UPDATE, 10\/29\/23<\/strong>: Planned Parenthood Arizona has reportedly<\/a> filed an official motion for recusal for Justice William Montgomery based on Montgomery’s “public comments and\u00a0his participation in a protest outside PPAZ headquarters in 2015,” because of which, they imply “would impact his ability to be impartial in the case.”<\/p>\n

10\/27\/23<\/strong>: After the Supreme Court\u2019s decision in <\/span>Dobbs v. Jackson Women\u2019s Health Organization<\/span><\/i>, which overturned <\/span>Roe v. Wade<\/span><\/i> and allowed states to make their own laws concerning abortion, an Arizona county judge sided with that state\u2019s attorney general, <\/span>ruling<\/span><\/a> that an 1864 law restricting almost all abortions was valid and should be enforced.<\/span><\/p>\n

Planned Parenthood, however, <\/span>sued<\/span><\/a> to block enforcement of the law, arguing that a 2022 law permitting abortions up to 15 weeks superseded it. An appellate court stayed enforcement of the older law until the courts sorted the matter out.\u00a0<\/span><\/p>\n

This December, the Arizona Supreme Court will hear the case. And Planned Parenthood and some of its <\/span>allies<\/span><\/a> are <\/span>taking issue<\/span><\/a> with Justice William Montgomery\u2019s refusal to recuse himself \u2013 because he is pro-life<\/em> and has been critical of the abortion corporation.<\/span><\/p>\n

Justice Montgomery reportedly <\/span>stated<\/span><\/a> in a 2017 Facebook post that Planned Parenthood \u201cis responsible for the greatest generational genocide known to man.\u201d He has also written that \u201cPP encourages the very behavior that leads to STDs and abortions. Their business model relies on it.\u201d\u00a0<\/span><\/p>\n

In addition, he <\/span>argued<\/span><\/a> a case in 2012 in which he asserted that Arizona had a right to ban abortions. \u201cI would recognize the inherent human dignity in a life at the moment of conception,\u201d he stated, adding that the procedure should be prohibited \u201cunless [the pregnancy] impacted the health and welfare of the mother.\u201d<\/span><\/p>\n

Kelley Dupps, Planned Parenthood\u2019s senior director of public policy and government relations, <\/span>said<\/span><\/a> in a media statement that \u201cPlanned Parenthood Arizona believes that all litigants are entitled to have their cases heard by judges who are not biased against them,\u201d adding, \u201cWe are evaluating the recent reporting that may impact our case in front of the Arizona Supreme Court.\u201d<\/span><\/p>\n

However, Justice Montgomery has repeatedly insisted that he can remain unbiased in hearing the case. \u201cAs with any other case involving an issue I may have previously taken a position on while serving as an executive branch official, I will consider the facts and the law to determine the merits of any legal argument presented without regard for any prior position and without passion or prejudice,\u201d Montgomery <\/span>told<\/span><\/a> Capitol Media Services in a statement. \u201cMy oath of office requires no less.\u201d<\/span><\/p>\n

Planned Parenthood has never expressed any concern over judges who <\/span>support<\/span><\/i> them overseeing their cases.<\/span><\/p>\n

Perhaps most notably, Planned Parenthood <\/span>argued<\/span><\/a> against<\/em> the forced recusal of Judge William H. Orrick III from its case against the <\/span>Center for Medical Progress<\/span><\/a> (CMP), which produced undercover videos exposing the abortion corporation\u2019s trafficking of fetal body parts.\u00a0<\/span><\/p>\n

Orrick wasn’t just pro-abortion; he founded an organization that works in partnership with and provides referrals to Planned Parenthood, and thereby has a direct financial <\/span>interest<\/span><\/a> therein. His <\/span>wife<\/span><\/a> has repeatedly expressed praise for Planned Parenthood and condemnation of pro-lifers, including CMP. What\u2019s more, Orrick consistently <\/span>acted<\/span><\/a> in <\/span>ways<\/span><\/a> that demonstrated bias in favor of Planned Parenthood during court proceedings, regularly ruling in their favor and <\/span>stymying<\/span><\/a> the <\/span>speech<\/span><\/a> and defense of the CMP.\u00a0<\/span><\/p>\n

Orrick was never disqualified from the case, either voluntarily or by higher courts.<\/span><\/p>\n

Clearly, Planned Parenthood is not interested in actual justice or judicial impartiality \u2013 only in their own legal and financial successes. Unless Justice Montgomery disregards actual law or twists it to fit his own agenda, as pro-abortion judges<\/a> often<\/a> have<\/a><\/span>, Planned Parenthood\u2019s protestations against him should not be taken seriously.<\/span><\/p>\n
