{"id":299101,"date":"2023-09-23T09:38:56","date_gmt":"2023-09-23T14:38:56","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=299101"},"modified":"2023-09-21T20:58:54","modified_gmt":"2023-09-22T01:58:54","slug":"ohio-court-unborn-child-ballot","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/ohio-court-unborn-child-ballot\/","title":{"rendered":"Ohio Supreme Court allows &#8216;unborn child&#8217; to remain in upcoming ballot language"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">The Ohio Supreme Court <\/span><a href=\"https:\/\/thehill.com\/policy\/healthcare\/4214531-ohio-supreme-court-allows-unborn-child-language-to-stay-in-abortion-ballot-measure\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ruled<\/span><\/a><span style=\"font-weight: 400;\"> Tuesday that the term \u201cunborn child\u201d can remain in the ballot language for the upcoming November referendum which will determine whether or not the \u201cright\u201d to abortion will be enshrined in the state\u2019s constitution.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The ruling comes after a <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/ohio-abortion-ballot-language-angers-advocates\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> was filed by supporters of the amendment, a pro-abortion coalition called <\/span><span style=\"font-weight: 400;\">Ohioans United for Reproductive Rights. The group took issue with ballot language drafted by the Ohio Ballot Board, particularly the fact that various phrases were rewritten and the ballot language contains the words \u201cunborn child\u201d instead of \u201cfetus.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">For instance, while the amendment states, \u201c\u2026 in no case may such an abortion be prohibited if in the professional judgment of the pregnant patient\u2019s treating physician it is necessary to protect the pregnant patient\u2019s life or health,\u201d the ballot language, which is presented to voters, explains the amendment would, \u201cAlways allow an unborn child to be aborted at any stage of pregnancy, regardless of viability, if, in the treating physician\u2019s determination, the abortion is necessary to protect the pregnant woman\u2019s life or health.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In their lawsuit, the petitioners <\/span><a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/ohio-court-rules-term-unborn-child-can-remain-abortion-ballot-language-rcna106310\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">argued<\/span><\/a><span style=\"font-weight: 400;\"> the ballot language <\/span><span style=\"font-weight: 400;\">\u201caims improperly to mislead Ohioans and persuade them to oppose the amendment.&#8221;<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/saturday-night-live-three-abortions-again\/\" target=\"_blank\" rel=\"noopener\"><em>\u2018Saturday Night Live\u2019 star admits to three abortions, says she would \u2018do it again\u2019<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">However, the court disagreed, saying that it &#8220;does not establish that the ballot board\u2019s language constitutes improper persuasion.&#8221; <\/span><span style=\"font-weight: 400;\">The only language the board was instructed to change was the phrase \u201ccitizens of the state.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mary Cianciolo, a spokesperson for Secretary of State Frank LaRose, said LaRose\u2019s office is pleased with the outcome. \u201cBy rejecting special interest attempts to substitute their own carefully crafted and poll tested language for that of the ballot board, they have ensured Ohio voters will have a full and accurate understanding of the proposed measure when they go to cast their ballots,\u201d she said in an email to <a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/ohio-court-rules-term-unborn-child-can-remain-abortion-ballot-language-rcna106310\" target=\"_blank\" rel=\"noopener\">NBC News<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lauren Blauvelt, a spokesperson for Ohioans United for Reproductive Rights, blasted the decision. \u201cThis should have been simple, but the Ohio ballot board tried to mislead voters yet again,\u201d she <\/span><a href=\"https:\/\/www.theguardian.com\/world\/2023\/sep\/19\/ohio-abortion-rights-referendum-language\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">said<\/span><\/a><span style=\"font-weight: 400;\">. \u201cIssue 1 is clearly and concisely written to protect Ohioans\u2019 right to make our own personal healthcare decisions about contraception, pregnancy, and abortion, free from government interference.
