than we do to human beings. How is that OK?\u201d <\/em><\/p>\n<p>Neiman added that the &#8220;viability&#8221; cutoff for abortion makes no sense, noting rightly that many elderly are often not independently viable at the end of their lives. \u201cIt just sickens me,\u201d he said. He also confirmed that lawmakers hope to reintroduce a bill requiring ultrasounds before abortion, which was previously vetoed by Governor Mark Gordon.<\/p>\n<p>\u201cWe can\u2019t quit. Human life is too valuable to just say, \u2018Well that\u2019s enough then, we lost,\u2019\u201d said Neiman. \u201cI\u2019m not giving up, and I\u2019m sure I\u2019m not alone.\u201d<\/p>\n<p>Gordon announced Tuesday that the state will appeal the ruling.<\/p>\n<p>\u201cJudge Owen\u2019s (sic) ruling is frustrating, still this is just one of the steps in the judicial process,\u201d he wrote in a <a href=\"https:\/\/cowboystatedaily.com\/2024\/11\/19\/wyoming-will-appeal-frustrating-ruling-to-block-abortion-bans-gordon-says\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> to Cowboy State Daily. \u201cRegardless of her decision, it was clear there would be an appeal.
