{"id":309347,"date":"2024-03-26T16:00:12","date_gmt":"2024-03-26T21:00:12","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=309347"},"modified":"2024-03-31T22:14:45","modified_gmt":"2024-04-01T03:14:45","slug":"four-shocking-admissions-supreme-court-abortion-pill","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/four-shocking-admissions-supreme-court-abortion-pill\/","title":{"rendered":"Four shocking admissions from the US Supreme Court abortion pill case oral arguments"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>The United States Supreme Court finalized hearing oral <a href=\"https:\/\/www.youtube.com\/watch?v=3gAHaGpADvk\" target=\"_blank\" rel=\"noopener\">arguments<\/a> on March 26 in the <em>Alliance for Hippocratic Medicine (AHM) v. Food and Drug Administration (FDA), <\/em>a lawsuit which <a href=\"https:\/\/archive.liveaction.org\/news\/separating-fact-fiction-supreme-court-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">challenged<\/a> the legitimacy of FDA&#8217;s recent expansions of the abortion pill, likely the most important case since the <em>Dobbs v. Jackson<\/em> case which overturned <em>Roe v. Wade<\/em>.<\/p>\n<p>During oral arguments, Elizabeth Prelogar, Solicitor General representing the FDA, argued that respondents \u2014 a group of pro-life medical professionals \u2014 lacked standing to bring the lawsuit, claiming the medical professionals were promoting &#8220;judicial second guessing.&#8221;<\/p>\n<div id=\"attachment_309349\" style=\"width: 506px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-309349\" decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-309349\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/03\/US-SUpreme-Court-hears-abortion-pill-case-FDA-v-AHM-March-26-2024.jpg\" alt=\"US Supreme Court hears abortion pill case FDA v AHM March 26, 2024\" width=\"496\" height=\"283\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/03\/US-SUpreme-Court-hears-abortion-pill-case-FDA-v-AHM-March-26-2024.jpg 496w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/03\/US-SUpreme-Court-hears-abortion-pill-case-FDA-v-AHM-March-26-2024-300x171.jpg 300w\" sizes=\"(max-width: 496px) 100vw, 496px\" \/><p id=\"caption-attachment-309349\" class=\"wp-caption-text\">US Supreme Court hears abortion pill case FDA v AHM March 26, 2024<\/p><\/div>\n<p><strong>Do pro-life doctors have standing?<\/strong><\/p>\n<p>AHM&#8217;s standing in the case was a predominant issue throughout the hearing. Yet, as Live Action News <a href=\"https:\/\/archive.liveaction.org\/news\/plaintiffs-supreme-court-abortion-pill-fda-jeopardizing\/\" target=\"_blank\" rel=\"noopener\">previously documented<\/a>, the Fifth Circuit previously held that Respondent doctors and associations <em>do<\/em> have standing to file suit.<\/p>\n<p>Another issue heavily argued was whether conscience protections applied to the Respondent pro-life doctors. This line of questioning seemed to intrigue several of the justices, many of whom inquired whether federal conscience protections would have sufficed, rather than \u2014 as Justice Ketanji Brown Jackson alluded \u2014 everyone being impacted by returning to pre-2016 FDA safety requirements for accessing the drug.<\/p>\n<p>Those requirements would roll the gestational limits back from 10 weeks to seven weeks and eliminate mail-order and pharmacy dispensing of the drug by reinstating in-person requirements. It would also once again require prescribers of the drug to report non-fatal adverse events.<\/p>\n<p>The FDA claimed that the Emergency Medical Treatment and Labor Act (<a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-federal-law-er-abortion\/\">EMTALA<\/a>) would protect conscience rights \u2014 but Alliance Defending Freedom (ADF) attorney Erin Hawley, representing the pro-life doctors in the case, seemed to dispute that claim.<\/p>\n<p>Hawley pointed to two specific clients, Dr. Christina Frances and Dr. Ingrid Skop, who testified to treating women in the emergency room who were suffering from incomplete abortions.<\/p>\n<p>&#8220;These are emergency situations. One of those was the University of California, a pro-abortion institution\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-money-trail-abortion-pill-corruption\/\" target=\"_blank\" rel=\"noopener\">heavily tied<\/a>\u00a0to abortion pill investors.<\/p>\n<h3><strong>SHOCK #1: FDA claimed to have &#8220;sovereign immunity&#8221; from lawsuits<\/strong><\/h3>\n<p>&#8220;Is there anybody who could challenge in court the lawfulness of what the FDA did here?&#8221; Justice Samuel Alito asked the FDA&#8217;s attorney.<\/p>\n<p>&#8220;In this particular case, I think the answer is no,&#8221; Prelogar stated.<\/p>\n<p>Justice Alito reiterated, asking the FDA whether states can intervene, and again, Prelogar said &#8220;No, the states lack standing.&#8221;<\/p>\n<p>&#8220;Okay, how about a doctor who opposes abortion. So, she&#8217;s on duty in an emergency room when a woman comes in with complication from having taken Mifepristone and&#8230; in order to save her life the doctor has to abort a viable fetus,&#8221; Alito asked. &#8220;Would that doctor have standing to seek injunctive relief?&#8221;<\/p>\n<p>FDA responded by not &#8220;disputing&#8221; that it would violate conscience protections, and claimed the scenario was &#8220;unduly speculative.&#8221;<\/p>\n<p>&#8220;Now, how about a woman who suffers adverse consequences from taking mifepristone. Would she be able to sue for damages?&#8221; Justice Alito asked.<\/p>\n<p>&#8220;I expect that we would have sovereign immunity arguments in that case,&#8221; FDA asked.<\/p>\n<p>&#8220;Is there anybody who can sue&#8230; shouldn&#8217;t somebody be able to challenge that in court? Who, in your view?&#8221; Alito asked.<\/p>\n<p>The FDA again said no. &#8220;I think that with respect to these regulatory changes, it&#8217;s hard to identify anybody that would have standing to sue,&#8221; Prelogar told the Court.<\/p>\n<p>&#8220;So, your argument is that it doesn&#8217;t matter if FDA flagrantly violated the law, didn&#8217;t do what it should have done, endangered the health of women, it&#8217;s just too bad &#8211; nobody can sue them in court?&#8221; Alito asked.\u00a0 &#8220;There&#8217;s no remedy, the American people have no remedy for that?&#8221;<\/p>\n<p>In response, the FDA invoked article 111 and reiterated that the respondents had no standing.<\/p>\n<h3><strong>SHOCK #2: FDA portrays tens of thousands of abortion pill ER visits as small<\/strong><\/h3>\n<p>Arguments by the FDA suggested that only a small number of women will present to emergency rooms after taking the abortion pill, but in her arguments before the Supreme Court, ADF attorney Erin Hawley repeatedly <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/AHM-OpeningBrief.pdf\" target=\"_blank\" rel=\"noopener\">cited<\/a> published percentages for ER visits on the drug\u2019s\u00a0<a href=\"https:\/\/www.accessdata.fda.gov\/drugsatfda_docs\/label\/2023\/020687Orig1s026lbl.pdf\" target=\"_blank\" rel=\"noopener\">2023 label<\/a>\u00a0which state that \u201c2.9 to 4.6 percent of women who take abortion drugs end up in the emergency room.\u201d<\/p>\n<p>This, Hawley claimed, likely resulted in an <a href=\"https:\/\/archive.liveaction.org\/news\/separating-fact-fiction-supreme-court-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">estimated<\/a>\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/emergency-room-visits-abortion-pill-tens-thouands\/\" target=\"_blank\" rel=\"noopener\">tens of thousands<\/a> of women, \u201croughly one in 25 women\u201d <a href=\"https:\/\/archive.liveaction.org\/news\/plaintiffs-supreme-court-abortion-pill-fda-jeopardizing\/\" target=\"_blank\" rel=\"noopener\">AHM<\/a>\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/emergency-room-visits-abortion-pill-tens-thouands\/\" target=\"_blank\" rel=\"noopener\">claimed<\/a> before the High Court as well as in their <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/AHM-OpeningBrief.pdf\" target=\"_blank\" rel=\"noopener\">brief<\/a>.<\/p>\n<p>In 2023 <em>alone<\/em>, this would be potentially between 19,000 (18,638) and 30,000 (29,564) women.<\/p>\n<div id=\"attachment_307576\" style=\"width: 764px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-307576\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-307576\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/02\/Mifepristone-Jan-2023-label-shows-percentage-of-women-taking-abortion-pill-visit-ER.jpg\" alt=\"Mifepristone Jan 2023 label shows percentage of women taking abortion pill visit Emergency room (ER)\" width=\"754\" height=\"916\" aria-describedby=\"caption-attachment-307576\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/02\/Mifepristone-Jan-2023-label-shows-percentage-of-women-taking-abortion-pill-visit-ER.jpg 959w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/02\/Mifepristone-Jan-2023-label-shows-percentage-of-women-taking-abortion-pill-visit-ER-247x300.jpg 247w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/02\/Mifepristone-Jan-2023-label-shows-percentage-of-women-taking-abortion-pill-visit-ER-576x700.jpg 576w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/02\/Mifepristone-Jan-2023-label-shows-percentage-of-women-taking-abortion-pill-visit-ER-768x933.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2024\/02\/Mifepristone-Jan-2023-label-shows-percentage-of-women-taking-abortion-pill-visit-ER-500x607.jpg 500w\" sizes=\"(max-width: 754px) 100vw, 754px\" \/><p id=\"caption-attachment-307576\" class=\"wp-caption-text\">Mifepristone Jan 2023 label shows percentage of women taking abortion pill visit ER<\/p><\/div>\n<h3><strong>SHOCK #3: Abortion pill manufacturer says restricting sales will &#8216;injure&#8217; their business<\/strong><\/h3>\n<p>Justice Clarence Thomas grilled Danco attorney Jessica Ellsworth on why the FDA did not take into account the Comstock Act, a federal law which prohibits the mailing of abortion-inducing drugs.<\/p>\n<p>&#8220;How do you respond to an argument that mailing your product and advertising it would violate the Comstock Act?&#8221; Justice Thomas asked the abortion pill maker&#8217;s attorney.<\/p>\n<p>Ellsworth dodged the question, <span style=\"color: #000000;\">warning Justice Thomas that challenging the FDA could &#8220;invit[e] mischief&#8221; and that the Court should &#8220;think hard&#8221; about that.<\/span><\/p>\n<p>&#8220;My problem is, you&#8217;re private,&#8221; Thomas stated, claiming that private entities are not subject to a &#8220;safe harbor&#8221; against federal laws, he alleged.<\/p>\n<p>Justice Alito then grilled Ellsworth, pressing into the profit motive, asking whether mifepristone was the &#8220;only product&#8221; that Danco is &#8220;currently marketing.&#8221; Alito also reiterated that the lower court&#8217;s ruling would not prohibit Danco from selling mifepristone.<\/p>\n<p>&#8220;So, I gather your injury is that you think you are going to sell more if the restrictions that previously were in place were lifted,&#8221; with zero evidence<\/strong><\/h3>\n<p>&#8220;Do you think the FDA is infallible?&#8221; Alito asked Danco&#8217;s attorney.<\/p>\n<p>&#8220;No, your honor,&#8221; Ellsworth said in response.<\/p>\n<p>&#8220;Has the FDA ever approved a drug and then pulled it after experience showed that had a lot of really serious adverse consequences?&#8221; asked Alito of Danco&#8217;s counsel.<\/p>\n<p>&#8220;It has certainly done that,&#8221; she responded, pointing to the adverse events reporting under the REMS.<\/p>\n<p>But Alito wasn&#8217;t taking that argument. He then asked,&#8221;But don&#8217;t you think the FDA should have continued to require reporting of non-fatal consequences?&#8221;<\/p>\n<p>In 2016, the FDA <strong>removed<\/strong> the requirement that all adverse events be reported, only requiring reporting of related <strong>deaths<\/strong>.<\/p>\n<p>In response, Ellsworth claimed that despite the FDA&#8217;s change in 2016, Danco still gathered that information.
