It\u2019s a sad testament to the state of our culture that the <i>Times<\/i> has managed to hold onto its prestigious nickname as America\u2019s \u201cpaper of record\u201d despite being an <a href=\"http:\/\/www.mrc.org\/articles\/ny-times\">unscrupulous mouthpiece for the left<\/a>. The editorial board\u2019s <a href=\"http:\/\/www.nytimes.com\/2013\/03\/30\/opinion\/the-campaign-to-outlaw-abortion.html?_r=0\">Friday piece<\/a> bemoaning a \u201cshocking new low\u201d in Republicans\u2019 state-level pro-life efforts &#8211; sorry, in lib-speak that reads, \u201cattack on women\u2019s reproductive health and freedom\u201d &#8211; is a perfect example of how the <i>Times<\/i> has dropped all pretense of analytical rigor in favor of ideological propaganda.<\/p>\n<p>According to the <i>Times<\/i>, North Dakota\u2019s governor and lawmakers \u201cmust know perfectly well\u201d that the <a href=\"\/news\/north-dakota-senate-passes-legislation-protecting-preborn-with-heartbeat-down-syndrome\/\">fetal heartbeat protection law they just enacted<\/a> is \u201cunconstitutional by any reading of the 1973 Roe v. Wade decision and others since\u201d&#8230;\u201cbrazenly unconstitutional,\u201d in fact.<\/p>\n<p>Now, far be it from me to question the enlightened, educated judgment of the <i>Times<\/i>, but shouldn\u2019t assessing a law\u2019s constitutionality entail reading, er, the Constitution? To proclaim its illegitimacy with such sweeping certainty requires citing a source somewhat more credible than a ruling that <a href=\"http:\/\/washingtonexaminer.com\/article\/1080661\">even pro-choice scholars often admit<\/a> is substantively bankrupt.<\/p>\n<p><i>Roe<\/i> is <a href=\"\/news\/the-case-against-roe-v-wade-and-planned-parenthood-v-casey\/\">based on<\/a> claims about the scope of privacy the Constitution doesn\u2019t make, misrepresenting the history of abortion restrictions in the United States, baldly asserting that the Fourteenth Amendment doesn\u2019t cover the unborn even though its own author <a href=\"http:\/\/rightcal.blogspot.com\/2011\/07\/is-abortion-already-illegal.html\">said<\/a> it applied to \u201cany human being,\u201d and punting on the central \u201cquestion of when life begins.\u201d But it\u2019s North Dakota who\u2019s \u201cbrazenly\u201d flouting the Constitution?<\/p>\n<p>Next come the contradictions. The <i>Times<\/i> begins the next paragraph by predicting that the law \u201cstands little chance of surviving a court challenge\u201d in one breath, yet closes it by warning that the Supreme Court is \u201cconservative-dominated.\u201d Well, which is it? Is the law so laughable that nobody will uphold it, or is it dangerous because it\u2019ll stand? I suppose they might simply mean that a lower court will strike it down and it won\u2019t ever reach the Supremes, but if so, it\u2019s worth noting that Planned Parenthood President Cecile Richards <a href=\"http:\/\/www.washingtonpost.com\/blogs\/wonkblog\/wp\/2013\/03\/27\/planned-parenthoods-president-thinks-abortion-is-headed-back-to-the-supreme-court\/\">disagrees<\/a>.<\/p>\n<p>Honestly, I\u2019m not optimistic about the heartbeat law\u2019s chances before the highest court in the land, but not because of the merits. I worry because <a href=\"\/news\/john-roberts-defection-spells-trouble-for-overturning-roe\/\">we&#8217;ve already gotten burned<\/a> by one of the Supreme Court\u2019s so-called conservative justices ruling based on criteria other than the law. Even so, more serious observers would draw a sharper distinction between predicting what outcomes <i>will<\/i> be and arguing what they <i>should<\/i> be.<\/p>\n<p>The next few paragraphs are a bland, generic rundown of everything else anti-choice yahoos are doing in the rest of the country, that frankly reads as if it was copy-pasted from a Planned Parenthood press release, from scaremongering that closing down and defunding Planned Parenthoods will threaten \u201cpreventive care relied upon by hundreds of thousands of people\u201d (<a href=\"\/news\/demolishing-the-demagoguery-on-wisconsin-planned-parenthood-shutdowns\/\">bull<\/a>) to how requiring abortionists to get hospital admitting privileges is \u201cmedically unnecessary\u201d (<a href=\"\/news\/abortion-clinics-sending-women-away-without-medical-care-how-often-does-it-happen\/\">not true<\/a>).<\/p>\n<p>Why, did you know some people even want to prohibit \u201cabortions for gender preference\u201d and \u201cabortions based on genetic defects\u201d? Those must be Obviously Bad Things, because the editors don\u2019t even bother to explain what\u2019s wrong with them. But take a few seconds to consider what practices they\u2019re siding with &#8211; killing babies <a href=\"\/news\/why-pro-choice-pro-gendercide\/\">specifically because they&#8217;re girls<\/a> or <a href=\"\/news\/but-what-about-genetic-disorders-bekahs-journey\/\">because they&#8217;re &#8220;defective&#8221;<\/a> &#8211; and the question goes from \u201cwhy won\u2019t they listen to the <i>Times<\/i>?\u201d to \u201cis the <i>Times<\/i> listening to itself?\u201d<\/p>\n<p>The final outrage is North Dakota\u2019s \u201cso-called\u201d <a href=\"\/news\/north-dakota-passes-first-personhood-amendment-in-u-s-history\/\">personhood amendment<\/a> \u201cthat would give a fertilized egg the full range of individual rights, and could outlaw abortion and threaten access to fertility treatments as well as to widely used forms of birth control.\u201d Never mind the fact that that \u201cfertilized egg\u201d <i>is<\/i> a live, individual human being and therefore <i>is<\/i> entitled under the Constitution to equal protection of his or her natural right to life. The only birth control that would be threatened are abortifacients, and as for fertility treatments, Live Action\u2019s Josh Craddock <a href=\"\/news\/north-dakota-passes-first-personhood-amendment-in-u-s-history\/\">notes<\/a> that \u201cit would be the basis only for changing standards at IVF clinics so that living human embryos cannot be killed and discarded. Some personhood proponents have <a href=\"http:\/\/personhoodeducation.org\/2013\/02\/27\/video-personhood-and-in-vitro-fertilization\/\">come forward<\/a> to talk about how IVF can be done ethically, without ever destroying a living human being.\u201d<\/p>\n<p>The <i>Times<\/i> closes with a clarion call \u201cfor a stepped-up effort to hold state officials electorally accountable for policies that harm women.\u201d How about holding accountable pompous newspaper editors who insult their readers\u2019 intelligence?<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The &#8220;paper of record&#8221;
