{"id":302123,"date":"2023-11-27T12:42:55","date_gmt":"2023-11-27T18:42:55","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=302123"},"modified":"2023-11-27T11:58:30","modified_gmt":"2023-11-27T17:58:30","slug":"women-pro-abortion-lawsuit-texas","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/women-pro-abortion-lawsuit-texas\/","title":{"rendered":"Seven more women join pro-abortion lawsuit against Texas"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">Seven more women have joined the<\/span> <a href=\"https:\/\/archive.liveaction.org\/news\/five-women-texas-pro-life-abortion\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> filed by the Center for Reproductive Rights against Texas, bringing the total number of plaintiffs in the case to 22. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The plaintiffs are suing Texas over <\/span><span style=\"font-weight: 400;\">the state\u2019s <\/span><a href=\"https:\/\/texasattorneygeneral.gov\/sites\/default\/files\/images\/executive-management\/Updated%20Post-Roe%20Advisory%20Upon%20Issuance%20of%20Dobbs%20Judgment%20(07.27.2022).pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">pro-life laws<\/span><\/a><span style=\"font-weight: 400;\">, wrongly claiming that the laws do not allow doctors to care for pregnant mothers suffering medical complications during their pregnancies. The case, <\/span><i><span style=\"font-weight: 400;\">Zurawski v. The State of Texas<\/span><\/i><span style=\"font-weight: 400;\">, was first filed by the Center for Reproductive Rights on behalf of five women in March.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Center for Reproductive Rights <\/span><a href=\"https:\/\/reproductiverights.org\/case\/zurawski-v-texas-abortion-emergency-exceptions\/?sourceid=1149230&amp;utm_campaign=24emcl112383aax&amp;utm_medium=ea&amp;utm_source=email&amp;utm_content=repro_matters&amp;emci=fdc31105-7485-ee11-8925-00224832e811&amp;emdi=7da85a96-8585-ee11-8925-00224832e811&amp;ceid=811438\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">acknowledged<\/span><\/a><span style=\"font-weight: 400;\"> that Texas&#8217; pro-life law provides exceptions for abortion in cases of medical emergency, however, it simultaneously claims that Texas has \u201cextreme abortion bans\u201d and seeks \u201cto clarify the scope of the state\u2019s \u2018medical emergency\u2019 exception.\u201d Induced abortion \u2014 the intentional and direct killing of preborn children in the womb \u2014 is not medically necessary. A pregnancy can be ended without intentionally killing the baby.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The seven new plaintiffs join the lead plaintiff, Amanda Zurawski, two OB\/GYNs, and 12 other plaintiffs. Each woman has shared heart-wrenching stories in an attempt to prove that Texas needs to weaken its protections for preborn human beings. Yet, none of the women needed for her child to be intentionally killed, and the failure of hospital staff to properly care for them has more to do with <a href=\"https:\/\/archive.liveaction.org\/news\/doctors-incompetent-cervix-medical-neglect\/\" target=\"_blank\" rel=\"noopener\">medical negligence<\/a> than pro-life laws.<\/span><\/p>\n<p style=\"text-align: center;\">\u00a0<iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/5TmomK2RB2A?si=yqnezbFhQszjCLwZ\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">New plaintiff Cristina Nu\u00f1ez was suffering from multiple health problems, including diabetes and end-stage renal disease when she conceived her child. According to the<\/span> <a href=\"https:\/\/reproductiverights.org\/zurawski-v-texas-plaintiffs-stories-11-14-23\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Center for Reproductive Rights<\/span><\/a><span style=\"font-weight: 400;\">, Nu\u00f1ez\u2019s pregnancy caused the mother to have multiple blood clots and spend more time on dialysis. It is not known if Nu\u00f1ez\u2019s doctors attributed these health problems to her pregnancy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nu\u00f1ez sought an abortion, first from Texas; then, when she found that she did not qualify for an abortion in Texas, from New Mexico. She wanted to take the abortion pill but was told she could not due to her health problems. After the severity of Nu\u00f1ez\u2019s blood clots increased, she sought and underwent an abortion in Texas after a trip to the emergency room with the help of a pro-bono attorney. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">When a woman&#8217;s life is truly at risk, doctors are able to intervene in every state including Texas by <em>ending the pregnancy<\/em> \u2014 not through induced abortion, but by delivering the child alive and attempting to save both lives. Sometimes the child will be too young to survive and will die as a result of the emergency delivery or C-section. The important difference is that the child was not intentionally and directly killed \u2014 that is the action that Texas law prohibits.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another new plaintiff, Kristen Anaya, was 16 and a half weeks pregnant when her water broke, but her daughter Tylee remained in the womb. According to reports, Anay<\/span>a\u2019s OB\/GYN told her she had to \u201cget very sick\u201d before doctors could help her.<\/p>\n<p>\u201cSo it would have been avoidable \u2014 me going into sepsis \u2014 if they were able to induce labor. The quicker they could get Tylee delivered, the better chance they had at me not going into sepsis. However, Tylee still had a heartbeat,\u201d Anaya said.<\/p>\n<p>She continued, \u201cMy husband and I are being told that \u2018not only did we lose Tylee, but now you\u2019re gonna go into sepsis and there\u2019s nothing we can do about it other than watch you because of the abortion laws in Texas.'&#8221;<\/p>\n<p>ABC News <a href=\"https:\/\/southernillinoisnow.com\/2023\/05\/15\/woman-said-she-went-into-sepsis-before-she-could-get-life-saving-abortion-care-in-texas\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> that according to her medical records, Anaya\u2019s physician \u201cinitiated contact with the termination committee\u201d \u2014 a committee of physicians who must approve any abortions at the hospital. However, the induction of labor in a medical emergency is not an induced abortion because the child is being delivered alive to save the mother&#8217;s life. Tylee was not going to be intentionally killed prior to delivery. At 16 weeks, Tylee would not have survived, but that does not make the induced delivery an induced abortion.<\/p>\n<p>An <em>induced abortion<\/em> carries the goal of delivering a stillborn baby. An <em>induced preterm delivery<\/em> carries the goal of saving the mother&#8217;s life, and after 20 weeks, possibly saving the baby&#8217;s life as well.<\/p>\n<p>These women did <em>not<\/em> receive proper care \u2014 but proper care would not have been an induced abortion.<\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/our-miracle-baby-girl-anencephaly-welcomed\/\" target=\"_blank\" rel=\"noopener\">\u2018She was our miracle\u2019: Baby girl with anencephaly was welcomed with love<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Other plaintiffs joining the case discovered during their pregnancies that their babies had severe health conditions that threatened their ability to survive outside the womb. D. Aylen\u2019s baby had <a href=\"https:\/\/archive.liveaction.org\/news\/baby-abortion-diagnosis-anencephaly\/\" target=\"_blank\" rel=\"noopener\">anencephaly<\/a>, Kimberly Manzano\u2019s baby had <a href=\"https:\/\/archive.liveaction.org\/news\/baby-organs-outside-body-christmas\/\" target=\"_blank\" rel=\"noopener\">organs developing outside of his body<\/a>, Amy Coronado\u2019s baby had <a href=\"https:\/\/archive.liveaction.org\/news\/fiona-grace-was-expected-to-die-birth-now-called-miracle\/\" target=\"_blank\" rel=\"noopener\">holoprosencephaly<\/a>, and Danielle Mathisen\u2019s baby had spinal and brain conditions. Some children with these conditions survive beyond birth.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These women could not get induced abortions in Texas because there was no threat to their own lives. Abortion is <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-prenatal-diagnosis-tennessee\/\" target=\"_blank\" rel=\"noopener\">not necessary<\/a> in the case of <a href=\"https:\/\/ecourses.liveaction.org\/prolifereplies\/terminal-diagnosis\/\" target=\"_blank\" rel=\"noopener\">fetal diagnosis<\/a> but is often sought out by parents after <a href=\"https:\/\/archive.liveaction.org\/news\/told-life-risk-baby-die-refused-abortion\/\" target=\"_blank\" rel=\"noopener\">doctors<\/a> tell them that their child will not survive or will not live a &#8216;normal&#8217; life. Doctors are often <a href=\"https:\/\/archive.liveaction.org\/news\/defend-diagnosed-anencephaly-angela-parents-chose-life\/\" target=\"_blank\" rel=\"noopener\">wrong<\/a> and sometimes <a href=\"https:\/\/archive.liveaction.org\/news\/refused-abortion-welcomed-misdiagnosed-baby\/\" target=\"_blank\" rel=\"noopener\">misdiagnose<\/a> babies. Regardless, no child deserves to be killed because a doctor said they might die or might experience suffering.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Texas Supreme Court will hear arguments for <\/span><i><span style=\"font-weight: 400;\">Zurawski vs.The State of Texas<\/span><\/i><span style=\"font-weight: 400;\"> on November 28.
