{"id":320264,"date":"2024-10-14T16:41:33","date_gmt":"2024-10-14T21:41:33","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=320264"},"modified":"2024-10-13T23:48:45","modified_gmt":"2024-10-14T04:48:45","slug":"louisiana-law-abortion-pill-controlled-substance-effect","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/louisiana-law-abortion-pill-controlled-substance-effect\/","title":{"rendered":"Louisiana law regulating abortion pill as a controlled substance goes into effect"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>A <a href=\"https:\/\/www.ksla.com\/2024\/10\/11\/louisiana-now-considers-2-abortion-pills-be-controlled-dangerous-substances\/\" target=\"_blank\" rel=\"noopener\">Louisiana law<\/a> requiring the classification of the abortion pill drugs mifepristone and misoprostol as controlled substances went into effect on October 1.<\/p>\n<p>Act 246, also known as the Catherine and Josephine Herring Act, was sponsored by State Senator Thomas Pressly, who said his sister was <a href=\"https:\/\/archive.liveaction.org\/news\/woman-details-attempt-force-abortion\/\" target=\"_blank\" rel=\"noopener\">unknowingly given the abortion pill<\/a> mifepristone by her husband, who wanted to kill their preborn child.<\/p>\n<p>Pressly said his bill is meant to ensure that mifepristone and misoprostol do not end up in the wrong hands \u2014 particularly as the abortion pill has become increasingly easy to get through mail-order services.<\/p>\n<p class=\"text | article-text\">&#8220;This bill really does two things,\u201d he explained. \u201cOne, we\u2019re making sure the pills are being able to be used for legitimate health care reasons. They\u2019re going to continue to be able to be used. They can be in hospitals when emergencies come up. And they can be prescribed outside of a hospital setting when necessary as well. By a doctor, by a nurse practitioner, by a physician\u2019s assistant. At the same time, if these pills are used for improper means and things that are not allowed under Louisiana law, such as abortion, then the bad actors will be held responsible and liable in a criminal fashion for that act,\u201d Pressly said.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/gnEHZiud8dg?si=8PaAZiEMe6akeHHU\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe>\n<\/p>\n<p>Louisiana Governor Jeff Landry <a href=\"https:\/\/archive.liveaction.org\/news\/louisiana-passes-bill-coerced-abortion\/\" target=\"_blank\" rel=\"noopener\">signed the legislation<\/a> in May. &#8220;Requiring an abortion inducing drug to be obtained with a prescription and criminalizing the use of an abortion drug on an unsuspecting mother is nothing short of common sense,\u201d he said at the time. \u201cThis bill protects women across Louisiana.&#8221;<\/p>\n<p>Since Landry&#8217;s signature, there have been many abortion advocates warning that the law is dangerous to women who may be denied access to mifepristone and misoprostol for purposes other than abortion.<\/p>\n<p>Attorney General Liz Murrill released a statement last month clarifying the law to assuage any misinformation. &#8220;[Act 246] does not limit a healthcare provider\u2019s ability to use, prescribe, or fill these medications for legitimate health purposes nor does it impose restrictive burdens on access for emergency purposes,\u201d she <a href=\"https:\/\/prolifelouisiana.org\/statement-from-attorney-general-liz-murrill-sets-the-record-straight-on-act-246\/\" target=\"_blank\" rel=\"noopener\">stated<\/a>.<\/p>\n<p>She went on:<\/p>\n<p style=\"padding-left: 40px;\"><em>To be clear: nothing in Louisiana laws stands in the way of a doctor providing care that stabilizes and treats emergency conditions. Any statements to the contrary are flatly incorrect. Any hospital or doctor at any hospital or emergency room who refuses to treat and stabilize a woman having a miscarriage or suffering with an ectopic pregnancy could be committing both medical malpractice and violating federal law. Louisiana law should not be read as requiring hospital or emergency room staff to refuse such emergency care.<\/em><\/p>\n<p>Nearly all preborn children are protected from abortion in Louisiana \u2014 a fact Murrill emphasized in her statement with the <a href=\"https:\/\/www.ag.state.la.us\/Article\/158\" target=\"_blank\" rel=\"noopener\">reminder<\/a> that &#8220;intentional delivery&#8221; of abortion pills via online or mail-order methods is strictly prohibited.<\/p>\n<p class=\"p1\" style=\"text-align: center;\"><span class=\"s1\"><a href=\"https:\/\/www.liveaction.org\/resist-pressure-to-dispense-the-abortion-pill\/\"><b><i>Urge Walmart, Costco, Kroger, and other major chains to resist pressure to dispense the abortion pill<\/i><\/b><b><i><\/i><\/b><\/a><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Louisiana law requiring the classification of the abortion pill drugs mifepristone and misoprostol as controlled substances went into effect on October 1.
