The law protects preborn children from abortion after 12 weeks of pregnancy but allows certain exceptions throughout pregnancy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to <\/span><a href=\"https:\/\/www.carolinajournal.com\/lawmakers-reject-injunction-in-nc-abortion-lawsuit\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The Carolina Journal<\/span><\/a><span style=\"font-weight: 400;\">, lawmakers filed a\u00a0<\/span><a href=\"https:\/\/www.carolinajournal.com\/wp-content\/uploads\/2023\/08\/abortion-plannedp-65-080723.pdf\" target=\"_blank\" rel=\"noopener\">document<\/a><span style=\"font-weight: 400;\"> Monday opposing an injunction, saying <\/span><span style=\"font-weight: 400;\">that opponents of the state\u2019s new pro-life law are trying to \u201ccircumvent\u201d the U.S. Supreme Court\u2019s 2022 decision in <em>Dobbs v. Jackson Women&#8217;s Health Organization<\/em> overturning <em>Roe v. Wade<\/em>.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">District Judge Catherine Eagles had previously issued an order <em>temporarily<\/em> blocking one portion of the law, labeled the \u201cIUP Documentation Requirement\u201d in court paperwork on June 30. This portion of the law requires doctors to document a pregnancy as being in the uterus prior to administering the abortion pill. This is in order to protect women who may be experiencing an ectopic pregnancy, which puts their lives at risk and may <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-abortion-pill-fda-ectopic\/\" target=\"_blank\" rel=\"noopener\">increase<\/a> their risk of death if they take the abortion pill.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Planned Parenthood is seeking an injunction against that requirement and it is also seeking an injunction against the \u201cHospitalization Requirement,\u201d a section of the law requiring that abortions committed after the first trimester take place in a hospital rather than an abortion facility.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\">\u00a0<iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/S-lQOooYAs8?si=Tn1oFYLYa8bVd5y5\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">In their latest filing, lawmakers wrote, \u201cThe Supreme Court held in Dobbs v. Jackson Women\u2019s Health Organization that \u2018[i]t is time to heed the Constitution and return the issue of abortion to the people\u2019s elected representatives&#8217;. Ignoring that instruction, Plaintiffs are abortion providers who disagree with the policy choices behind North Carolina\u2019s new abortion laws and seek to constitutionalize their preferences for what North Carolina\u2019s laws should be.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lawmakers defended the requirement for doctors administering abortion drugs, stating, \u201cAs the leading cause of maternal mortality in the first trimester, ectopic pregnancies must be identified and treated before they rupture. The North Carolina General Assembly addressed this danger by requiring doctors to document an intrauterine pregnancy (IUP) prior to giving women drugs that can mask the symptoms of a life-threatening rupture. The U.S. Food and Drug Administration (FDA) has also addressed this risk by including a warning on mifepristone\u2019s label that a prescriber must \u2018exclude [an ectopic pregnancy] before treatment.\u2019 Codifying FDA\u2019s warning into law is rational.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The brief also defended the new law\u2019s hospitalization requirement for abortions that take place after the first trimester, saying, \u201cThe General Assembly also sought to provide safe conditions for women who seek abortions beyond the first trimester. As Plaintiffs have conceded, women who have post-12-week surgical abortions may experience life-threatening complications that require hospitalization. What\u2019s more, Planned Parenthood South Atlantic (PPSAT) admits that it has transferred women from its facilities to hospitals due to complications from post-12-week surgical abortions that it could not treat at its facilities.\u201d<\/span><\/p>\n<p><strong>READ: <a href=\"https:\/\/archive.liveaction.org\/news\/aborting-twins-too-late-healing-process\/\" target=\"_blank\" rel=\"noopener\"><em>She didn\u2019t know she was aborting twins until it was too late. Years later, her process of healing began.<\/em><\/a><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">\u201cSimply put, the North Carolina legislature had rational reasons to require IUP documentation prior to a chemical abortion and hospitalization for post-12-week surgical abortions.
