Currently, <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-birth-thing-legal-9-states-dc\/\">nine states plus Washington, D.C.<\/a> allow abortion <a href=\"https:\/\/states.guttmacher.org\/policies\/abortion-policies\">with no restrictions<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The \u201cFundamental right to reproductive freedom\u201d\u2014 or what the Virginia Society for Human Life (VSHL) is more accurately calling the \u201c<\/span><a href=\"https:\/\/vshl.org\/abortion-up-to-birth-amendment\/?fbclid=IwY2xjawGfXwdleHRuA2FlbQIxMQABHdtM-D5fs7ZyOHBRwYuvMLLbsQIHN27q24CQeJhLU0rHFExe5hoEcdgR0A_aem_3I_fTvNfMOVbqMHYz4TMuQ\"><span style=\"font-weight: 400;\">Abortion up to birth amendment<\/span><\/a><span style=\"font-weight: 400;\">\u201d \u2014 was <\/span><a href=\"https:\/\/virginiageneralassembly.gov\/house\/agendas\/agendaItem.php?id=4626\"><span style=\"font-weight: 400;\">brought up<\/span><\/a><span style=\"font-weight: 400;\"> before the House Privileges and Elections Committee on Wednesday, November 13th, and was advanced in a party-line vote. The move appears to be an acceleration of the <\/span><a href=\"https:\/\/reprorisingva.org\/policy\/constitutional-amendment\/\"><span style=\"font-weight: 400;\">declared timeline<\/span><\/a><span style=\"font-weight: 400;\"> put forth by big money abortion groups.<\/span><\/p>\n<p>&#8220;Getting this right, something this big with life and death consequences, I think deserves more than just this meeting,&#8221; House Republican Leader Todd Gilbert said, according to local station <a href=\"https:\/\/www.wtkr.com\/news\/politics\/virginia-lawmakers-advance-amendments-on-abortion-voting-rights-same-sex-marriage\">WTKR<\/a>.<\/p>\n<p><span style=\"font-weight: 400;\">Earlier this year, the pro-abortion lobby sent bills to the governor\u2019s desk intending to shield abortionists who break laws in Virginia or elsewhere. Governor Youngkin vetoed the bills, <\/span><span style=\"font-weight: 400;\">Live Action News <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/virginia-governor-vetoes-bills-shield-abortionists\/\"><span style=\"font-weight: 400;\">reports<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The wording of <\/span><a href=\"https:\/\/lis.blob.core.windows.net\/files\/1005833.PDF\"><span style=\"font-weight: 400;\">HJ1<\/span><\/a><span style=\"font-weight: 400;\"> (and its companion <\/span><a href=\"https:\/\/legacylis.virginia.gov\/cgi-bin\/legp604.exe?241+ful+SJ1\"><span style=\"font-weight: 400;\">SJ1<\/span><\/a><span style=\"font-weight: 400;\">) is similar to the ACLU- and Planned Parenthood-funded constitutional amendment in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/montana-pro-lifers-extreme-abortion-agenda\/\"><span style=\"font-weight: 400;\">Montana<\/span><\/a><span style=\"font-weight: 400;\"> that voters adopted. The wording of the amendment is the most extreme abortion proposal in Virginia, and would <strong>negate any and all abortion limits,<\/strong> such as Virginia\u2019s already late limit on abortion, which is <i>after<\/i> the widely-accepted age of viability, and sits at 26 weeks and 6 days. It <em><strong>completely excludes any reference to viability<\/strong><\/em> and includes <strong>no limits<\/strong> except to &#8220;ensure the protection of the health of an individual seeking care.&#8221;<\/span><\/p>\n<p>Yet somehow, inexplicably, local station WTKR <a href=\"https:\/\/www.wtkr.com\/news\/politics\/virginia-lawmakers-advance-amendments-on-abortion-voting-rights-same-sex-marriage\">claims<\/a>, &#8220;Like current state law, it says Virginia may regulate abortion care in the third trimester of pregnancy, although Republicans questioned whether the language is as specific as state law.&#8221; <em>Nowhere<\/em> does the amendment state anything about regulation of abortion at all, nor does it mention trimesters of pregnancy.<\/p>\n<p><span style=\"font-weight: 400;\">Similar to <a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-8-times-ballot-initiatives-funding\/\">other recently-passed pro-abortion amendments<\/a>, the amendment text even contains controversial &#8220;<a href=\"https:\/\/archive.liveaction.org\/news\/pregnancy-outcome-laws-protect-women-babies-trash\/\">pregnancy outcomes<\/a>&#8221; language that some legal experts believe could allow for the decriminalization of infanticide.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The text reads:\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">That every individual has the fundamental right to reproductive freedom. This right to make and effectuate one&#8217;s own decisions about all matters related to one&#8217;s pregnancy shall not be denied, burdened, or infringed upon, <strong>unless justified by a compelling state interest<\/strong> and achieved by the least restrictive means that do not infringe an individual&#8217;s autonomous decision-making. <strong>A state interest is compelling only when it is to ensure the protection of the health of an individual seeking care<\/strong>, consistent with accepted clinical standards of practice and evidence-based medicine. The Commonwealth shall not discriminate in the protection or enforcement of this fundamental right.<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">That, except when justified by a compelling state interest, the Commonwealth shall not penalize, prosecute, or otherwise take adverse action against an individual on the basis of an actual, potential, perceived, or <strong>alleged outcome of such individual&#8217;s pregnancy<\/strong>, nor shall the Commonwealth penalize, prosecute, or otherwise take adverse action against an individual who aids or assists another individual, with such individual&#8217;s voluntary consent, in the exercise of such individual&#8217;s right to reproductive freedom.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">The amendment would negate parental consent laws, which would not only put minors in danger, but as Live Action News has reported, would also <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/liberal-abortion-laws-sex-traffickers\/\"><span style=\"font-weight: 400;\">aid in covering up human trafficking<\/span><\/a><span style=\"font-weight: 400;\">. Human trafficking <\/span><a href=\"https:\/\/www.wdbj7.com\/2024\/04\/11\/wdbj7-documentary-spotlights-human-trafficking-virginia\/\"><span style=\"font-weight: 400;\">only became illegal<\/span><\/a><span style=\"font-weight: 400;\"> in Virginia in 2015, and Virginia currently ranks <\/span><a href=\"https:\/\/samaritanhouseva.org\/get-informed\/human-trafficking\"><span style=\"font-weight: 400;\">15th in the nation<\/span><\/a><span style=\"font-weight: 400;\"> for human trafficking.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">What\u2019s worse, it would also prevent any potential limitations or more popular common-sense restrictions on abortion in the future. It would enshrine abortion up to birth in Virginia\u2019s constitution permanently.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is <a href=\"https:\/\/archive.liveaction.org\/news\/virginia-democrats-pro-abortion-amendment\/\">not the first time<\/a> lawmakers have attempted to legalize abortion up to birth in Virginia by a proposed constitutional amendment. And back in 2019, Delegate Kathy Tran was <a href=\"https:\/\/archive.liveaction.org\/news\/virginia-democrat-extreme-abortion-legislation\/\">lambasted<\/a> after <a href=\"https:\/\/archive.liveaction.org\/news\/virginia-democrat-abortion-bill-labor\/\">introducing a bill<\/a> to legalize abortion up to birth in the state. At that time, Del. Todd Gilbert questioned Tran:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\"><em>So where it\u2019s obvious that a woman is about to give birth, she has physical signs that she\u2019s about to give birth, would that still be a point at which she could still request an abortion if she was so certified [as needing an abortion to protect her mental health]? She\u2019s dilating?<\/em>\u00a0<\/span><\/p>\n<p>Tran responded, &#8220;Mr. Chairman, you know, that would be a decision that the doctor, the physician, and the woman would make.&#8221;<\/p>\n<p>Gilbert replied, &#8220;I understand that. I\u2019m asking if your bill allows that.&#8221;<\/p>\n<p>Tran said, &#8220;My bill would allow that, yes.&#8221;<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/GcHzaWyB21A?si=6re6PFjFChb711V0\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In order for Virginia\u2019s constitution to be amended, a resolution supporting the amendment must pass both the House and Senate during the same legislative session, and then sit until after a general House election. The same resolution must then pass both the House and Senate again. <\/span><span style=\"font-weight: 400;\">After this is complete, the amendment is placed on the ballot, which original estimates of big-money abortion groups place at 2026. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">If a majority of voters vote in favor of it, Virginia\u2019s constitution will be amended. The current legislative session is majority Democratic with a pro-life governor; however, there is little a pro-life governor can do to put the brakes on this process.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to <\/span><a href=\"https:\/\/vshl.org\/wp-content\/uploads\/2024\/10\/Stop-the-Extreme-abortion-Flyer-10-14-24.pdf\"><span style=\"font-weight: 400;\">VSHL<\/span><\/a><span style=\"font-weight: 400;\">, \u201cHaving a pro-life majority of State Senate or House of Delegates defeat the resolution in the General Assembly or Virginians defeat the bill during a ballot initiative. We believe it is important to defeat this Amendment when being voted on by the Virginia General Assembly. Planned Parenthood, with vast financial resources, would dramatically outspend pro-life efforts if the Amendment goes to a referendum.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But at least one political scientist at the University of Mary Washington suggests that the path forward for the amendment may not be as easy and straightforward as pro-lifers fear.\u00a0 <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Stephen Farnsworth of the University told <\/span><a href=\"https:\/\/www.nbcwashington.com\/news\/local\/the-next-step-in-virginias-abortion-rights-battle-a-constitutional-amendment\/3477902\/\"><span style=\"font-weight: 400;\">NBC4<\/span><\/a><span style=\"font-weight: 400;\"> last year: &#8220;One of the realities that we sometimes see in politics these days is that popular ideas don&#8217;t necessarily reach a consensus across party lines. So going to the voters might be a way to resolve, once and for all, some of these issues.&#8221;<\/span><\/p>\n<p>However, as was seen with recent pro-abortion ballot initiatives put to voters, <a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-8-times-ballot-initiatives-funding\/\">most passed<\/a>. Though it has become popular to say that overturning <em>Roe v. Wade<\/em> was positive because it will now allow states to decide their own abortion laws, the fact remains that <a href=\"https:\/\/archive.liveaction.org\/news\/protecting-human-life-decided-will-people\/\">allowing voters to decide<\/a> which innocent human beings may be discriminated against and then executed, and which may not, is unjust.
