(NRL News Today<\/a>) On August 11, after hearing arguments from lawyers for Planned Parenthood of the Heartland and the Nebraska Attorney General\u2019s Office, Lancaster County District Court\u00a0Judge Lori Maret sided with the state<\/a>.<\/p>\n

Plaintiffs had requested that a preliminary injunction be placed on the \u201cLet Them Grow Act\u201d and the accompanying law protecting the unborn at 12-weeks and beyond with the exception of rape, incest, and life of the mother.<\/p>\n

The final version of LB 574 that was signed into law in May immediately went into effect.<\/p>\n

Erin Bamer reported<\/a>\u00a0\u201cThe Nebraska Supreme Court announced Wednesday that it overruled a request by Planned Parenthood of the Heartland, backed by the American Civil Liberties Union of Nebraska, for a temporary injunction that would have halted Legislative Bill 574 during the time the case was considered.\u201d<\/p>\n

The law \u201cstill could be blocked if the court sides with Planned Parenthood\u2019s argument that LB 574 violates a provision of the Nebraska Constitution which states a bill shall contain no more than one subject,\u201d\u00a0according to Bamer<\/a>. \u201cThe next court date has not been set yet.\u201d<\/p>\n

Background<\/strong><\/p>\n

Attorneys for Planned Parenthood of the Heartland had argued that when the \u201cPreborn Child Protection Act\u201d \u2014Amendment 1568\u2014was attached to the \u201cLet Them Grow Act\u201d \u2014LB 574\u2014on May 16, it violated the Nebraska Constitution\u2019s requirement that legislation be confined to a single subject.<\/p>\n

However, the Nebraska Attorney General\u2019s Office maintained that LB 574 \u201cfirmly withstands\u201d questions about its constitutionality because the two matters both deal with public health and welfare.<\/p>\n

\u201cPlaintiffs (Planned Parenthood) rely on case law that is often inapplicable, distinguishable, or plainly stands against its proffered outcome,\u201d wrote the Attorney General\u2019s office. According to reporter Paul Hammel, Attorney General Erik Fernit\u2019s brief maintains it is \u201cirrelevant how LB 574 got passed and that the court needs only to consider \u2018the end result.\u2019\u201d<\/p>\n

Responding to Judge Maret\u2019s decision to upholds the state\u2019s position, Gov. Jim Pillen said, \u201cI am grateful for the court\u2019s thorough decision.\u201d He went to say, \u201cI was proud to sign into law a measure that protects kids and defends the unborn, and I am pleased that it has been upheld. Thank you to the Attorney General and his litigation team for defending this important law.\u201d<\/p>\n

Nebraska Attorney General Mike Hilgers added, \u201cWe are thankful for the court\u2019s thoughtful analysis and recognition of the Legislature\u2019s prerogatives and processes. As a result of today\u2019s order, LB 574 remains law in Nebraska.\u201d<\/p>\n

Richardson called Judge Maret\u2019s decision a \u201cdevastating blow to Nebraskans\u2019 fundamental right to make what should be private decisions between them and their doctors.\u201d<\/p>\n

Earlier this year, a bill to protect unborn children after the 6th week fell short by a single vote of overcoming a filibuster.<\/p>\n
