{"id":311974,"date":"2024-05-08T16:39:38","date_gmt":"2024-05-08T21:39:38","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=311974"},"modified":"2024-09-20T12:45:34","modified_gmt":"2024-09-20T17:45:34","slug":"study-links-anti-abortion-laws-homicide-pregnant","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/study-links-anti-abortion-laws-homicide-pregnant\/","title":{"rendered":"Misleading study links &#8216;anti-abortion&#8217; laws to higher homicide rates for pregnant women"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">A recent <\/span><a href=\"https:\/\/www.healthaffairs.org\/doi\/10.1377\/hlthaff.2023.01098\"><span style=\"font-weight: 400;\">study<\/span><\/a><span style=\"font-weight: 400;\"> conducted by researchers affiliated with Tulane University and published by Health Affairs earlier this month titled \u201cStates\u2019 Abortion Laws Associated With Intimate Partner Violence-Related Homicide Of Women And Girls In The US, 2014\u201320\u201d claims that the enforcement of certain \u201canti-abortion\u201d laws is correlated with increased homicide rates for pregnant women and girls ages 10\u201344.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abortion advocates within the media are uncritically regurgitating the study\u2019s findings \u2013 and even expanding upon the conclusions drawn by the study itself. But the claims made in these articles, as well as those made by the study, are misleading and problematic in multiple ways.<\/span><\/p>\n<p><strong>Blaming &#8220;restrictive abortion laws&#8221; \u2014 before Dobbs \u2014 for violence<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">\u201cRestrictive abortion laws have caused a small but real climb in fatal violence committed against women,\u201d claims an <\/span><a href=\"https:\/\/gizmodo.com\/tough-abortion-laws-boost-murder-rates-girls-women-1851459068\"><span style=\"font-weight: 400;\">article<\/span><\/a><span style=\"font-weight: 400;\"> published on May 6 in Gizmodo. Similarly, an <\/span><a href=\"https:\/\/www.huffpost.com\/entry\/anti-abortion-laws-linked-to-increase-in-domestic-violence-deaths_n_663926fde4b00641c49638e5\"><span style=\"font-weight: 400;\">article<\/span><\/a><span style=\"font-weight: 400;\"> appearing the same day on HuffPost opens by stating: \u201cAnti-abortion laws increase the likelihood that pregnant victims of domestic violence will be murdered by their abusive partner[.]\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The articles in Gizmodo and HuffPost both wrongly claim that there is a <\/span><i><span style=\"font-weight: 400;\">causal<\/span><\/i><span style=\"font-weight: 400;\"> relationship between what they describe as \u201canti-abortion laws\u201d and increased homicide rates for pregnant women within states that have such laws. But even the study itself is careful <em>not<\/em> to make that specific claim. Instead, it says that laws restricting abortion are \u201cassociated with\u201d increased incidences of \u00a0homicide against pregnant women, and that enforcing a greater number of these laws \u201cmay increase the[] risk\u201d of violence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even that claim, however, is tenuous. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Note that the period covered by the study is <strong>2014-2020<\/strong> \u2013 <\/span><i><span style=\"font-weight: 400;\">before<\/span><\/i><span style=\"font-weight: 400;\"> the <\/span><i><span style=\"font-weight: 400;\">Dobbs v. Jackson Women\u2019s Health Organization<\/span><\/i> <span style=\"font-weight: 400;\">Supreme Court decision which overturned <\/span><i><span style=\"font-weight: 400;\">Roe v. Wade<\/span><\/i><span style=\"font-weight: 400;\">. During that period, meaningful laws designed to significantly restrict abortion were not legally enforceable.\u00a0<\/span><\/p>\n<p><strong>The &#8220;restrictive abortion laws&#8221; referenced in the study don&#8217;t restrict abortions<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">In fact, the laws addressed by this study are so-called \u201cTargeted Regulation of Abortion Provider\u201d laws, commonly referred to as TRAP laws. The study defines these as \u201cregulations regarding structural standards comparable to those for ambulatory surgical centers, specified procedure room size, specified corridor width, a transfer agreement between the facility and a local hospital, and admitting privileges for the clinician at a local hospital.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In other words, these are laws which regulate various structural and operational details for abortionists and the facilities in which they work \u2013 they <\/span><i><span style=\"font-weight: 400;\">do not<\/span><\/i><span style=\"font-weight: 400;\"> regulate or restrict abortion itself.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This study claims that so-called TRAP laws \u201cgo beyond what is necessary to ensure patient safety,\u201d but this is provably untrue. In fact, these laws are designed to protect the lives and health of abortion customers and do not impose atypical standards upon abortion facilities. Rather, they are designed to force abortion facilities to conform to the <em>same common-sense safety standards<\/em> by which legitimate medical facilities must abide.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Often, abortion advocates <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortion-industry-regulations-woman\/\"><span style=\"font-weight: 400;\">argue<\/span><\/a><span style=\"font-weight: 400;\"> that abortion facilities should be <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/illinois-refuses-lift-regulations-abortion\/\"><span style=\"font-weight: 400;\">exempted<\/span><\/a><span style=\"font-weight: 400;\"> from minimum safety <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortion-industry-health-care-rejecting-regulations\/\"><span style=\"font-weight: 400;\">regulations<\/span><\/a><span style=\"font-weight: 400;\">. However, there are <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortion-industry-health-care-rejecting-regulations\/\"><span style=\"font-weight: 400;\">countless<\/span><\/a> <a href=\"https:\/\/archive.liveaction.org\/news\/north-carolina-planned-parenthood-emergency\/\"><span style=\"font-weight: 400;\">examples<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/woman-injured-ohio-abortion-facility-defective-elevator\/\"><span style=\"font-weight: 400;\">injuries<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/lakisha-wilsons-abortion-death-preventable\/\"><span style=\"font-weight: 400;\">deaths<\/span><\/a><span style=\"font-weight: 400;\"> that can, and do, <\/span><a href=\"https:\/\/www.operationrescue.org\/archives\/39-years-after-roe-v-wade-no-gurney-access-endangers-two-injured-abortion-patients-in-alabama\/\"><span style=\"font-weight: 400;\">occur<\/span><\/a><span style=\"font-weight: 400;\"> when abortion <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/26-months-ny-planned-parenthood-15-emergencies\/\"><span style=\"font-weight: 400;\">facilities<\/span><\/a><span style=\"font-weight: 400;\"> are allowed to <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/nyc-planned-parenthood-paramedics-gurney\/\"><span style=\"font-weight: 400;\">skirt<\/span><\/a><span style=\"font-weight: 400;\"> common-sense regulations \u2014 including the specific regulations named by this study, like hallway width. There are occasions in which an abortion facility&#8217;s broken elevator or too-narrow hallway has impeded emergency care at abortion facilities, putting women&#8217;s lives at serious risk.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cTRAP laws have been shown to reduce abortion by forcing the closure of clinics that provide abortions,\u201d the study claims, adding, \u201cWomen without the means to travel longer distances to obtain a wanted abortion\u2026 may be forced to continue a pregnancy and experience fatal violence as a result.\u201d The authors then go on to advocate for \u201cthe removal of political\u2026 barriers to accessing health care and services that may save [abortion customers\u2019] lives.\u201d\u00a0<\/span><\/p>\n<p><strong>Pro-abortion logic: Protecting women puts them in greater danger<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">The study authors are asserting that we shouldn\u2019t enact or enforce laws which attempt to protect women from injury and\/or death in abortion facilities, because these women may be more likely to subsequently be harmed or killed by someone else. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In essence, the authors are arguing that protecting women puts them in greater danger.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Study authors also implicitly contend that, in order to prevent the homicides of one innocent party (mothers), we should perpetrate homicide against <em>another<\/em> innocent party (preborn babies).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Like most pro-abortion reasoning, both of these arguments fall apart under scrutiny. Not only are they completely nonsensical, they are also blatantly <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/fact-check-pbs-abortion-reduces-domestic-violence\/\"><span style=\"font-weight: 400;\">immoral<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/actnow.io\/ARQQhk1\"><b><i>The DOJ put a pro-life grandmother in jail for protesting the killing of preborn children.
