{"id":302101,"date":"2023-11-24T10:19:58","date_gmt":"2023-11-24T16:19:58","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=302101"},"modified":"2023-11-21T20:30:02","modified_gmt":"2023-11-22T02:30:02","slug":"missouri-supreme-court-appeal-ballot","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/missouri-supreme-court-appeal-ballot\/","title":{"rendered":"Missouri Supreme Court refuses to hear appeal over pro-abortion ballot language"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">The Missouri Supreme Court has <a href=\"https:\/\/abc17news.com\/politics\/2023\/11\/20\/ashcrofts-application-to-transfer-abortion-ballot-summary-case-to-missouri-supreme-court-denied\/\" target=\"_blank\" rel=\"noopener\">declined<\/a> to hear an appeal from Secretary of State Jay Ashcroft regarding the language of the ballot summary of a possible abortion rights initiative petition for 2024.<\/span><\/p>\n<p>A circuit judge ruled two weeks ago that the wording Ashcroft used in the ballot summary was partisan. Cole County Judge Jon Beteem then <a href=\"https:\/\/abc17news.com\/news\/ap-missouri\/2023\/09\/25\/a-judge-has-rewritten-missouri-ballot-summary-language-that-described-dangerous-abortions\/\" target=\"_blank\" rel=\"noopener\"><em>rewrote<\/em> the ballot language<\/a>, which summarizes the <span style=\"font-weight: 400;\">proposed constitutional amendment that aims to remove protections for preborn children following the implementation of a state law protecting virtually all preborn children from abortion last year. Ashcroft\u2019s language aimed to make it clear how extreme the amendment is. His original <\/span><a href=\"https:\/\/www.sos.mo.gov\/petitions\/2024IPcirculation#2024099\"><span style=\"font-weight: 400;\">summary<\/span><\/a><span style=\"font-weight: 400;\"> read:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><em><span style=\"font-weight: 400;\">Do you want to amend the Missouri Constitution to:<\/span><\/em><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">allow for dangerous, unregulated, and unrestricted abortions, from conception to live birth, without requiring a medical license or potentially being subject to medical malpractice;<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">nullify longstanding Missouri law protecting the right to life, including but not limited to partial-birth abortion;<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">require the government not to discriminate against persons providing or obtaining an abortion, potentially including tax-payer funding; and<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">prohibit any municipality, city, town, village, district, authority, public subdivision, or public corporation having the power to tax or regulate or the state of Missouri from regulating abortion procedures?<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">A group called Missourians for Constitution Freedom sued to have the ballot language struck down. Beetem <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/judge-surprising-action-abortion-amendments-missouri\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">removed<\/span><\/a><span style=\"font-weight: 400;\"> much of that language, calling it \u201cproblematic.\u201d He said phrases like \u201cunborn child,\u201d \u201cpartial-birth abortion, \u201cend the life,\u201d and more must be removed. Ashcroft said he would continue fighting.<\/span><\/p>\n<p><strong>READ: <em><a href=\"https:\/\/archive.liveaction.org\/news\/no-middle-ground-intentionally-killing-humans\/\" target=\"_blank\" rel=\"noopener\">Why there can be no \u2018middle ground\u2019 on intentionally killing innocent human beings<\/a><\/em><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe will not stand idly by while the courts hide the effects of this amendment and mislead the people as to what they may very well be voting on next year,\u201d Ashcroft said. \u201cWhile the court may pretend this does not allow \u2018dangerous, unregulated, unrestricted\u2019 abortions, it is clear that under this initiative petition, individuals like Kermit Gosnell, who was sentenced to life imprisonment without the possibility of parole for killing a mother and 3 children, would be free from prosecution. Additionally, this court\u2019s language misleads the people into believing that initiative petitions 2024-085 and 087 would amend the constitution to \u2018declare government funding of abortion is not required\u2019 which is categorically false.\u201d<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">A Western District Court of Appeals upheld the descriptions written by Beetem, with the summary much vaguer, using statements like, \u201c<\/span><i><span style=\"font-weight: 400;\">establish a right to make decisions about reproductive health care, including abortion and contraceptives, with any governmental interference presumed invalid<\/span><\/i><span style=\"font-weight: 400;\">\u201d and \u201c<\/span><i><span style=\"font-weight: 400;\">remove Missouri\u2019s ban on abortion<\/span><\/i><span style=\"font-weight: 400;\">.\u201d <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The appeals court <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/10\/31\/appeals-court-swats-down-ashcroft-arguments-on-missouri-abortion-rights-petitions\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">said<\/span><\/a><span style=\"font-weight: 400;\"> Ashcroft\u2019s language was \u201creplete with politically partisan language,\u201d though the new language is so vague that voters will likely not understand how extreme the amendment is. And though Ashcroft again appealed, the Missouri Supreme Court <\/span><a href=\"https:\/\/stlpr.org\/government-politics-issues\/2023-11-20\/missouri-abortion-rights-backers-win-after-supreme-court-declines-to-consider-ballot-wording\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">would not hear his case<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Despite the loss, Ashcroft said he still stands by his ballot language, pointing out that it accurately describes what the constitutional amendment would do.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">\u201cWe stand by our language \u2014 it fairly and accurately reflects the scope and magnitude of each petition,\u201d he said in a <\/span><a href=\"https:\/\/stlpr.org\/government-politics-issues\/2023-11-20\/missouri-abortion-rights-backers-win-after-supreme-court-declines-to-consider-ballot-wording\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\">. \u201cMy responsibility as secretary of state is to make sure the people of Missouri have ballot language that they can understand and trust,&#8221; Ashcroft said. &#8220;If these petitions make it to the ballot, the people will decide.
