Witness testimony in the ongoing <\/span>federal trial<\/span><\/a> of three pro-life activists \u2013 Joan Andrews Bell, Jonathan Darnel, and Jean Marshall \u2013 continued on Wednesday and Thursday of this week. Charges stem from an October 2020 <\/span>rescue action<\/span><\/a> at the D.C.-based <\/span>Washington Surgi-Clinic<\/span><\/a> (WSC), which is run by abortionist <\/span>Dr. Cesare Santangelo<\/span><\/a>. Each defendant faces up to 11 years in prison.<\/span><\/p>\n

Wednesday, which was abbreviated to accommodate <\/span>Judge Kollar-Kotelly\u2019s<\/span><\/a> schedule, was dominated by the testimony of Caroline Davis. Davis participated in the WSC rescue, for which the defendants have been indicted on charges of <\/span>conspiracy against rights<\/span><\/a> and violations of the <\/span>FACE Act<\/span><\/a>. Davis is not being prosecuted for her participation in the WSC rescue; however, she was indicted on the same charges for her participation in a rescue which took place in <\/span>Sterling Heights<\/span><\/a>, Michigan, in August of 2020. She accepted a plea deal in which she agreed to testify against her fellow activists in exchange for a reduction in the charges against her.<\/span><\/p>\n

Davis\u2019s testimony largely mirrored that which she gave in the <\/span>previous trial<\/span><\/a> of five other defendants. She said she had decided to testify against her fellow activists for two reasons: because she didn\u2019t want to go to jail, and because she has had \u201ca complete change in perspective\u201d concerning rescue generally. <\/span><\/p>\n

\u201cI used to be part of a cult,\u201d Davis said, referring to those who participate in rescue as a whole. She also accused her former mentor <\/span>Calvin Zastrow<\/span><\/a> of being \u201ca cult leader.\u201d<\/span><\/p>\n

Using the pseudonym \u201cTina Smith,\u201d the WSC clinic administrator testified on Thursday morning. She, too, <\/span>testified<\/span><\/a> in the previous trial. Smith said she has been working at WSC since 1988, and that the facility sees a variety of \u201cpatients,\u201d including the \u201cseven-year-old kid who has been raped.\u201d However, she failed to elaborate on what an abortion facility could possibly do for a child that young.\u00a0<\/span><\/p>\n

Smith, as in the last trial, touted her alleged Catholic faith, pulling out the rosary she wears as a necklace, and stating that Our Lady of Sorrows is her patron saint. This is particularly ironic, as Our Lady of Sorrows has been frequently <\/span>invoked<\/span><\/a> in prayerful pro-life efforts. One <\/span>prayer<\/span><\/a> to Our Lady of Sorrows asks \u201c[t]hat the parents, grandparents and health care professionals who kill the innocent by abortion may receive the strength to seek Christ\u2019s forgiveness.\u201d<\/span><\/p>\n

Smith characterized the rescuers as \u201caggressors\u201d who used various tactics to \u201charass\u201d WSC\u2019s clients. She claimed rescuers used prayer, in particular, as a method of harassment, saying activists were only praying \u201cto make [clients] feel guilty.\u201d\u00a0<\/span><\/p>\n

Smith also admitted that her co-worker, \u201c<\/span>Sasha Proctor<\/span><\/a>,\u201d shoved defendants as they tried to enter WSC and clarified that the implement she used to repel the rescuers as they entered the facility was a mop, not a broomstick, as has been previously reported. Herb Geraghty, who was a defendant in the previous trial, <\/span>testified<\/span><\/a> that Smith used the mop to jab activists, not merely to \u201chold the line\u201d as she claimed on Thursday.<\/span><\/p>\n

The prosecution rested following Smith\u2019s testimony.\u00a0<\/span><\/p>\n

All three defendants chose not to testify. Joan Andrews Bell, who represented herself, chose not to give a closing statement. Marshall\u2019s and Darnel\u2019s attorneys both presented their closing statements Thursday with arguments underscoring what they described as uncertainty surrounding their clients\u2019 roles and intentions during the Oct. 2020 rescue. The defense also criticized former rescuer Caroline Davis. The government\u2019s rebuttal highlighted communications from defendant Jonathan Darnel in which he discussed the prospect for arrests and breaking the law.\u00a0<\/span><\/p>\n

Jury instructions are scheduled for Friday.<\/span><\/p>\n
