{"id":320081,"date":"2024-10-13T11:44:39","date_gmt":"2024-10-13T16:44:39","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=320081"},"modified":"2024-10-10T23:06:41","modified_gmt":"2024-10-11T04:06:41","slug":"india-rules-parents-son-sperm-ivf","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/india-rules-parents-son-sperm-ivf\/","title":{"rendered":"India&#8217;s High Court rules parents can have dead son&#8217;s sperm for IVF"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">India&#8217;s High Court recently ruled that a deceased man\u2019s parents may use his preserved sperm for reproductive purposes, according to the <\/span><a href=\"https:\/\/www.bbc.com\/news\/articles\/cnvdgv6rejvo\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">BBC<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The deceased man\u2019s mother, Harbir Kaur, told the BBC she and her husband were \u201cdelighted\u201d and that they had plans for their son&#8217;s sister to be a surrogate mother for his child \u2014 their grandchild.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cHe loved his sisters and was much loved by his friends. He is the screensaver on my phone. I start my day by looking at his face every morning,\u201d said Mrs. Kaur, adding, \u201cWe will keep it in the family.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kaur\u2019s son, Preet Inder Singh, 30, was diagnosed with Non-Hodgkin&#8217;s Lymphoma in June of 2020. Because Preet was unmarried and the disease and its treatment were likely to affect his reproductive faculties, the hospital where he was being treated recommended storing his semen. Preet did so, and sadly passed away on September 1 of the same year.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When the grieving parents tried to retrieve their son\u2019s genetic material, they were rebuffed by the hospital. The hospital told the man\u2019s parents that the law only permitted the semen to be released to the spouse of the deceased.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe policy stated that gametes can be released only to a spouse and there was no policy in place,\u201d the hospital\u2019s lawyer Anurag Bindal said, according to the <\/span><a href=\"https:\/\/indianexpress.com\/article\/cities\/delhi\/delhi-hc-give-dead-mans-frozen-sperms-to-his-parents-for-surrogacy-9604291\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Indian Express<\/span><\/a><span style=\"font-weight: 400;\">. \u201cIn terms of the Assisted Reproductive Technology (Regulation) Act 2021, no statutory guidelines have been placed in respect of disposal\/utilization of semen samples of [an] unmarried person.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In recent years, India\u2019s laws regarding IVF and surrogacy have been evolving, mostly to combat the rise in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/priyanka-chopra-nick-jonas-feminist-surrogacy\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">predatory<\/span><\/a> <a href=\"https:\/\/archive.liveaction.org\/news\/experts-condemn-gestational-surrogacy-harmful-exploitative\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">surrogacy<\/span><\/a><span style=\"font-weight: 400;\">. The Assisted Reproductive Technology Regulation Act <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/india-ending-commercial-surrogacy\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">outlawed paying for the practice<\/span><\/a><span style=\"font-weight: 400;\">, but left room for so-called \u201caltruistic\u201d surrogacy by married women ages 25-35, with one child of their own already.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite the country\u2019s effort to curb the fertility industry, IVF is still largely poorly regulated worldwide, and the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/women-india-died-egg-harvesting-casualties-fertility\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">risks<\/span><\/a><span style=\"font-weight: 400;\"> of donating eggs and undergoing hormonal treatments are frequently not well-explained.\u00a0<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-rejects-ivf-clinics-appeal-alabama\/\" target=\"_blank\" rel=\"noopener\"><em>Supreme Court rejects IVF clinic\u2019s appeal of Alabama ruling<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Preet Singh\u2019s parents brought the matter of the hospital&#8217;s refusal to the High Court, who ruled that the son\u2019s semen is property that can be released to his parents for purposes of posthumous reproduction, as the consent form he signed implies he was aware and consented to his parents\u2019 wishes. Additionally, Justice Prathiba M. Singh ruled that the parents being allowed to create grandchildren with their dead son\u2019s sperm was an <\/span><a href=\"https:\/\/lawtrend.in\/delhi-hc-allows-parents-to-use-deceased-sons-frozen-sperm-for-posthumous-reproduction\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">extension of the dead son\u2019s reproductive autonomy<\/span><\/a><span style=\"font-weight: 400;\"> and should be respected under the Indian constitution.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lastly, Judge Singh ruled that grandparents are \u201cequally capable of bringing up their grandchildren in a manner so as to integrate them into society\u2026\u201d the ruling reads, according to the <\/span><a href=\"https:\/\/indianexpress.com\/article\/cities\/delhi\/delhi-hc-give-dead-mans-frozen-sperms-to-his-parents-for-surrogacy-9604291\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Indian Express<\/span><\/a>. <span style=\"font-weight: 400;\">\u201c In the present case, the proposed child may be born through an identified surrogate mother or by fertilization of the sperm with a consenting lady who may be identified by the petitioners through IVF.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As Live Action News has <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/widow-dead-husband-sperm-surrogate\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">reported<\/span><\/a><span style=\"font-weight: 400;\">, a similar battle was fought recently in Australia when a 62-year-old woman fought to retrieve her deceased husband\u2019s sperm, also for the purposes of posthumous reproduction. In 2023, a Spanish actress also created a baby via a surrogate with her dead son\u2019s sperm, at <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/spanish-tv-star-surrogate-child-dead-son\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">68 years old<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With profit as the main driver of the IVF industry, patients are frequently not ethically screened. The case of a 74-year-old woman in India in 2019 made headlines when she <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/ivf-74-year-twins-hospitalized\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">gave birth to twins via IVF<\/span><\/a><span style=\"font-weight: 400;\">, drawing moral criticism from around the globe.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the process of creating an embryo with Singh\u2019s sperm in a lab, many babies could be <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/watch-pro-life-concern-ivf-why\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">discarded<\/span><\/a><span style=\"font-weight: 400;\"> \u2014 at a higher rate than <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/poll-support-ivf-4-things-told\/\"><span style=\"font-weight: 400;\">abortion<\/span><\/a><span style=\"font-weight: 400;\"> \u2014 or frozen indefinitely. Frequently if too many babies survive implantation, they are \u201cselectively reduced\u201d via abortion.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ultimately, babies are not commodities to be bought and sold.
