{"id":318745,"date":"2024-09-16T12:52:25","date_gmt":"2024-09-16T17:52:25","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=318745"},"modified":"2024-09-15T23:04:44","modified_gmt":"2024-09-16T04:04:44","slug":"texas-ag-biden-harris-hhs-abortion-information","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/texas-ag-biden-harris-hhs-abortion-information\/","title":{"rendered":"Texas AG sues Biden-Harris HHS over rule that would hide abortion information"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">Texas Attorney General Ken Paxton recently <\/span><a href=\"https:\/\/www.reuters.com\/legal\/texas-sues-block-biden-rule-protecting-privacy-women-who-get-abortions-2024-09-05\/\"><span style=\"font-weight: 400;\">filed a lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> at the Federal District Court in Lubbock against a Biden administration rule that would hide information regarding abortion or other \u201creproductive health\u201d from criminal investigations \u2014 a law which disingenuously purports to protect women, but instead could end up harming them.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Biden Administration\u2019s <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/04\/26\/2024-08503\/hipaa-privacy-rule-to-support-reproductive-health-care-privacy\"><span style=\"font-weight: 400;\">proposed rule<\/span><\/a><span style=\"font-weight: 400;\"> greatly limits the circumstances under which personal health information (PHI) can be shared when it comes to \u201creproductive health care,\u201d or abortion. While the original 1996 Health Insurance Portability and Accountability Act (HIPAA) still allowed states access to some information \u2013 for example, where it relates to public health like diseases, child abuse, births, deaths, injury, etc. \u2013 the new rule would greatly inhibit or block their investigative ability to look at this information if it has anything to do with \u201creproductive health care.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Attorney General Paxton said in a <\/span><a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-sues-biden-administration-over-illegal-rule-would-weaken-state-law\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\">: \u201cThis new rule actively undermines Congress\u2019s clear statutory meaning when HIPAA was passed, and it reflects the Biden Administration\u2019s disrespect for the law. The federal government is attempting to undermine Texas\u2019s law enforcement capabilities, and I will not allow this to happen.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the <\/span><a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/zjpqybdjdpx\/Texas%20v%20HHS%20complaint%20HIPAA%209-4-24.pdf\"><span style=\"font-weight: 400;\">filing<\/span><\/a><span style=\"font-weight: 400;\">, the Texas AG is asserting that the 2024 rule was enacted \u201cin order to obstruct States\u2019 ability to enforce their own laws on abortion and other laws that HHS deems to fall under the rubric of \u2018reproductive health care,\u2019\u201d and points out that the rule itself explicitly states that it exists as a response to the Supreme Court\u2019s <\/span><i><span style=\"font-weight: 400;\">Dobbs<\/span><\/i><span style=\"font-weight: 400;\"> decision in 2022 that overturned <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\"> and <\/span><i><span style=\"font-weight: 400;\">Planned Parenthood v. Casey<\/span><\/i><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/biden-hhs-abortion-related-information\/\"><em>New Biden HHS rule would ban sharing of abortion-related information with law enforcement<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Under the Biden administration rule, information that is in any way related to reproductive health care would be difficult to obtain, or just simply blocked. This would prevent states like Texas with pro-life laws from knowing about abortions, potentially preventing the state from prosecuting illegal abortions, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortionist-sued-patients-left-sterile\/\"><span style=\"font-weight: 400;\">medical malpractice<\/span><\/a><span style=\"font-weight: 400;\">, abortion or other kinds of criminal activity, effectively <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/media-doesnt-tell-abortion-industry-darker\/\"><span style=\"font-weight: 400;\">shielding dangerous abortionists<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Supporters of the rule have painted the issue as a way of protecting women\u2019s privacy. &#8220;The Biden-Harris Administration remains committed to protecting reproductive health privacy and ensuring that no woman&#8217;s medical records are used against her, her doctor, or her loved one simply because she got the lawful reproductive care she needed,&#8221; the agency said according to <\/span><a href=\"https:\/\/www.cbsnews.com\/texas\/news\/texas-lawsuit-federal-rule-protects-medical-records-abortions\/\"><span style=\"font-weight: 400;\">CBS<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However the concern for shielding women from prosecution lacks merit, as Texas\u2019 heartbeat law <\/span><a href=\"https:\/\/casetext.com\/statute\/texas-codes\/health-and-safety-code\/title-2-health\/subtitle-h-public-health-provisions\/chapter-171-abortion\/subchapter-h-detection-of-fetal-heartbeat\/section-171206-construction-of-subchapter#:~:text=Section%20171.206%20%2D%20Construction%20of%20Subchapter%20(a)%20This%20subchapter%20does,a%20fetal%20heartbeat%20is%20detected.\"><span style=\"font-weight: 400;\">sec. 171.206 (b) (1) <\/span><\/a><span style=\"font-weight: 400;\">\u00a0<\/span><i><span style=\"font-weight: 400;\">explicitly prohibits<\/span><\/i><span style=\"font-weight: 400;\"> targeting a woman on whom an abortion was performed or induced.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a June 2023 <\/span><a href=\"https:\/\/www.ag.ky.gov\/Press%20Release%20Attachments\/2023.06.16%20Comment%20Letter%20of%20the%20Mississippi%20Attorney%20General%20et%20al.%20(as%20filed).pdf\"><span style=\"font-weight: 400;\">letter<\/span><\/a><span style=\"font-weight: 400;\"> to Secretary Becerra signed by pro-life Attorneys General of several states, they called a precursor to the current rule \u201ca solution in search of a problem\u201d and called out the false narrative that states are seeking to punish women who seek abortions. Moreover, they point out the potential for future injury that hiding such information would cause, saying that if, for example, someone were to commit an illegal abortion on a woman that injures her, it would be difficult to prosecute the doctor.
