{"id":298850,"date":"2023-09-10T08:40:53","date_gmt":"2023-09-10T13:40:53","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=298850"},"modified":"2023-09-18T15:50:57","modified_gmt":"2023-09-18T20:50:57","slug":"lawsuit-fewer-restrictions-abortion-medical-emergencies","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/lawsuit-fewer-restrictions-abortion-medical-emergencies\/","title":{"rendered":"Lawsuit seeks fewer restrictions on abortion during medical emergencies in three states"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">Intentional killing by induced abortion is not medically necessary, but that doesn\u2019t stop pro-abortion activists from claiming that abortion is healthcare as a way to gain support for their cause, even if it might obscure the truth.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That is the case with a recent <\/span><a href=\"https:\/\/reproductiverights.org\/exceptions-complaints-idaho-tennessee-oklahoma\/\"><span style=\"font-weight: 400;\">lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> brought by the Center of Reproductive Rights on behalf of multiple women in Tennessee, Oklahoma, and Idaho who claim they were denied abortions during medical emergencies.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, the lead plaintiff, Jennifer Adkins, faced a difficult pregnancy. At 12 weeks, she learned her baby had multiple conditions, including a high chance of Turner syndrome, often resulting in miscarriage and carrying cardiovascular risks for the mother. Since Idaho protects nearly all preborn children from abortion, Jennifer traveled to neighboring Oregon for an abortion.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is important to note that the lives of those with Turner syndrome and other disabilities are not expendable. Several years ago, Live Action News <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/turner-syndrome-lives-expendable\/\"><span style=\"font-weight: 400;\">shared<\/span><\/a><span style=\"font-weight: 400;\"> the story of a remarkable woman, Julie Leon, who has Turner syndrome. Leon struggled with multiple complications throughout her life, but none stopped her from having a normal life, including getting married and adopting two children. Her story is just one among many like it.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She remarked, \u201cTo those who advocate for abortion, I say, my son, my daughter, my nieces and nephews, my grandchildren, and my grandniece and nephew would not be here because they consider our lives expendable.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This lawsuit bears similarities to another case brought forward by the same organization in Texas. In the <\/span><a href=\"https:\/\/reproductiverights.org\/case\/zurawski-v-texas-abortion-emergency-exceptions\/\"><span style=\"font-weight: 400;\">Texas lawsuit,<\/span><\/a><span style=\"font-weight: 400;\"> a group of women argued that the state&#8217;s protections for preborn children posed a risk to their lives. They sought a temporary injunction to prevent these laws from taking effect in situations involving pregnancy complications. Texas, along with several other states, had implemented \u201ctrigger laws\u201d that would automatically activate if <em>Roe v. Wade<\/em> were overturned. Texas laws protect most preborn children after six weeks of pregnancy when a heartbeat can be detected, and those who commit abortions can be criminally charged.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/zVk1qM1El9o?si=jQvuKvglHGN486Q1\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe>\n<\/p>\n<p><span style=\"font-weight: 400;\">In early August, a <\/span><a href=\"http:\/\/www.apple.com\"><span style=\"font-weight: 400;\">Texas<\/span><\/a><span style=\"font-weight: 400;\"> judge ruled doctors could exercise their \u201cgood faith judgment\u201d in committing abortions for dangerous or complicated pregnancies. However, the state swiftly appealed the ruling, and it is currently on hold, with oral arguments set for late November.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nancy Northup, Center president and CEO, issued a <\/span><a href=\"https:\/\/reproductiverights.org\/exceptions-complaints-idaho-tennessee-oklahoma\/\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\"> on the lawsuit, arguing that abortion is \u201cstandard, necessary, life-saving care.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe Supreme Court\u2019s unwarranted reversal of\u00a0Roe v. Wade has led repeatedly, in multiple states, to women being denied abortion care when they face serious complications in their pregnancies,\u201d said Northup. \u201cNo one should have to be at death\u2019s door to receive essential health care, but that is exactly what happens when doctors are forced to practice medicine under threat of imprisonment.\u201d\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">But is abortion really life-saving? Live Action and other other pro-life organizations have worked tirelessly to <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/abortion-medical-emergencies-smoke-screen-abortionists\/\"><span style=\"font-weight: 400;\">dispel the myth<\/span><\/a><span style=\"font-weight: 400;\"> that abortion is healthcare, illuminating the fact that <\/span><a href=\"https:\/\/aaplog.org\/what-is-aaplogs-position-on-abortion-to-save-the-life-of-the-mother\/\"><span style=\"font-weight: 400;\">thousands of healthcare professionals<\/span><\/a><span style=\"font-weight: 400;\"> have asserted that abortion (defined as the intentional and direct killing of a preborn human being) is not medically required to safeguard the health or life of the mother. There are other options, including <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/emergencies-pregnancy-c-section-save-lives\/\"><span style=\"font-weight: 400;\">premature delivery<\/span><\/a><span style=\"font-weight: 400;\"> of the preborn child, that are safer for the mother and do not kill the child. Both mother and baby should be treated as patients whose lives are valued.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although the reversal of <em>Roe v. Wade<\/em> marked a significant milestone in the pro-life movement, these lawsuits serve as a stark reminder that the fight to protect all human life, including preborn children, is far from over. Pro-lifers now find themselves at a critical juncture where it remains more important then ever to bring to light the truth about abortion, showing that it is neither healthcare nor necessary to save the life of women.
