{"id":301087,"date":"2023-11-05T13:44:28","date_gmt":"2023-11-05T19:44:28","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=301087"},"modified":"2023-11-03T22:15:09","modified_gmt":"2023-11-04T03:15:09","slug":"bishops-warn-eeoc-rule-pro-life-discrimination","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/bishops-warn-eeoc-rule-pro-life-discrimination\/","title":{"rendered":"Bishops warn EEOC rule change could lead to pro-life discrimination in the workplace"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>The United States Conference of Catholic Bishops (USCCB) has written a letter to the Biden administration urging them to drop a new abortion rule, saying it could lead to pro-life employees facing discrimination in the workplace.<\/p>\n<p>In August, the U.S. Equal Employment Opportunity Commission (EEOC) put new rules in place to comply with the Pregnant Workers&#8217; Fairness Act (PWFA); however, those rules didn&#8217;t just cut down on pregnancy discrimination. They also moved to <a href=\"https:\/\/archive.liveaction.org\/news\/eeoc-rule-rewrites-pregnant-workers-abortion\/\" target=\"_blank\" rel=\"noopener\">protect abortion<\/a>, adding it as a medical condition for which employees can request workplace accommodations. The USCCB supported the PWFA, but strongly condemned it being used to include abortion, calling it a distortion of the law.<\/p>\n<p>Now, in a <a href=\"https:\/\/www.usccb.org\/sites\/default\/files\/about\/general-counsel\/rulemaking\/upload\/2023.10.27.final_.eeoc_.comments.usccb_.pdf\" target=\"_blank\" rel=\"noopener\">message<\/a> to the EEOC, the USCCB pointed out new guidance from the Biden administration regarding sex-based harassment could put pro-lifers at risk. The new guidance advises that \u201csex-based harassment&#8230; also can include harassment based on a woman\u2019s reproductive decisions, such as decisions about contraception or abortion.\u201d This move, they claimed, is an assault on free speech.<\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/eeoc-investigates-abortion-travel\/\"><em>EEOC investigates whether abortion travel benefits are discriminatory<\/em><\/a><\/strong><\/p>\n<p>&#8220;Opposition to abortion (including speech opposing abortion) is not sexual harassment because it is not based on sex,&#8221; the letter said, continuing, &#8220;We encourage speech on abortion and other moral issues that is respectful, courteous, and constructive. It is reasonable for employers and employees to insist upon civility and non-disruption in the workplace as a general matter. But on issues that involve no protected category, such as abortion, Title VII itself is silent and therefore has no role.&#8221;<\/p>\n<p>They further acknowledged the fall of <em>Roe v. Wade<\/em> last year, pointing out, \u201cIt is inconceivable that our nation\u2019s highest court, having just recently held that the Constitution does not enshrine a right to an abortion, would now interpret Title VII to forbid or chill workplace speech on this subject.\u201d<\/p>\n<p>Comments on the new rule will <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/10\/02\/2023-21644\/proposed-enforcement-guidance-on-harassment-in-the-workplace\" target=\"_blank\" rel=\"noopener\">remain open<\/a> until Wednesday, November 8, and the USCCB encouraged the public to express opposition to the guidance. &#8220;It is good that we have laws prohibiting harassment in the workplace,&#8221; they said in a <a href=\"https:\/\/angelusnews.com\/news\/nation\/bishops-abortion-sexual-harassment\/\" target=\"_blank\" rel=\"noopener\">statement<\/a>. &#8220;But speech expressing moral opposition to abortion, contraception, or same-sex unions, or speech that refers to people by their actual sex, is not harassment.&#8221;<\/p>\n<p><a href=\"https:\/\/www.liveaction.org\/stop-planned-parenthood\/?utm_campaign=sex_ed_petition&amp;utm_medium=LAN&amp;utm_source=website\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-295788\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-700x180.jpg\" alt=\"\" width=\"700\" height=\"180\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-700x180.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-300x77.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-768x198.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-500x129.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur.jpg 970w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The United States Conference of Catholic Bishops (USCCB) has written a letter to the Biden administration urging them to drop a new abortion rule, saying it could lead to pro-life employees facing discrimination in the workplace.
