{"id":314546,"date":"2024-06-26T12:42:46","date_gmt":"2024-06-26T17:42:46","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=314546"},"modified":"2024-06-25T21:01:14","modified_gmt":"2024-06-26T02:01:14","slug":"pro-life-laws-not-violate-establishment-clause","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/pro-life-laws-not-violate-establishment-clause\/","title":{"rendered":"Why pro-life laws do not violate the First Amendment&#8217;s Establishment Clause"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">On a <\/span><a href=\"https:\/\/www.msnbc.com\/andrea-mitchell-reports\/watch\/palmieri-reproductive-rights-under-assault-after-southern-baptists-opposition-of-ivf-212918341674\"><span style=\"font-weight: 400;\">recent episode<\/span><\/a><span style=\"font-weight: 400;\"> of MSNBC\u2019s \u201cAndrea Mitchell Reports,\u201d host Alex Witt suggested that pro-life laws violate the Establishment Clause of the First Amendment, saying:<\/span><\/p>\n<blockquote><p><i><span style=\"font-weight: 400;\">[T]here&#8217;s supposed to be separation of church and state in our system of government, a tenet of the First Amendment known as the Establishment Clause, which states, \u201cCongress shall make no law respecting the establishment of religion,\u201d but the issue of abortion makes you question if that&#8217;s the case.<\/span><\/i><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Her hypothesis betrays her ignorance of the philosophical and moral foundations of pro-life legal protections, and possibly her ignorance of the science regarding when new life begins, as well.<\/span><\/p>\n<p><b>Pro-life Laws (and Beliefs) Are Not Intrinsically Religious<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Though <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/women-suing-kentucky-religious-freedom-abortion-court\/\"><span style=\"font-weight: 400;\">many<\/span><\/a><span style=\"font-weight: 400;\"> abortion <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/indiana-judge-blocks-pro-life-religious-freedom\/\"><span style=\"font-weight: 400;\">advocates<\/span><\/a><span style=\"font-weight: 400;\"> have <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/judge-dismisses-lawsuit-missouri-religious-belief\/\"><span style=\"font-weight: 400;\">argued<\/span><\/a><span style=\"font-weight: 400;\"> that pro-life laws and\/or <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/un-special-rapporteur-opposition-abortion-religious-belief\/\"><span style=\"font-weight: 400;\">beliefs<\/span><\/a><span style=\"font-weight: 400;\"> are <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/uk-medical-journal-us-pro-life-repressive\/\"><span style=\"font-weight: 400;\">religious<\/span><\/a><span style=\"font-weight: 400;\"> by definition, this is not even remotely true.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Atheist <\/span><a href=\"https:\/\/secularprolife.org\/team\/\"><span style=\"font-weight: 400;\">Monica Snyder<\/span><\/a><span style=\"font-weight: 400;\">, executive director of Secular Pro Life, has <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/religious-oppose-abortion-human-rights\/\"><span style=\"font-weight: 400;\">stated<\/span><\/a><span style=\"font-weight: 400;\">: \u201cThe belief that abortion is wrong is not exclusive to the Bible \u2014 or to any one worldview, theistic, secular, or otherwise.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a Live Action <\/span><a href=\"https:\/\/youtu.be\/x1zQySlFSUM\"><span style=\"font-weight: 400;\">video<\/span><\/a><span style=\"font-weight: 400;\"> on this subject, Snyder points out that the central argument against abortion \u2013 which is founded upon logical reasoning \u2013 does not rely upon or refer to religion in any way. This argument, simply put, is: It\u2019s wrong to kill innocent human beings. Abortion kills innocent human beings; therefore, abortion is wrong.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/x1zQySlFSUM?si=2g5CY5ge_mcFb3Ya\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">Likewise, the conviction that killing innocent human beings is wrong is not inherently religious. Human civilizations all over the world and throughout history have <\/span><a href=\"https:\/\/droitromain.univ-grenoble-alpes.fr\/Anglica\/CJ9_Scott.gr.htm\"><span style=\"font-weight: 400;\">prohibited<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/factsanddetails.com\/world\/cat56\/sub363\/entry-6077.html\"><span style=\"font-weight: 400;\">punished<\/span><\/a><span style=\"font-weight: 400;\"> this practice.<\/span><\/p>\n<p><b>Science, Not Religion<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In order to kill something, it must first be alive. And some abortion advocates have insisted that abortion is not actually an act of killing by <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/indiana-judge-blocks-pro-life-religious-freedom\/\"><span style=\"font-weight: 400;\">arguing<\/span><\/a><span style=\"font-weight: 400;\"> that the \u201cbelief\u201d that life begins in the womb is religious in nature.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But this is not a \u201cbelief\u201d \u2013 it\u2019s a fact.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/archive.liveaction.org\/news\/unique-life-begins-fertilization-claims\/\"><span style=\"font-weight: 400;\">Scientific journals and textbooks<\/span><\/a><span style=\"font-weight: 400;\"> have long upheld the truth that a unique, living, individual organism is generated when gametes fuse, i.e., at fertilization.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But one need look no further than an ordinary dictionary to deduce that preborn children are living creatures. <\/span><a href=\"https:\/\/www.merriam-webster.com\/dictionary\/life\"><span style=\"font-weight: 400;\">Merriam-Webster<\/span><\/a><span style=\"font-weight: 400;\"> defines \u201clife\u201d as \u201can organismic state characterized by <\/span><b>capacity for metabolism, growth, reaction to stimuli, and reproduction<\/b><span style=\"font-weight: 400;\">\u201d (emphasis added).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Human beings in the womb <\/span><b><i>grow<\/i><\/b><span style=\"font-weight: 400;\"> rapidly by means of the <\/span><b><i>reproduction<\/i><\/b><span style=\"font-weight: 400;\"> (or duplication) of cells (known as <\/span><a href=\"https:\/\/medlineplus.gov\/genetics\/understanding\/howgeneswork\/cellsdivide\/\"><span style=\"font-weight: 400;\">mitosis<\/span><\/a><span style=\"font-weight: 400;\">), which is <\/span><a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC4825590\/\"><span style=\"font-weight: 400;\">powered by<\/span><\/a> <b><i>metabolic<\/i><\/b> <a href=\"https:\/\/www.khanacademy.org\/science\/ap-biology\/cellular-energetics\/cellular-energy\/a\/overview-of-metabolism\"><span style=\"font-weight: 400;\">processes<\/span><\/a><span style=\"font-weight: 400;\">. And the <\/span><a href=\"https:\/\/www.ehd.org\/prenatal-summary.php\"><span style=\"font-weight: 400;\">Endowment for Human Development<\/span><\/a><span style=\"font-weight: 400;\"> notes that preborn children <\/span><b><i>react to stimuli<\/i><\/b><span style=\"font-weight: 400;\"> \u2013 they respond to touch as early as 15 weeks post-fertilization, and to sounds by 22 weeks.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Clearly children in-utero meet all of the criteria defining \u201clife.\u201d They are indisputably alive, and abortion kills them. Belief in any particular religion is not required to recognize this reality \u2013 <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortionists-killing-babies-under-oath\/\"><span style=\"font-weight: 400;\">even<\/span><\/a> <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-workers-admit-we-know-we-are-taking-life\/\"><span style=\"font-weight: 400;\">abortionists<\/span><\/a> <a href=\"https:\/\/archive.liveaction.org\/news\/abortionist-admits-killing-baby-abortion\/\"><span style=\"font-weight: 400;\">admit<\/span><\/a> <a href=\"https:\/\/archive.liveaction.org\/news\/abortionist-admits-that-abortion-kills-preborn-children-we-are-the-executioners\/\"><span style=\"font-weight: 400;\">this<\/span><\/a> <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-violence-words-videos-inside-abortion-industry\/\"><span style=\"font-weight: 400;\">fact<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although most religions affirm that preborn children are alive and <\/span><a href=\"https:\/\/www.merriam-webster.com\/dictionary\/innocent\"><span style=\"font-weight: 400;\">innocent<\/span><\/a><span style=\"font-weight: 400;\">, and that it is therefore wrong to kill them, this does not mean that these are religious concepts. Religion didn\u2019t <em>create<\/em><\/span><span style=\"font-weight: 400;\"> these concepts. Rather, religion <em>embraced<\/em><\/span><span style=\"font-weight: 400;\"> these ideas \u2013 they are distinct realities, and various religions have simply recognized them.<\/span><\/p>\n<p><b>The Establishment Clause<\/b><\/p>\n<p><span style=\"font-weight: 400;\">But what about the Establishment Clause? What is it, and is it relevant to the discussion of pro-life laws?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The initial portion of the <\/span><a href=\"https:\/\/www.archives.gov\/founding-docs\/bill-of-rights-transcript#:~:text=Bill%20of%20Rights.%22-,Amendment%20I,for%20a%20redress%20of%20grievances.\"><span style=\"font-weight: 400;\">First Amendment<\/span><\/a><span style=\"font-weight: 400;\"> commonly referred to as the Establishment Clause states: \u201cCongress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof[.]\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the <\/span><a href=\"https:\/\/constitutioncenter.org\/the-constitution\/amendments\/amendment-i\/interpretations\/264\"><span style=\"font-weight: 400;\">National Constitution Center<\/span><\/a><span style=\"font-weight: 400;\">: \u201cAfter Independence, there was widespread agreement that there should be no nationally established church. The Establishment Clause of the First Amendment, principally authored by James Madison, reflects this consensus.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.freedomforum.org\/the-establishment-clause\/\"><span style=\"font-weight: 400;\">Freedom Forum<\/span><\/a><span style=\"font-weight: 400;\"> also states that the Establishment Clause \u201chas been interpreted by the U.S. Supreme Court to prevent government from either advancing (that is, establishing) or hindering religion[.]\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As previously stated, the fact that preborn children are alive, and that abortion kills them, is a matter of fact, not religious belief. Because pro-life laws are based upon these facts, they are not religious in nature. Therefore, the Establishment Clause does not prohibit the government from enforcing them \u2013 in fact, it is totally irrelevant to this issue.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alex Witt\u2019s argument, like so many others aimed at excusing and promoting the violence of abortion, has no basis in fact or reason.<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/actnow.io\/ARQQhk1\"><b><i>The DOJ put a pro-life grandmother in jail for protesting the killing of preborn children.
