{"id":310946,"date":"2024-04-23T16:41:03","date_gmt":"2024-04-23T21:41:03","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=310946"},"modified":"2024-04-23T09:02:01","modified_gmt":"2024-04-23T14:02:01","slug":"survey-respondents-oppose-scotland-buffer-zone","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/survey-respondents-oppose-scotland-buffer-zone\/","title":{"rendered":"More than 70% of survey respondents oppose Scottish buffer zones"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>(<a href=\"https:\/\/righttolife.org.uk\/news\/77-of-respondents-to-consultation-oppose-introducing-worlds-most-extreme-abortion-buffer-zone-law-to-scotland\" target=\"_blank\" rel=\"noopener\">Right to Life UK<\/a>) Results of a Scottish Parliament <a class=\"__mPS2id\" href=\"https:\/\/www.parliament.scot\/bills-and-laws\/bills\/abortion-services-safe-access-zones-scotland-bill\/stage-1#CommitteeWork\" target=\"_blank\" rel=\"noopener\">consultation<\/a>\u00a0on Gillian Mackay MSP\u2019s buffer zone Bill show that 77% of respondents to the consultation are opposed to introducing buffer zones in Scotland.<\/p>\n<p>Released [on April 22], the results of the public consultation on the <a href=\"https:\/\/www.parliament.scot\/-\/media\/files\/legislation\/bills\/s6-bills\/abortion-services-safe-access-zones-scotland-bill\/introduced\/bill-as-introduced.pdf\" target=\"_blank\" rel=\"noopener\">Abortion Services (Safe Access Zones) (Scotland) Bill<\/a>\u00a0reveal strong opposition to plans to introduce buffer zones around abortion clinics in Scotland. The Bill was introduced in October 2023 and is currently progressing through the Scottish Parliament.<\/p>\n<p>Out of the 5,856 responses to the question \u2018Do you agree with the overall purpose of this Bill?\u2019, 4,517 (77.13%) disagreed, 1,288 (21.99%) agreed, 40 (0.68%) partially agreed and 11 (0.19%) responded \u2018don\u2019t know\u2019. (Full calculations and sources for these figures are available\u00a0<a href=\"https:\/\/righttolife.org.uk\/scotland-buffer-zone-consultation-results\">here<\/a>).<\/p>\n<p>Summaries of the responses to the proposed legislation were also released that present some of the specific reasons why respondents were so opposed to the Bill. Some respondents said buffer zones would prevent some women from being offered the help they need.<\/p>\n<p>One person\u00a0<a class=\"__mPS2id\" href=\"https:\/\/www.parliament.scot\/-\/media\/files\/committees\/health-social-care-and-sport-committee\/saz-detailed-cfv-evidence-summary.pdf#page=13\" target=\"_blank\" rel=\"noopener\">said<\/a>: \u201cI worry that these buffer zones will prevent women who are unsure of their decision on abortion to explore options many peaceful volunteers seek to educate women on. This is so they can make a more informed decision about their pregnancy. This is important to me personally as two of my friends felt forced into abortion by their baby\u2019s father and later suffered mentally as a result. If they had had a volunteer to educate them more on the options available, I believe they may have chosen differently and not have to live forever with the regret of their abortions\u201d.<\/p>\n<p>Another respondent who had accessed an abortion and expressed her opposition to the Bill\u00a0<a class=\"__mPS2id\" href=\"https:\/\/www.parliament.scot\/-\/media\/files\/committees\/health-social-care-and-sport-committee\/saz-detailed-cfv-evidence-summary.pdf#page=13\" target=\"_blank\" rel=\"noopener\">said<\/a>: \u201cI wish someone had been there to offer me help and advice before I had an abortion. It was the biggest mistake of my life\u201d.<\/p>\n<p>Other respondents\u00a0<a class=\"__mPS2id\" href=\"https:\/\/www.parliament.scot\/-\/media\/files\/committees\/health-social-care-and-sport-committee\/saz-detailed-cfv-evidence-summary.pdf#page=21\" target=\"_blank\" rel=\"noopener\">pointed<\/a>\u00a0to the fact that the Bill creates unnecessary legislation because \u201c\u2026 there are laws against harassment and, used properly, these are sufficient to protect everyone in a fair way\u201d.<\/p>\n<p>Some respondents noted that Police Scotland had not called for new powers in order to be able to deal with vigils offering help to women outside abortion clinics. The consultation response summary notes that this \u201cwas confirmed by Police Scotland\u2019s submission, which stated that they considered existing legal powers to be sufficient\u201d.<\/p>\n<p>Many individuals\u00a0<a class=\"__mPS2id\" href=\"https:\/\/www.parliament.scot\/-\/media\/files\/committees\/health-social-care-and-sport-committee\/saz-detailed-cfv-evidence-summary.pdf#page=14\" target=\"_blank\" rel=\"noopener\">described<\/a>\u00a0the legislation as \u201cdraconian\u201d with one individual saying \u201cAre we seriously going to criminalise and convict grannies praying?\u201d.<\/p>\n<p><strong>The most extreme abortion buffer zone legislation in the world<\/strong><\/p>\n<p><a href=\"https:\/\/righttolife.org.uk\/wp-content\/uploads\/2023\/10\/Savanta-Comres-Poll-Buffer-Zones.pdf\">Polling from Savanta ComRes shows<\/a>\u00a0that only 30% of the population in Scotland support the introduction of nationwide buffer zones around abortion clinics.<\/p>\n<p>The poll assessed support for buffer zones of 150 metres, as will be introduced in England and Wales, so it is likely that support would be even lower for the Mackay buffer zone Bill given the proposed law in Scotland would introduce a more extreme 200m buffer zone.<\/p>\n<p>Despite overwhelming opposition to the Bill from respondents to the consultation, and polling that shows that only a small percentage of the population in Scotland supports the introduction of nationwide buffer zones, the Health, Social Care, and Sport Committee has\u00a0<a href=\"https:\/\/bprcdn.parliament.scot\/published\/HSCS\/2024\/4\/22\/73825841-ef4e-4dea-9f76-667bd74dc69a\/HSCSS062024R06.pdf\" target=\"_blank\" rel=\"noopener\">agreed<\/a>\u00a0to the overall principles of the Bill, and has recommended the Scottish Parliament do the same.<\/p>\n<p>If the Bill becomes law, it will introduce the world\u2019s most extreme buffer zone law in Scotland.<\/p>\n<p>The Bill proposes an extreme law change in Scotland that would create a minimum of 200m \u2018safe access\u2019, or buffer, zones around any facility that performs abortions where offering support to women would be criminalised. The 200m is a minimum, as abortion providers can apply for the zone to be extended, with the Bill giving the Scottish Government the power to extend any buffer zone beyond the 200m if they judge that the existing zone \u201cdoes not adequately protect\u201d women seeking an abortion. There is no limit on the size of the buffer zone that can be created under this power.<\/p>\n<p>The minimum size of the buffer zones introduced by this law extends further than the minimum size of any other buffer zones in the world. For example, the\u00a0<a class=\"__mPS2id\" href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2023\/15\/enacted#:~:text=of%20abortion%20services-,9,Offence%20of%20interference%20with%20access%20to%20or%20provision%20of%20abortion%20services,-(1)\" target=\"_blank\" rel=\"noopener\">Public Order Act 2023<\/a>\u00a0in England and Wales sets the limits of the buffer zones at 150m and the legislation does not give the Government the power to extend buffer zones beyond 150m. Most buffer zones in Northern Ireland are\u00a0<a href=\"https:\/\/www.health-ni.gov.uk\/sites\/default\/files\/publications\/health\/doh-saz-comms.xlsx\" target=\"_blank\" rel=\"noopener\">100m<\/a>, half the size of what is being proposed in Scotland.<\/p>\n<p>Within these zones, it will be illegal to influence a person in regard to their decision \u201cto access\u2026 the provision of abortion\u201d in an abortion clinic or a hospital. These provisions would make offers of help to women seeking an abortion illegal within a buffer zone, and could criminalise silent prayer.<\/p>\n<p>Anyone who commits an offence can be fined up to \u00a310,000 on a\u00a0<a href=\"https:\/\/www.parliament.scot\/-\/media\/files\/legislation\/bills\/s6-bills\/abortion-services-safe-access-zones-scotland-bill\/introduced\/explanatory-notes-accessible.pdf\" target=\"_blank\" rel=\"noopener\">summary conviction<\/a>, or an unlimited fine on indictment.<\/p>\n<p>The\u00a0<a class=\"__mPS2id\" href=\"https:\/\/www.parliament.scot\/-\/media\/files\/legislation\/bills\/s6-bills\/abortion-services-safe-access-zones-scotland-bill\/introduced\/explanatory-notes-accessible.pdf#page=5\" target=\"_blank\" rel=\"noopener\">provisions<\/a>\u00a0of the Bill apply to anything that is \u201cvisible or audible\u201d within a buffer zone, even if these relate to private buildings. This means it may be illegal for pro-life signs to be displayed from a window within a private home or outside a place of worship if the signs are within the boundaries of or visible to a buffer zone. Similarly, conversations in private homes or outside churches may be included if they are audible inside a buffer zone. Referring to private dwellings, Mackay herself\u00a0<a class=\"__mPS2id\" href=\"https:\/\/bprcdn.parliament.scot\/published\/HSCS\/2024\/4\/22\/73825841-ef4e-4dea-9f76-667bd74dc69a\/HSCSS062024R06.pdf#page=65\" target=\"_blank\" rel=\"noopener\">told the Committee<\/a>\u00a0\u201cit is essential that such premises are covered by the legislation\u201d.<\/p>\n<p>Spokesperson for Right To Life UK, Catherine Robinson, said \u201cThe results of this consultation show that the vast majority of the respondents oppose the introduction of buffer zones in Scotland\u201d.<\/p>\n<p>\u201c<a href=\"https:\/\/righttolife.org.uk\/wp-content\/uploads\/2023\/10\/Savanta-Comres-Poll-Buffer-Zones.pdf\">Polling<\/a>\u00a0from Savanta ComRes shows that only 30% of the population in Scotland support the introduction of nationwide buffer zones around abortion clinics\u201d.<\/p>\n<p>\u201cDespite overwhelming opposition to the Bill from respondents to the consultation, and polling that shows that only a small percentage of the population in Scotland support the introduction of nationwide buffer zones, the Health, Social Care, and Sport Committee has unanimously agreed to the overall principles of the Bill\u201d.<\/p>\n<p>\u201cThis Committee has totally ignored the overwhelming opposition to this Bill and instead is supporting the introduction of the world\u2019s most extreme buffer zone law in Scotland\u201d.<\/p>\n<p>\u201cThis legislation goes further than any buffer zone legislation in other jurisdictions, creating a larger buffer zone than anywhere else in the world and giving the Scottish Government powers to extend these zones without limit\u201d.<\/p>\n<p>\u201cMany women have been helped outside abortion clinics by pro-life volunteers who have provided them with practical support, which made it clear to them that they had another option other than going through with the abortion\u201d.<\/p>\n<p>\u201cThe proposed law change would mean that the vital practical support provided by volunteers outside abortion clinics will be removed for women and many more lives would likely be lost to abortion\u201d.<\/p>\n<p>\u201cThis is a truly draconian piece of legislation that reaches into the homes of ordinary people. It creates an offence for being publicly pro-life. It is direct viewpoint discrimination\u201d.<\/p>\n<p>\u201cNo one else is penalised for hanging the flag of their favourite football team from their window, or having a \u2018Vote Labour\u2019 sign, but if an individual or a church wants to display a sign, from within their own property, which says \u2018Pregnant? We can help\u2019, they may be guilty of violating this buffer zone legislation\u201d.<\/p>\n<p>\u201cThis legislation is not only a direct attack on free expression and public association based on viewpoint, it is entirely unnecessary insofar as harassment and intimidation are already illegal.
