{"id":299423,"date":"2023-09-27T16:38:17","date_gmt":"2023-09-27T21:38:17","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=299423"},"modified":"2023-09-27T15:24:16","modified_gmt":"2023-09-27T20:24:16","slug":"ohio-supreme-court-weigh-heartbeat-law","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/ohio-supreme-court-weigh-heartbeat-law\/","title":{"rendered":"Ohio Supreme Court to weigh law protecting preborn humans with detectable heartbeats"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>The Ohio Supreme Court has begun <a href=\"https:\/\/www.cincinnati.com\/story\/news\/politics\/2023\/09\/26\/ohio-supreme-court-to-hear-arguments-about-ban-on-most-abortions\/70931104007\/\" target=\"_blank\" rel=\"noopener\">hearing arguments<\/a> on the state&#8217;s law protecting preborn children from abortion after a heartbeat can be detected \u2014 usually at about six weeks gestation.<\/p>\n<p>In 2019, the law was initially passed, only for a federal court judge to block it. When <em>Roe v. Wade<\/em> was overturned last summer, it was briefly reinstated, only for Judge Christian Jenkins to issue an <a href=\"https:\/\/archive.liveaction.org\/news\/ohio-judge-blocks-six-week-abortion-protections\/\" target=\"_blank\" rel=\"noopener\">indefinite injunction<\/a> against it in October. \u201cAbortion is safe health care to which Ohioans have a right,\u201d he <a href=\"https:\/\/ohiocapitaljournal.com\/2022\/10\/10\/abortion-ban-blocked-indefinitely-by-hamilton-county-judge\/\" target=\"_blank\" rel=\"noopener\">wrote<\/a>, adding, \u201cIt is simply wrong to state, as many do, that a right does not exist because it is not specifically listed in the constitution.\u201d<\/p>\n<p>Attorney General Dave Yost requested that the 1st District Court of Appeals overturn the ruling; when they <a href=\"https:\/\/archive.liveaction.org\/news\/ohio-court-declines-appeal-heartbeat-law\/\" target=\"_blank\" rel=\"noopener\">declined<\/a>, he asked the state Supreme Court to step in. They agreed to consider two legal issues: Jenkins\u2019 order blocking the heartbeat law, and whether or not abortion facilities have legal standing to challenge the law on behalf of their patients.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/cpdY97GOK2I?si=ZE8K_F5rxWPCgQgN\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe>\n<\/p>\n<p>Justice Pat Fischer questioned attorney Jessie Hill, who is representing Ohio abortion facilities, why Ohio women can&#8217;t sue the state themselves, and need abortion facilities to sue on their behalf \u2014 and pointed out that, by this logic, other people can sue on the issue of abortion as well.<\/p>\n<p>\u201cIf it\u2019s that broad of standing, why wouldn\u2019t then a grandparent or a putative father have standing to oppose the abortion?\u201d she said. \u201cCouldn\u2019t a grandparent of the putative child or a putative father of the child have that same standing to save that child\u2019s life?\u201d<\/p>\n<p>Additionally, Justice Pat DeWine questioned whether or not local judges should be able to block state laws so easily. &#8220;Your conception of final orders seems to give a trial court judge in one county extraordinary powers to enjoin a law and the judge in Meigs County could say that all of Ohio\u2019s housing discrimination laws are unconstitutional, schedule a trial that\u2019s going to last a couple of years and the state wouldn\u2019t be able to appeal,&#8221; she said. &#8220;Are there any limits to that?\u201d<\/p>\n<p>Ohio Solicitor General Benjamin Flowers agreed that this issue impacts more than abortion.<\/p>\n<p>\u201cThis argument is not about abortion. It\u2019s about much broader issues,\u201d Flowers said. \u201cIf they\u2019re right, we have no basis for appealing those flagrantly unconstitutional decisions once the injunction issues. So what they are really seeking is a special rule for abortion, and that\u2019s exactly the kind of jurisprudence that destroyed irreparably the U.S. Supreme Court\u2019s reputation. We ask this court not to follow the same path.\u201d<\/p>\n<p>The state is <a href=\"https:\/\/www.nbc4i.com\/news\/politics\/ohio-supreme-court-hears-arguments-in-six-week-abortion-ban-case\/\" target=\"_blank\" rel=\"noopener\">also arguing<\/a> that abortion facilities have no claim to standing and cannot establish a third-party claim. For a third-party claim to be valid, the third parties must demonstrate that their rights are interconnected with the rights of those directly affected \u2014 and Flowers said that allowing abortionists to sue on behalf of women violates current principles of standing. \u201cWhat they\u2019re really seeking is an exception for abortion,\u201d Flowers said.<\/p>\n<p>If the court rules in favor of Yost, the law will be allowed to take effect, though a ballot referendum will take place in November, in which voters can choose to enshrine abortion as a &#8220;right&#8221; in the state constitution.<\/p>\n<p><a href=\"https:\/\/www.liveaction.org\/stop-planned-parenthood\/?utm_campaign=sex_ed_petition&amp;utm_medium=LAN&amp;utm_source=website\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-295788\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-700x180.jpg\" alt=\"\" width=\"700\" height=\"180\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-700x180.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-300x77.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-768x198.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur-500x129.jpg 500w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Stop-PP-From-Sexualizing-Kids970x250-blur.jpg 970w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Ohio Supreme Court has begun hearing arguments on the state&#8217;s law protecting preborn children from abortion after a heartbeat can be detected \u2014 usually at about six weeks gestation.
