Now, the government is looking to\u00a0amend the current legislation to soften penalties for medical providers who fail to follow the legal requirements and safeguards for euthanizing patients.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Up until now, the penalty for disregarding proper procedure in MAiD (medical assistance in dying) \u2014 whether considered to be a \u201cminor\u201d or \u201cmajor\u201d offense \u2014 has been a charge of murder by poisoning, which carries a life sentence in prison. According to <\/span><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.genethique.org\/euthanasie-en-belgique-la-chambre-adopte-le-systeme-de-sanctions-graduel\/\">Genethics<\/a> (translated from French)<\/span><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><em><span style=\"font-weight: 400;\">The new law provides for a sentence of 10 to 15 years in prison in case of violation of the \u2018basic\u2019 conditions required in the context of the use of euthanasia, and a penalty of 8 days to 3 years in case of violation of \u2018procedural\u2019 conditions such as consultation with a second doctor or, if necessary, a child psychiatrist. Other violations will no longer be considered criminal offences.<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">This controversial <\/span><a href=\"https:\/\/www.thelancet.com\/pdfs\/journals\/lanepe\/PIIS2666-7762(22)00245-9.pdf\"><span style=\"font-weight: 400;\">shift<\/span><\/a><span style=\"font-weight: 400;\"> started after <\/span><a href=\"https:\/\/www.bbc.com\/news\/world-europe-51322781\"><span style=\"font-weight: 400;\">the 2020 case <\/span><\/a><span style=\"font-weight: 400;\">regarding the death of Tine Nys, a 38-year-old Belgian woman with a history of mental illness and various traumas including abortion in her lifetime. <\/span><span style=\"font-weight: 400;\">Nys\u2019s sisters claimed that the doctors involved failed to follow the legal guidelines and should not have allowed their sister to choose death by means of MAiD. However, the jury and courts acquitted the doctors even though evidence showed the psychiatrist involved did not fairly judge Nys\u2019s condition and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/belgium-euthanasia-record-high\/\"><span style=\"font-weight: 400;\">lied about an autism diagnosis<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another instance showing the same questionable medical judgment was <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/european-court-belgium-violated-human-rights-euthanasia\/\"><span style=\"font-weight: 400;\">the death of Tom Mortier\u2019s mother, Godelieva de Troyer<\/span><\/a><span style=\"font-weight: 400;\">. Mortier wasn\u2019t made aware of his mother\u2019s impending MAiD death until <em>after she had already died<\/em>. Godelieva had a history of chronic severe depression. Instead of trying to reconnect her with mental health resources or contact her family, her psychiatrist decided she was a good candidate for MAiD. In late 2022, the European Court of Human Rights <a href=\"https:\/\/adflegal.org\/article\/european-court-human-rights-belgium-violated-right-life-euthanasia-case\">finally acknowledged<\/a> that Mortier&#8217;s mother&#8217;s right to life had been violated. &#8220;While the court did not strike down the Belgian euthanasia law, it did find that the Belgian system for ensuring compliance with the law &#8216;lacked independence&#8217; and therefore violated the right to life, protected under Article 2 of the European Convention on Human Rights,&#8221; noted Alliance Defending Freedom.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Live Action News recently reported that deaths by MAiD in Belgium alone <a href=\"https:\/\/archive.liveaction.org\/news\/belgium-euthanasia-record-high\/\">rose 15%<\/a> from 2022 to 2023, equating to 3,423 people killed by such methods in the country in just <a href=\"https:\/\/www.vrt.be\/vrtnws\/en\/2024\/02\/27\/euthanasia-cases-increase-by-15-per-cent-in-belgium-in-2023\/\">one year<\/a>. Despite this, <\/span>BioEdge <a href=\"https:\/\/bioedge.org\/end-of-life-issues\/euthanasia\/belgian-softens-penalties-for-illegal-euthanasia-deaths\/\">notes<\/a> that &#8220;Some Belgian doctors welcomed the changes&#8221; to amend the law:<\/p>\n<p style=\"padding-left: 40px;\"><em>Dr Luc Herry, of the ABYSM doctors union, said that the current system was inadequate. \u201cIf a doctor forgot some aspect of the procedure, but the patient had actually made a request for euthanasia, a family member might still file a complaint.
