{"id":319970,"date":"2024-10-07T16:46:11","date_gmt":"2024-10-07T21:46:11","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=319970"},"modified":"2024-10-07T16:37:15","modified_gmt":"2024-10-07T21:37:15","slug":"supreme-court-force-texas-preborn-babies-emergencies","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/supreme-court-force-texas-preborn-babies-emergencies\/","title":{"rendered":"US Supreme Court won&#8217;t force Texas hospitals to intentionally kill preborn babies in emergencies"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">The Supreme Court declined on Monday to hear the Biden administration\u2019s appeal of a case in which it would would force Texas hospitals to commit abortions as emergency stabilizing \u201ctreatment,\u201d leaving a lower court\u2019s decision in place.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After the 2022 <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> decision that overturned <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\">, the Biden administration\u2019s department of Health and Human Services (HHS) invoked the Emergency Medical Treatment and Labor Act (EMTALA) to issue federal guidance in July of the same year. EMTALA is a <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-1994-title42-section1395dd&amp;num=0&amp;edition=1994\" target=\"_blank\" rel=\"noopener\">law<\/a> that requires hospitals to treat emergency medical conditions and stabilize patients, such that their conditions will likely not deteriorate in the immediate future. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Biden administration took that guidance a step further, directing that hospitals had to provide \u201cemergency\u201d abortions, preempting any state pro-life law \u2014 or risk losing federal funds.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Texas <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/texas-sues-biden-administration-hospitals-abortions-funding\/\"><span style=\"font-weight: 400;\">sued<\/span><\/a><span style=\"font-weight: 400;\"> the Biden administration, saying among other things that the rule was improperly applied, that it violates the Hyde amendment by making federal funding dependent on providing abortions, and that nothing in EMTALA supports an abortion mandate. \u201cEMTALA does not mandate access to abortion or codify a right to an abortion as \u2018stabilizing treatment\u2019 for an \u2019emergency medical condition.\u2019 The Abortion Mandate cites no other federal law that would authorize or require an abortion. No federal statute, including EMTALA, supersedes or preempts the States\u2019 power to regulate or prohibit abortion,\u201d read the suit in part.\u00a0<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/growing-number-americans-pro-choice-whats-behind\/\" target=\"_blank\" rel=\"noopener\"><em>A growing number of Americans call themselves \u2018pro-choice\u2019 \u2013 but what\u2019s really behind it?<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">The Supreme Court\u2019s move leaves in place the earlier 5th Circuit Court of Appeals <\/span><a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-10246-CV0.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">decision<\/span><\/a><span style=\"font-weight: 400;\"> in <\/span><a href=\"https:\/\/www.texastribune.org\/2024\/01\/02\/texas-abortion-fifth-circuit\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Texas\u2019 favor<\/span><\/a><span style=\"font-weight: 400;\">, stating that \u201cEMTALA does not govern the practice of medicine.\u201d However, the questions of the case remain unresolved at the national level.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Separately, Idaho <a href=\"https:\/\/archive.liveaction.org\/news\/biden-hhs-propaganda-emergency-abortions-judge\/\">also sued the administration<\/a>. As Live Action News reported in that case:<\/span><\/p>\n<p style=\"padding-left: 40px;\">.<em>.. the U.S. Supreme Court sent <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/23-726.html\" target=\"_blank\" rel=\"noopener\">Moyle v. United States<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A470\/290151\/20231120154722276_2023-11-20%20Motion%20with%20Appendix.pdf\" target=\"_blank\" rel=\"noopener\">Idaho v. United States<\/a>\u00a0back to a lower court, reinstating an injunction on Idaho\u2019s Defense of Life Act. This means that should an \u201cemergency abortion\u201d become absolutely necessary to protect a pregnant woman in any of the very narrow possible circumstances where Idaho\u2019s law conflicts with the federal EMTALA rules, doctors in Idaho must provide that \u201cemergency abortion\u201d as a \u201cstabilizing treatment.\u201d A press release quote from Idaho AG Ra\u00fal Labrador\u00a0<a href=\"https:\/\/adflegal.org\/press-release\/justice-barrett-idahos-ability-enforce-its-law-remains-almost-entirely-intact\">noted<\/a>:<\/em><\/p>\n<p style=\"padding-left: 80px;\"><em>The Biden administration\u2019s\u00a0<strong>concession that EMTALA will rarely override Idaho\u2019s law<\/strong>\u00a0caused the Supreme Court to ask the 9th Circuit for review in light of the federal government\u2019s change in position.\u00a0<strong>Justice Barrett wrote, those concessions mean that Idaho\u2019s Defense of Life Act \u2018remains almost entirely intact.\u2019<\/strong>\u00a0The 9th Circuit\u2019s decision should be easy. As Justice Alito explained well: the Biden administration\u2019s \u2018preemption theory is plainly unsound.\u2019<\/em><\/p>\n<p><span style=\"font-weight: 400;\">Abortion, defined as the intentional and direct killing of a preborn child, is not health care and is not medically necessary, despite the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-did-georgias-law-kill-mom\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">efforts<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-georgia-law-second-woman-abortion-pill\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">media<\/span><\/a><span style=\"font-weight: 400;\"> to <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/california-attorney-general-sues-catholic-hospital-abortion\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">portray<\/span><\/a><span style=\"font-weight: 400;\"> instances of insufficient medical care as the direct consequence of pro-life laws. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">When a mother\u2019s life is in danger, it is not necessary to kill her baby before performing a labor induction or an emergency c-section in an effort to save both lives, or to remove an ectopic pregnancy. Additionally, <strong>all<\/strong> of these procedures are legal under Texas\u2019 heartbeat law, which contains a <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/texas-women-blame-pro-life-law-ectopic\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">legal carve-out for medical emergencies<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/www.liveaction.org\/resist-pressure-to-dispense-the-abortion-pill\/\"><b><i>Urge Walmart, Costco, Kroger, and other major chains to resist pressure to dispense the abortion pill<\/i><\/b><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court declined on Monday to hear the Biden administration\u2019s appeal of a case in which it would would force Texas hospitals to commit abortions as emergency stabilizing \u201ctreatment,\u201d leaving a lower court\u2019s decision in place.\u00a0 After the 2022 Dobbs decision that overturned Roe v.
