{"id":300238,"date":"2023-10-16T17:41:11","date_gmt":"2023-10-16T22:41:11","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=300238"},"modified":"2023-10-16T13:36:22","modified_gmt":"2023-10-16T18:36:22","slug":"dollar-general-settles-pregnancy-discrimination-lawsuit","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/dollar-general-settles-pregnancy-discrimination-lawsuit\/","title":{"rendered":"Dollar General settles pregnancy discrimination lawsuit"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">Dollar General, a well-known discount retailer, has settled a lawsuit with a former employee after allegedly firing the woman because she was pregnant.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the suit, the U.S. <\/span><span style=\"font-weight: 400;\">Equal Employment Oppor\u00adtunity Commission (EEOC) alleges that Calleigh Rutledge <\/span><a href=\"https:\/\/www.cbsnews.com\/news\/dollar-general-fires-pregnant-worker-for-health-reasons\/\"><span style=\"font-weight: 400;\">was fired<\/span><\/a><span style=\"font-weight: 400;\"> \u201cimmediately\u201d upon telling her manager that she was pregnant in September 2020. At the time, she hadn\u2019t asked for any pregnancy-related time off or suggested that she couldn\u2019t perform her duties as a result of her pregnancy. Nevertheless, she was let go &#8220;due to her pregnancy.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the EEOC, the store\u2019s manager later called Rutledge and apologized for firing her while asking her if she could return for \u201clight duty.\u201d Despite this, she \u201cwas never again placed on the schedule\u201d and later received a separation notice that noted she had been let go due to \u201chealth reasons.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dollar General initially <\/span><a href=\"https:\/\/www.cbsnews.com\/news\/dollar-general-fires-pregnant-worker-for-health-reasons\/\"><span style=\"font-weight: 400;\">refused<\/span><\/a><span style=\"font-weight: 400;\"> to acknowledge that Rutledge\u2019s pregnancy was the reason she was fired. &#8220;Dollar General asserts that there is no causal connection between Ms. Rutledge&#8217;s sex or alleged pregnancy, and any adverse employment action allegedly suffered by Ms. Rutledge,&#8221; it wrote.<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/studies-impact-workplace-pregnancy-discrimination\/\"><em>Two studies find significant impact of workplace pregnancy discrimination on moms and babies<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">As part of the settlement, Dollar General agreed to pay Rutledge $42,500 in damages, including $12,750 in back pay damages and $29,750 in compensatory damages. Additionally, it has been ordered to <\/span><span style=\"font-weight: 400;\">revise its anti-discrimination policies, provide annual training to its managers, and allow the EEOC to monitor complaints of discrimin\u00adation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe hope this case conveys the seriousness of pregnancy discrimination allegations to employers,\u201d <\/span><a href=\"https:\/\/www.eeoc.gov\/newsroom\/dollar-general-pay-42500-settle-pregnancy-discrimination-lawsuit\"><span style=\"font-weight: 400;\">said<\/span><\/a><span style=\"font-weight: 400;\"> Marcus G. Keegan, regional attorney for the EEOC\u2019s Atlanta District Office. \u201cThe Commission will continue to seek policy changes, training, and reporting in cases like this to protect employees and applicants from facing pregnancy discrimination in the future.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Data <\/span><a href=\"https:\/\/www.eeoc.gov\/statistics\/pregnancy-discrimination-charges-fy-2010-fy-2020\"><span style=\"font-weight: 400;\">shows<\/span><\/a><span style=\"font-weight: 400;\"> that <\/span><a href=\"https:\/\/bipartisanpolicy.org\/blog\/bpc-morning-consult-pregnancy-discrimination\/#:~:text=Overall%2C%208%25%20of%20all%20women,to%20pregnancy%20in%20the%20workplace.\"><span style=\"font-weight: 400;\">thousands<\/span><\/a><span style=\"font-weight: 400;\"> of pregnant women experience discrimination in the workplace each year.
