Becerra, et. al<\/span><\/a><\/em><span style=\"font-weight: 400;\">\u00a0<\/span><a href=\"https:\/\/www.tennessean.com\/story\/news\/health\/2024\/08\/27\/title-x-funds-in-tennessee-feds-dont-have-to-return-money\/74973840007\/\"><span style=\"font-weight: 400;\">announced this week<\/span><\/a><span style=\"font-weight: 400;\"> that the State of Tennessee gave up funding through Title X when it chose not to include counseling for illegal abortions with the grant money. According to the <\/span><a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/attorneygeneral\/documents\/pr\/2023\/title-x-complaint.pdf\"><span style=\"font-weight: 400;\">original complaint<\/span><\/a><span style=\"font-weight: 400;\"> filed by the Attorney General\u2019s office, the suit sought to defend Tennessee against the \u201cfederal government\u2019s latest effort to coerce States into carrying out pro-abortion policy in violation of statutory, constitutional, and administrative-law limits.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.opn.ca6.uscourts.gov\/opinions.pdf\/24a0199p-06.pdf\"><span style=\"font-weight: 400;\">2-1 ruling<\/span><\/a><span style=\"font-weight: 400;\"> allows the federal Department of Health and Human Services to withhold about $7 million of funding for low-income family planning services from Tennessee for fiscal year 2022-23. The money <\/span><a href=\"https:\/\/wpln.org\/post\/tennessees-abortion-ban-cost-it-7m-in-federal-funding-now-those-dollars-will-be-routed-to-planned-parenthood\/\"><span style=\"font-weight: 400;\">was given<\/span><\/a><span style=\"font-weight: 400;\"> instead to <\/span><span style=\"font-weight: 400;\">Planned Parenthood of Tennessee and North Mississippi, and Virginia League for Planned Parenthood<\/span><span style=\"font-weight: 400;\"> \u2014 who used the money in Tennessee. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<\/span><span style=\"font-weight: 400;\">We are experts in high-quality, nonjudgmental sexual and reproductive health care and sex education. We know just how important these services are for our patients, especially those with lower incomes,\u201d <\/span><a href=\"https:\/\/wpln.org\/post\/tennessees-abortion-ban-cost-it-7m-in-federal-funding-now-those-dollars-will-be-routed-to-planned-parenthood\/\"><span style=\"font-weight: 400;\">asserted<\/span><\/a><span style=\"font-weight: 400;\"> Planned Parenthood of TN when it received the funds in 2023.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Since 1970, Title X has authorized the Federal Government to make grants to states and private entities that offer family planning projects. Using the funding to provide actual abortions is restricted, but the federal government has regularly permitted counseling related to abortions.\u00a0 <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In its complaint, Tennessee argued that the \u201cspending power\u201d of the federal government should not infringe on its state sovereignty. But the <\/span><a href=\"https:\/\/www.opn.ca6.uscourts.gov\/opinions.pdf\/24a0199p-06.pdf\"><span style=\"font-weight: 400;\">Court ruled<\/span><\/a> <span style=\"font-weight: 400;\">that Tennessee could not \u201cdictate\u201d how eligibility would be determined for the federal grants.\u00a0 In particular, the court determined that while abortion may be illegal in Tennessee, providing information about the illegal services was not restricted by their law, and that federal funds should be used accordingly.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Attorney General Jonathan Skrmetti has previously accused the federal government of <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/tennessee-sues-hhs-title-x-planned-parenthood\/\"><span style=\"font-weight: 400;\">\u201cplaying politics\u201d<\/span><\/a><span style=\"font-weight: 400;\"> with the health of Tennessee women.
