{"id":321580,"date":"2024-11-14T06:46:35","date_gmt":"2024-11-14T12:46:35","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=321580"},"modified":"2024-11-14T16:21:33","modified_gmt":"2024-11-14T22:21:33","slug":"wisconsin-supreme-court-arguments-1849-pro-life","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/wisconsin-supreme-court-arguments-1849-pro-life\/","title":{"rendered":"&#8216;Political theater&#8217;: Wisconsin Supreme Court justices hear oral arguments on 1849 pro-life law"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>The Wisconsin Supreme Court heard oral arguments Monday in a case to determine the constitutionality of the state&#8217;s 1849 law protecting preborn children from abortion.<\/p>\n<p>The 1849 law states that \u201cAny person, other than the mother, who intentionally destroys the life of an unborn child is guilty of a Class H felony.\u201d It went into effect following the United States Supreme Court&#8217;s overturn of <em>Roe v. Wade<\/em> in 2022 and was quickly challenged by the abortion industry.<\/p>\n<p>In December 2023, Dane County Circuit Judge Diane Schlipper\u00a0<a href=\"https:\/\/www.jsonline.com\/story\/news\/politics\/2023\/12\/05\/judge-rules-wisconsins-1849-law-does-not-ban-abortions\/70560319007\/\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that the 174-year-old law applies to feticide (an act of homicide against a fetus committed by someone other than the child\u2019s mother), but not abortion. That ruling led to an appeal by Sheboygan County District Attorney Joel Urmanski, and the case now sits before the state&#8217;s Supreme Court for a final decision.<\/p>\n<p>According to Wisconsin Right to Life, the state justices <a href=\"https:\/\/wisconsinrighttolife.org\/wrtl-news\/2024\/11\/11\/wisconsin-supreme-court-hears-oral-arguments-on-the-enforcement-of-s-940-04\/\" target=\"_blank\" rel=\"noopener\">appeared<\/a> all too eager to overturn the law, though the day was simply for hearings \u2014 an observation echoed by the <a href=\"https:\/\/www.wtaj.com\/news\/national-news\/ap-wisconsins-high-court-to-hear-oral-arguments-on-whether-an-1849-abortion-ban-remains-valid\/\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>, which called the session &#8220;little more than political theater.&#8221;<\/p>\n<p><span data-contrast=\"none\">\u201cIt was clear that the majority of the Wisconsin Supreme Court was there to legislate from the bench today,&#8221; said Heather Weininger, Executive Director of Wisconsin Right to Life. &#8220;District Attorney Urmanski\u2019s attorney had to remind those members of the court that the reason they were there today was not to be the legislature, but to determine if in fact the lower court\u2019s decision was applicable.\u201d<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:1,&quot;335551620&quot;:1,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:279}\">\u00a0<\/span><\/p>\n<p>The Court is currently comprised of seven members; six are women. According to the Milwaukee Journal-Sentinel, <a href=\"https:\/\/www.jsonline.com\/story\/news\/politics\/2024\/04\/17\/who-are-the-seven-supreme-court-justices-in-wisconsin\/73292671007\/\">the members are as follows<\/a>:<\/p>\n<ul class=\"gnt_ar_b_ul\">\n<li class=\"gnt_ar_b_ul_li\"><em><a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wicourts.gov\/courts\/supreme\/justices\/ziegler.htm\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|z|k|${u}\">Chief Justice Annette Kingsland Ziegler<\/a>, conservative, term ends 2027.<\/em><\/li>\n<li class=\"gnt_ar_b_ul_li\"><em><a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wicourts.gov\/courts\/supreme\/justices\/bradley.htm\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|z|k|${u}\">Ann Walsh Bradley<\/a>, liberal, term ends 2025.<\/em><\/li>\n<li class=\"gnt_ar_b_ul_li\"><em><a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wicourts.gov\/courts\/supreme\/justices\/rbradley.htm\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|z|k|${u}\">Rebecca Grassl Bradley<\/a>, conservative, term ends 2026.<\/em><\/li>\n<li class=\"gnt_ar_b_ul_li\"><em><a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wicourts.gov\/courts\/supreme\/justices\/dallet.htm\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|z|k|${u}\">Rebecca Frank Dallet<\/a>, liberal, term ends 2028.<\/em><\/li>\n<li class=\"gnt_ar_b_ul_li\"><em><a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wicourts.gov\/courts\/supreme\/justices\/hagedorn.htm\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|z|k|${u}\">Brian Hagedorn<\/a>, conservative, term ends 2029.<\/em><\/li>\n<li class=\"gnt_ar_b_ul_li\"><em><a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wicourts.gov\/courts\/supreme\/justices\/karofsky.htm\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|z|k|${u}\">Jill J. Karofsky<\/a>, liberal, term ends 2030.<\/em><\/li>\n<li class=\"gnt_ar_b_ul_li\"><em><a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wicourts.gov\/courts\/supreme\/justices\/protasiewicz.htm\" data-t-l=\":b|z|k|${u}\">Janet C. Protasiewicz<\/a>, liberal, term ends 2033<\/em><\/li>\n<\/ul>\n<p>Justice Jill Karofsky told Urmanski&#8217;s attorney Matthew Thome that the pro-life law &#8220;was essentially asking the court to sign a &#8216;death warrant&#8217; for women and children in Wisconsin.&#8221; Another liberal Justice, Rebecca Dallet, told Thome the law &#8220;was passed in 1849 by white men who held all the power.&#8221;<\/p>\n<div id=\"attachment_57098\" style=\"width: 681px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-57098\" decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-57098\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2014\/12\/human-fetus-20-weeks.jpg\" alt=\"human-fetus-20-weeks, pro-life, abortion restrictions\" width=\"671\" height=\"372\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2014\/12\/human-fetus-20-weeks.jpg 671w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2014\/12\/human-fetus-20-weeks-300x166.jpg 300w\" sizes=\"(max-width: 671px) 100vw, 671px\" \/><p id=\"caption-attachment-57098\" class=\"wp-caption-text\">A preborn child in the second trimester at 20 weeks.<\/p><\/div>\n<p>Attorney General Josh Kaul <a href=\"https:\/\/www.wpr.org\/news\/wisconsin-ag-josh-kaul-arguments-abortion-state-supreme-court\" target=\"_blank\" rel=\"noopener\">appeared<\/a> on Wisconsin Today following the oral arguments, saying, \u201cWe went about 15 months in Wisconsin where women were denied access to safe and legal abortion in the state and that had a lot of consequences for people\u2019s lives.&#8221; He added, &#8220;Fortunately, reproductive freedom has been restored in Wisconsin for now. But sadly, we continue to see the impacts in other states like Texas, where some people have lost their lives because of delayed care.&#8221; He alleged that the same &#8220;devastating health consequences&#8221; would occur for &#8220;women in Wisconsin.&#8221;<\/p>\n<p>However, <a href=\"https:\/\/archive.liveaction.org\/news\/new-yorker-woman-died-pro-life-law\/\" target=\"_blank\" rel=\"noopener\">no one<\/a> in Texas or any other <a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-did-georgias-law-kill-mom\/\" target=\"_blank\" rel=\"noopener\">state<\/a> with pro-life laws has died as a result of those laws. Rather, they died from the apparent medical negligence that took place and the <a href=\"https:\/\/archive.liveaction.org\/news\/experts-say-died-malpractice-pro-publica-blame\/\" target=\"_blank\" rel=\"noopener\">hands<\/a> of <a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-georgia-law-second-woman-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">doctors<\/a> who failed to properly treat them. And despite the media&#8217;s attempts to blame pro-life laws for such tragedies, the Associated Press <a href=\"https:\/\/archive.liveaction.org\/news\/ap-blames-pro-life-negligence-admits-everywhere\/\">admitted earlier this year<\/a> that its own analysis revealed, \u201cSerious violations that jeopardized a mother or her fetus\u2019 heath occurred in states with and without abortion bans\u2026.\u201d<\/p>\n<p>While the Supreme Court considers the case, abortions remain legal in the state through 20 weeks of pregnancy. Planned Parenthood has also filed a separate lawsuit with the state Supreme Court, asking it to determine whether or not abortion is constitutionally protected.
