When put to a vote, the abortion lobby\u2019s efforts are succeeding, primarily because of deceptive sponsorship and misleading language.<\/span><\/p>\n<p><b>FOLLOWING THE MONEY<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Pro-abortion ballot measures are generally proposed and funded by groups which appear to be local grassroots organizations at first glance. But in reality, Big Abortion and its allies are footing the lion\u2019s share of the bill for the promotion of pro-abortion ballot measures \u2013 and opposition to pro-life ones \u2013 in virtually every case.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These are the primary organizations and individuals promoting abortion at the ballot box across the country:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.sixteenthirtyfund.org\/\"><span style=\"font-weight: 400;\">Sixteen Thirty Fund<\/span><\/a><span style=\"font-weight: 400;\"> is a nationwide self-described \u201cprogressive\u201d organization with over <\/span><a href=\"https:\/\/www.sixteenthirtyfund.org\/wp-content\/uploads\/2023\/11\/Sixteen-Thirty-Fund-2022-Public-Disclosure-Copy.pdf\"><span style=\"font-weight: 400;\">$191 million<\/span><\/a><span style=\"font-weight: 400;\"> in total revenue for 2022. A substantial portion of its revenue is being devoted to advancing abortion in state elections. It <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-for-reproductive-freedom\/59279242\/2023\"><span style=\"font-weight: 400;\">provided<\/span><\/a> <a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-united-for-reproductive-rights\/59279240\/2023\"><span style=\"font-weight: 400;\">over<\/span><\/a><span style=\"font-weight: 400;\"> $6.7 million to the campaign to <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/ohio-voters-enshrine-abortion-constitution\/\"><span style=\"font-weight: 400;\">enshrine<\/span><\/a><span style=\"font-weight: 400;\"> abortion as a constitutional \u201cright\u201d in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/ohio-issue-1-abortion-any-reason\/\"><span style=\"font-weight: 400;\">Ohio<\/span><\/a><span style=\"font-weight: 400;\"> and over <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/reproductive-freedom-for-all\/56845349\/2022\"><span style=\"font-weight: 400;\">$6 million<\/span><\/a><span style=\"font-weight: 400;\"> to a similar effort in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/michigan-activists-codify-abortion-constitution\/\"><span style=\"font-weight: 400;\">Michigan<\/span><\/a><span style=\"font-weight: 400;\">. It also provided substantial <\/span><a href=\"https:\/\/news.ballotpedia.org\/2022\/03\/21\/sixteen-thirty-fund-aclu-and-planned-parenthood-contribute-to-the-campaign-behind-vermont-proposal-5-the-right-to-personal-reproductive-autonomy-amendment\/\"><span style=\"font-weight: 400;\">funding<\/span><\/a><span style=\"font-weight: 400;\"> to the effort to pass the pro-abortion <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/vermont-house-amendment-abortion-constitution\/\"><span style=\"font-weight: 400;\">Proposal 5<\/span><\/a><span style=\"font-weight: 400;\"> in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/election-abortion-right-states\/\"><span style=\"font-weight: 400;\">Vermont<\/span><\/a><span style=\"font-weight: 400;\">. In addition, it provided a large portion of the funding behind efforts to defeat pro-life measures in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/election-abortion-right-states\/\"><span style=\"font-weight: 400;\">Kentucky<\/span><\/a><span style=\"font-weight: 400;\"> (<\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/protect-kentucky-access\/54451349\/2022\"><span style=\"font-weight: 400;\">$585K<\/span><\/a><span style=\"font-weight: 400;\">) and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/voters-reject-pro-life-amendment-kansas-constitution\/\"><span style=\"font-weight: 400;\">Kansas<\/span><\/a><span style=\"font-weight: 400;\"> (nearly <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/kansans-for-constitutional-freedom\/55856684\/2022\"><span style=\"font-weight: 400;\">$1.6 million<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">).<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Planned Parenthood Federation of America and its various affiliates, which form the nation\u2019s <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-report-record-high-abortions-drop\/\"><span style=\"font-weight: 400;\">largest abortion chain<\/span><\/a><span style=\"font-weight: 400;\">, have spent millions promoting pro-abortion ballot measures across the country: <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-for-reproductive-freedom\/59279242\/2023\"><span style=\"font-weight: 400;\">$3.9 million<\/span><\/a><span style=\"font-weight: 400;\"> in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-united-for-reproductive-rights\/59279240\/2023\"><span style=\"font-weight: 400;\">Ohio<\/span><\/a><span style=\"font-weight: 400;\">; over <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/CA\/2022\/55770895\/summary\"><span style=\"font-weight: 400;\">$2.7 million<\/span><\/a><span style=\"font-weight: 400;\"> in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/atkins-ballot-measure-committee-yes-on-proposition-1-supported-by-health-care-organizations-planned-parenthood-affiliates-of-california-senator-toni\/22215056\/2022\"><span style=\"font-weight: 400;\">California<\/span><\/a><span style=\"font-weight: 400;\">; over $4 million in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/reproductive-freedom-for-all\/56845349\/2022\"><span style=\"font-weight: 400;\">Michigan<\/span><\/a><span style=\"font-weight: 400;\">; and over $71K in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/vermont-governor-signs-amendment-abortion-right\/\"><span style=\"font-weight: 400;\">Vermont<\/span><\/a><span style=\"font-weight: 400;\">. It is sponsoring proposed pro-abortion ballot measures in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/advocates-constitutional-killing-right-montana\/\"><span style=\"font-weight: 400;\">Montana<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/ballotpedia.org\/New_York_Equal_Protection_of_Law_Amendment_(2024)\"><span style=\"font-weight: 400;\">New York<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/nebraska-measure-would-legalize-abortion-through-birth\/\"><span style=\"font-weight: 400;\">Nebraska<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/florida-cash-pro-abortion-groups-ballot\/\"><span style=\"font-weight: 400;\">Florida<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-aclu-naral-right-abortion-nevada\/\"><span style=\"font-weight: 400;\">Nevada<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-groups-constitutional-right-arizona\/\"><span style=\"font-weight: 400;\">Arizona<\/span><\/a><span style=\"font-weight: 400;\">. In addition, it provided major funding to the efforts to defeat pro-life measures in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/protect-kentucky-access\/54451349\/2022\"><span style=\"font-weight: 400;\">Kentucky<\/span><\/a><span style=\"font-weight: 400;\"> (over $1.8 million) and <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/kansans-for-constitutional-freedom\/55856684\/2022\"><span style=\"font-weight: 400;\">Kansas<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> (nearly $2.1 million).<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The American Civil Liberties Union (<\/span><a href=\"https:\/\/www.aclu.org\/\"><span style=\"font-weight: 400;\">ACLU<\/span><\/a><span style=\"font-weight: 400;\">) is another national-level organization. It has launched an \u201c<\/span><a href=\"https:\/\/www.aclu.org\/campaigns\/abortion-criminal-defense-initiative\"><span style=\"font-weight: 400;\">Abortion Criminal Defense Initiative<\/span><\/a><span style=\"font-weight: 400;\">\u201d which \u201cis establishing and working alongside a network of experienced criminal defense attorneys prepared to defend those facing prosecution related to abortion care.\u201d It is also bankrolling efforts to advance abortion in individual states. It <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-for-reproductive-freedom\/59279242\/2023\"><span style=\"font-weight: 400;\">funneled<\/span><\/a> <a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-united-for-reproductive-rights\/59279240\/2023\"><span style=\"font-weight: 400;\">nearly<\/span><\/a><span style=\"font-weight: 400;\"> $4.9 million to pro-abortion efforts in Ohio; spent over <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/reproductive-freedom-for-all\/56845349\/2022\"><span style=\"font-weight: 400;\">$9 million<\/span><\/a><span style=\"font-weight: 400;\"> in Michigan; and was a <\/span><a href=\"https:\/\/news.ballotpedia.org\/2022\/03\/21\/sixteen-thirty-fund-aclu-and-planned-parenthood-contribute-to-the-campaign-behind-vermont-proposal-5-the-right-to-personal-reproductive-autonomy-amendment\/\"><span style=\"font-weight: 400;\">top donor<\/span><\/a><span style=\"font-weight: 400;\"> behind Proposal 5 in Vermont. It is <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/nebraska-measure-would-legalize-abortion-through-birth\/\"><span style=\"font-weight: 400;\">sponsoring<\/span><\/a><span style=\"font-weight: 400;\"> proposed pro-abortion ballot measures in <\/span><a href=\"https:\/\/journalstar.com\/news\/state-regional\/government-politics\/nebraska-abortion-rights-petition-language\/article_eef8adbe-83bf-11ee-a279-07579f8e71ff.html\"><span style=\"font-weight: 400;\">Nebraska<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/florida-cash-pro-abortion-groups-ballot\/\"><span style=\"font-weight: 400;\">Florida<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-aclu-naral-right-abortion-nevada\/\"><span style=\"font-weight: 400;\">Nevada<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-groups-constitutional-right-arizona\/\"><span style=\"font-weight: 400;\">Arizona<\/span><\/a><span style=\"font-weight: 400;\">. It also provided a substantial portion of the funding behind the campaigns to defeat pro-life measures in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/protect-kentucky-access\/54451349\/2022\"><span style=\"font-weight: 400;\">Kentucky<\/span><\/a><span style=\"font-weight: 400;\"> ($519K) and <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/kansans-for-constitutional-freedom\/55856684\/2022\"><span style=\"font-weight: 400;\">Kansas<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> (nearly $767K).<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/group-funded-george-soros-attack-pregnancy-centers\/\"><span style=\"font-weight: 400;\">Open Society Policy Center<\/span><\/a><span style=\"font-weight: 400;\">, a project of <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/george-soros-and-family-top-donors-planned-parenthood-votes\/\"><span style=\"font-weight: 400;\">pro-abortion<\/span><\/a><span style=\"font-weight: 400;\"> billionaire <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-money-trail-abortion-pill-corruption\/\"><span style=\"font-weight: 400;\">George Soros<\/span><\/a><span style=\"font-weight: 400;\">, has provided major funding toward efforts to declare abortion a \u201cright\u201d in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-for-reproductive-freedom\/59279242\/2023\"><span style=\"font-weight: 400;\">Ohio<\/span><\/a><span style=\"font-weight: 400;\"> (<\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-united-for-reproductive-rights\/59279240\/2023\"><span style=\"font-weight: 400;\">$4 million<\/span><\/a><span style=\"font-weight: 400;\">) and Michigan (<\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/reproductive-freedom-for-all\/56845349\/2022\"><span style=\"font-weight: 400;\">$4.5 million<\/span><\/a><span style=\"font-weight: 400;\">). It also donated $250K to each respective effort to defeat pro-life measures in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/protect-kentucky-access\/54451349\/2022\"><span style=\"font-weight: 400;\">Kentucky<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/kansans-for-constitutional-freedom\/55856684\/2022\"><span style=\"font-weight: 400;\">Kansas<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">.<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reproductive Freedom for All, formerly known as NARAL Pro-Choice America, and its various affiliates have provided significant funding to pro-abortion efforts in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/ohioans-for-reproductive-freedom\/59279242\/2023\"><span style=\"font-weight: 400;\">Ohio<\/span><\/a><span style=\"font-weight: 400;\"> ($100K) and <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/MI\/2022\/47369136\/summary\"><span style=\"font-weight: 400;\">Michigan<\/span><\/a><span style=\"font-weight: 400;\"> ($48.2 million, much of which was donated by other major pro-abortion organizations and funneled through Reproductive Freedom for All). It is sponsoring proposed measures in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/planned-parenthood-aclu-naral-right-abortion-nevada\/\"><span style=\"font-weight: 400;\">Nevada<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-groups-constitutional-right-arizona\/\"><span style=\"font-weight: 400;\">Arizona<\/span><\/a><span style=\"font-weight: 400;\">, and funded efforts to defeat pro-life measures in <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/protect-kentucky-access\/54451349\/2022\"><span style=\"font-weight: 400;\">Kentucky<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/kansans-for-constitutional-freedom\/55856684\/2022\"><span style=\"font-weight: 400;\">Kansas<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">.<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Former New York City mayor and major Planned Parenthood <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/presidential-michael-bloomberg-millions-planned-parenthood\/\"><span style=\"font-weight: 400;\">donor<\/span><\/a><span style=\"font-weight: 400;\">, billionaire <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/nyc-mayor-bloomberg-pregnant-employee-kill-it\/\"><span style=\"font-weight: 400;\">Michael Bloomberg<\/span><\/a><span style=\"font-weight: 400;\">, donated <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/reproductive-freedom-for-all\/56845349\/2022\"><span style=\"font-weight: 400;\">$2 million<\/span><\/a><span style=\"font-weight: 400;\"> toward enshrining abortion as a \u201cright\u201d in Michigan. He also donated <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/kansans-for-constitutional-freedom\/55856684\/2022\"><span style=\"font-weight: 400;\">$1.25 million<\/span><\/a><span style=\"font-weight: 400;\"> toward the effort to defeat Kansas\u2019 pro-life measure, and <\/span><a href=\"https:\/\/www.opensecrets.org\/ballot-measures\/committees\/protect-kentucky-access\/54451349\/2022\"><span style=\"font-weight: 400;\">$250K<\/span><\/a><span style=\"font-weight: 400;\"> toward the pro-life defeat in Kentucky.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">It is clear that the efforts to enshrine abortion as a \u201cright\u201d in state constitutions are not primarily locally based\/grassroots-driven.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/zVk1qM1El9o?si=47_64zhWxh1IYqzg\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p><b>DECEPTIVE LANGUAGE<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In addition to the fact that Big Abortion is outspending its opposition by tens of millions of dollars through its donations to umbrella organizations posing as grassroots coalitions, abortion is winning at the ballot box as a result of the vague and deceptive language of the measures themselves.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When examining the language of the various pro-abortion ballot measures, commonalities emerge:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Most are worded in such a way as to insinuate that abortions committed past the point of so-called \u201cviability\u201d could still be regulated and limited. This is true of ballot measures which have enshrined abortion as a \u201cright\u201d in the state constitutions of <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/ohio-issue-1-abortion-any-reason\/\"><span style=\"font-weight: 400;\">Ohio<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220SCA10\"><span style=\"font-weight: 400;\">California<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/ballotpedia.org\/Michigan_Proposal_3,_Right_to_Reproductive_Freedom_Initiative_(2022)\"><span style=\"font-weight: 400;\">Michigan<\/span><\/a><span style=\"font-weight: 400;\">. This language is also included in the proposed pro-abortion measures of <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/advocates-constitutional-killing-right-montana\/\"><span style=\"font-weight: 400;\">Montana<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/journalstar.com\/news\/state-regional\/government-politics\/nebraska-abortion-rights-petition-language\/article_eef8adbe-83bf-11ee-a279-07579f8e71ff.html\"><span style=\"font-weight: 400;\">Nebraska<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/floridiansprotectingfreedom.com\/wp-content\/uploads\/2023\/05\/Fulltext_2307_EN.pdf\"><span style=\"font-weight: 400;\">Florida<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.sos.mo.gov\/cmsimages\/Elections\/Petitions\/2024-087.pdf\"><span style=\"font-weight: 400;\">Missouri<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/drive.google.com\/file\/d\/194STMWIDKd-YatMAIFeZZ-CnHwJ0x8q-\/view\"><span style=\"font-weight: 400;\">Arizona<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">. <\/span><\/span><span style=\"font-weight: 400;\">However, whether or not a pre-born child is \u201cviable\u201d is a subjective case-by-case <\/span><a href=\"https:\/\/catholicaoc.org\/wp-content\/uploads\/2023\/09\/WhereDoesItSayThat_CCO_logo.pdf\"><span style=\"font-weight: 400;\">determination<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> made by the very abortionist being paid to kill that child.<\/span><\/span><\/span>This renders the term meaningless, and effectively legalizes abortion throughout all nine months of pregnancy.The majority of Americans consistently and overwhelmingly <a href=\"https:\/\/archive.liveaction.org\/news\/npr-poll-shows-americans-support-abortion-restrictions\/\"><span style=\"font-weight: 400;\">oppose<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> abortion past the first trimester, but do not seem to understand that these ballot measures enable the permanent legalization of abortion throughout pregnancy in their respective states.<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Another way in which most of the passed\/proposed measures legalize abortion throughout pregnancy is by means of their built-in \u201chealth\u201d exceptions. <\/span><\/span>Amendments passed in <a href=\"https:\/\/archive.liveaction.org\/news\/ohio-issue-1-abortion-any-reason\/\"><span style=\"font-weight: 400;\">Ohio<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220SCA10\"><span style=\"font-weight: 400;\">California<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/ballotpedia.org\/Michigan_Proposal_3,_Right_to_Reproductive_Freedom_Initiative_(2022)\"><span style=\"font-weight: 400;\">Michigan<\/span><\/a><span style=\"font-weight: 400;\"> contain \u201chealth\u201d exceptions protecting abortions past the point of so-called \u201cviability.\u201d Proposed measures in <\/span><a href=\"https:\/\/floridiansprotectingfreedom.com\/wp-content\/uploads\/2023\/05\/Fulltext_2307_EN.pdf\"><span style=\"font-weight: 400;\">Florida<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.sos.mo.gov\/cmsimages\/Elections\/Petitions\/2024-087.pdf\"><span style=\"font-weight: 400;\">Missouri<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/ballotpedia.org\/South_Dakota_Right_to_Abortion_Amendment_(2024)\"><span style=\"font-weight: 400;\">South Dakota<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/arkansasadvocate.com\/2023\/11\/27\/proposed-arkansas-ballot-measure-would-make-abortion-access-a-constitutional-right\/#:~:text=Abortion%20is%20currently%20illegal%20in,put%20this%20law%20in%20place.\"><span style=\"font-weight: 400;\">Arkansas<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/nebraskaexaminer.com\/2023\/11\/15\/nebraska-abortion-rights-petition-language-aims-for-viability-standard\/\"><span style=\"font-weight: 400;\">Nebraska<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/drive.google.com\/file\/d\/194STMWIDKd-YatMAIFeZZ-CnHwJ0x8q-\/view\"><span style=\"font-weight: 400;\">Arizona<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> also stipulate that abortions performed to protect the \u201chealth\u201d of the mother cannot be regulated.<\/span><\/span><\/span>So-called \u201chealth\u201d exceptions have historically been <a href=\"https:\/\/archive.liveaction.org\/news\/ohio-issue-1-abortion-any-reason\/\"><span style=\"font-weight: 400;\">broadly interpreted<\/span><\/a><span style=\"font-weight: 400;\"> to include such things as emotional\/psychological health, familial health, and even financial health; some ballot measures explicitly include mental health as a qualifying exception to post-&#8220;viability\u201d regulations. Because \u201chealth\u201d is vaguely defined in all cases, and because the determination of health-related \u201cnecessity\u201d is left up to the abortionist\u2019s discretion, abortion for <\/span><i><span style=\"font-weight: 400;\">any<\/span><\/i><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> reason could be construed as \u201cnecessary.\u201d In practice, therefore, abortion could be permitted for any reason at any point in pregnancy.<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Most of the passed\/proposed ballot measures stipulate that the \u201cright\u201d to abortion is possessed by everyone \u2013 including minors. They do this by using the terms \u201cindividual,\u201d \u201cperson,\u201d or \u201cpatient\u201d rather than \u201cwoman\u201d or \u201cadult.\u201d Such language could essentially <a href=\"https:\/\/archive.liveaction.org\/news\/issue-1-endanger-ohio-parental-involvement\/\">outlaw <\/a><\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortion-minors-consent-poll\/\"><span style=\"font-weight: 400;\">popular<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> laws requiring parental consent\/notification for abortions committed on minors.<\/span><\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A majority of the passed\/proposed ballot measures also group abortion in with other, completely unrelated items <em>which are not prohibited by law in any state<\/em>, including contraception, miscarriage care, childbirth, prenatal care, postpartum care, sterilization, and infertility care. <\/span><\/span>Nevada\u2019s proposed ballot measure was recently <a href=\"https:\/\/archive.liveaction.org\/news\/judge-rejects-abortion-ballot-initiative-nevada\/\"><span style=\"font-weight: 400;\">rejected<\/span><\/a><span style=\"font-weight: 400;\"> in its current form by District Judge James T. Russell for this very reason \u2013 he ruled that the language was \u201ctoo broad.\u201d This over-broad language convices people who might otherwise oppose such measures into voting <\/span><i><span style=\"font-weight: 400;\">in favor<\/span><\/i><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> of them, because it deceptively insinuates that these other, non-abortion-related services could be threatened.<\/span><\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Some measures, like <\/span><a href=\"https:\/\/ballotpedia.org\/Michigan_Proposal_3,_Right_to_Reproductive_Freedom_Initiative_(2022)\"><span style=\"font-weight: 400;\">Michigan<\/span><\/a><span style=\"font-weight: 400;\">\u2019s and <\/span><a href=\"https:\/\/ballotpedia.org\/New_York_Equal_Protection_of_Law_Amendment_(2024)\"><span style=\"font-weight: 400;\">New York<\/span><\/a><span style=\"font-weight: 400;\">\u2019s, contain language prohibiting \u201cdiscrimination\u201d or \u201cprosecution\u201d of women based on their so-called \u201c<em>pregnancy outcomes<\/em>.\u201d This vague language has led even some legal groups to express <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/groups-express-concerns-language-michigan\/\"><span style=\"font-weight: 400;\">concern<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> that infanticide investigations could be prohibited, allowing women who murder their newborns to evade prosecution.<\/span><\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cReproductive freedom\u201d and\/or \u201creproductive autonomy\u201d are also common catchphrases used in various passed\/proposed ballot measures. This appeals to Americans\u2019 traditional love of freedom generally; it is also misleading because abortions take place <\/span><i><span style=\"font-weight: 400;\">after reproduction has already occurred,<\/span><\/i><span style=\"font-weight: 400;\"> and no state is attempting to regulate individuals\u2019 freedom to sexually reproduce.<\/span><\/li>\n<\/ul>\n<p><strong>CURRENT BALLOT MEASURE LANDSCAPE<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Ballot measures enshrining a so-called \u201cright\u201d to abortion have already passed in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/ohio-voters-enshrine-abortion-constitution\/\"><span style=\"font-weight: 400;\">Ohio<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/election-abortion-right-states\/\"><span style=\"font-weight: 400;\">California<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/election-abortion-right-states\/\"><span style=\"font-weight: 400;\">Michigan<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/election-abortion-right-states\/\"><span style=\"font-weight: 400;\">Vermont<\/span><\/a><span style=\"font-weight: 400;\">. Similar measures are on the 2024 ballot in <\/span><a href=\"https:\/\/ballotpedia.org\/Maryland_Right_to_Reproductive_Freedom_Amendment_(2024)\"><span style=\"font-weight: 400;\">Maryland<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/ballotpedia.org\/New_York_Equal_Protection_of_Law_Amendment_(2024)\"><span style=\"font-weight: 400;\">New York<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pro-abortion measures have been proposed, but are not yet officially on the ballot, in <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/advocates-constitutional-killing-right-montana\/\"><span style=\"font-weight: 400;\">Montana<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/nebraska-measure-would-legalize-abortion-through-birth\/\"><span style=\"font-weight: 400;\">Nebraska<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/florida-cash-pro-abortion-groups-ballot\/\"><span style=\"font-weight: 400;\">Florida<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/virginia-democrats-pro-abortion-amendment\/\"><span style=\"font-weight: 400;\">Virginia<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/missouri-supreme-court-abortion-proceed\/\"><span style=\"font-weight: 400;\">Missouri<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/atg.sd.gov\/docs\/ltr.Barnett%20Ballot%20Explenation%20Abortion%208.24.2022.pdf\"><span style=\"font-weight: 400;\">South Dakota<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/pro-abortion-groups-constitutional-right-arizona\/\"><span style=\"font-weight: 400;\">Arizona<\/span><\/a><span style=\"font-weight: 400;\">.
