{"id":298349,"date":"2023-09-12T14:38:55","date_gmt":"2023-09-12T19:38:55","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=298349"},"modified":"2023-09-12T14:03:07","modified_gmt":"2023-09-12T19:03:07","slug":"fda-seeks-supreme-court-review-abortion-pill","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/fda-seeks-supreme-court-review-abortion-pill\/","title":{"rendered":"FDA seeks Supreme Court review of lower court&#8217;s abortion pill ruling"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>The Food and Drug Administration (FDA) is asking the U.S. Supreme Court to review a lower court <a href=\"https:\/\/archive.liveaction.org\/news\/court-fda-abortion-pill-safety-supreme\/\" target=\"_blank\" rel=\"noopener\">ruling<\/a> in the <em><a href=\"https:\/\/adfmedia.org\/case\/alliance-hippocratic-medicine-v-us-food-and-drug-administration\" target=\"_blank\" rel=\"noopener\">Alliance for Hippocratic Medicine (AHM) v. FDA<\/a><\/em> lawsuit, which would roll back expanded use of the abortion pill while a challenge to FDA&#8217;s approval of the pill is being heard. In August, the Fifth Circuit ruling returned FDA safety requirements on the abortion pill to those which existed prior to 2016, while the case was litigated.<\/p>\n<p>Danco, the abortion pill&#8217;s manufacturer (which profits off the sales of abortion pills and appears to have <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-industry-abortion-pill-fda-limits\/\" target=\"_blank\" rel=\"noopener\">failed to enforce<\/a> safety requirements put in place by the FDA), has also <a href=\"https:\/\/www.documentcloud.org\/documents\/23945087-danco-mifepristone-filing\" target=\"_blank\" rel=\"noopener\">filed<\/a> a brief before the high court.<\/p>\n<p>The abortion pill mifepristone was\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/fda-abortion-pill-timeline-events\/\" target=\"_blank\" rel=\"noopener\">approved<\/a> by the FDA in 2000, to be prescribed in-person through the 7th week of pregnancy. In 2016, the FDA removed requirements that all adverse non-fatal events be reported, allowed the pill to be prescribed through the 10th week of pregnancy, removed the requirement that only physicians prescribe the drug, and no longer required women to take the first pill at the facility.<\/p>\n<p>In 2021, the FDA eliminate the <a href=\"https:\/\/archive.liveaction.org\/news\/fda-removes-abortion-pill-safety-protocols-drug\/\" target=\"_blank\" rel=\"noopener\">in-person dispensing requirement<\/a> and enabled the abortion pill to be permanently <a href=\"https:\/\/archive.liveaction.org\/news\/fda-permanently-loosens-abortion-pill-safety-measure\/\" target=\"_blank\" rel=\"noopener\">shipped by mail<\/a>. Then in 2023, FDA expanded access further to <a href=\"https:\/\/archive.liveaction.org\/news\/fda-retail-pharmacies-abortion-pills-prescription\/\" target=\"_blank\" rel=\"noopener\">allow retail pharmacies to dispense the drug<\/a>.<\/p>\n<div id=\"attachment_298424\" style=\"width: 893px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-298424\" decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-298424\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/FDA-and-Danco-file-briefs-to-SCOTUS-in-abortion-pill-lawsuit.jpg\" alt=\"FDA and Danco file briefs to SCOTUS in abortion pill lawsuit\" width=\"883\" height=\"346\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/FDA-and-Danco-file-briefs-to-SCOTUS-in-abortion-pill-lawsuit.jpg 883w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/FDA-and-Danco-file-briefs-to-SCOTUS-in-abortion-pill-lawsuit-300x118.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/FDA-and-Danco-file-briefs-to-SCOTUS-in-abortion-pill-lawsuit-700x274.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/FDA-and-Danco-file-briefs-to-SCOTUS-in-abortion-pill-lawsuit-768x301.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/09\/FDA-and-Danco-file-briefs-to-SCOTUS-in-abortion-pill-lawsuit-500x196.jpg 500w\" sizes=\"(max-width: 883px) 100vw, 883px\" \/><p id=\"caption-attachment-298424\" class=\"wp-caption-text\">FDA and Danco file briefs to SCOTUS in abortion pill lawsuit<\/p><\/div>\n<p><strong>Background<\/strong><\/p>\n<p>The lawsuit was <a href=\"https:\/\/lozierinstitute.org\/what-is-the-truth-about-the-alliance-for-hippocratic-medicine-v-u-s-food-and-drug-administration-lawsuit\/\" target=\"_blank\" rel=\"noopener\">initiated<\/a> In November of 2022 by the Alliance for Hippocratic Medicine (AHM), a group of medical doctors and organizations who claimed the 2000 approval of the drug was illegal and the expanded use of the abortion pill was <a href=\"https:\/\/archive.liveaction.org\/news\/doctors-alarm-abortion-pill-complications\/\" target=\"_blank\" rel=\"noopener\">unsafe<\/a>.\u00a0 The doctors <a href=\"https:\/\/archive.liveaction.org\/news\/doctors-fda-abortion-pill-decades-medical-negligence\/\" target=\"_blank\" rel=\"noopener\">testified<\/a> to treating women with severe complications \u2014 \u201cmany who presented to the emergency room.\u201d<\/p>\n<p>On April 7, 2023, U.S. District Court Judge Matthew J. Kacsmaryk <a href=\"https:\/\/archive.liveaction.org\/news\/district-court-judge-revoke-fda-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">ruled<\/a> in favor of the Plaintiffs to immediately suspend the 2000 approval and subsequent FDA changes to the abortion pill. But the case was appealed to the U.S. Court of Appeals for the Fifth Circuit, which issued a partial stay.<\/p>\n<p>&#8220;After the 5th Circuit put only part of Kacsmaryk\u2019s order on hold, the Biden administration and Danco went to the Supreme Court, asking the justices to freeze the entire order to maintain the status quo until the dispute is resolved. The justices agreed to do so in a brief unsigned order on April 21, with two justices \u2013 Justices Clarence Thomas and Samuel Alito \u2013 indicating that they would have denied the request,&#8221; <a href=\"https:\/\/www.scotusblog.com\/2023\/09\/federal-government-and-drug-manufacturer-ask-court-to-review-ruling-restricting-access-to-abortion-medication\/\" target=\"_blank\" rel=\"noopener\">ScotusBlog.com<\/a> wrote. That <a href=\"https:\/\/www.washingtonpost.com\/documents\/9448e000-0ac3-4d9d-962f-85bb3e78194d.pdf?itid=lk_inline_manual_8\" target=\"_blank\" rel=\"noopener\">order<\/a>\u00a0from the\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/supreme-court-abortion-pill-market\/\" target=\"_blank\" rel=\"noopener\">U.S. Supreme Court<\/a>\u00a0allowed mifepristone to remain on the market while legal proceedings continued.<\/p>\n<p>AHM\u2019s case <a href=\"https:\/\/archive.liveaction.org\/news\/judges-abortion-pill-approval-pregnancy-illness\/\" target=\"_blank\" rel=\"noopener\">went back<\/a> to the Fifth Circuit which heard oral arguments in May. A <a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-10362-CV1.pdf\">62-page decision<\/a> issued August 16, 2023, by the Appeals Court <a href=\"https:\/\/archive.liveaction.org\/news\/court-fda-abortion-pill-safety-supreme\/\" target=\"_blank\" rel=\"noopener\">ruled<\/a> to allow mifepristone to remain \u201cavailable to the public under the conditions for use that\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/fda-abortion-pill-timeline-events\/\" target=\"_blank\" rel=\"noopener\">existed<\/a>\u201d\u00a0<em>prior to 2016<\/em>. The decision would therefore remove mail order and <a href=\"https:\/\/archive.liveaction.org\/news\/fda-retail-pharmacies-abortion-pills-prescription\/\" target=\"_blank\" rel=\"noopener\">pharmacy dispensing<\/a> of the drug while leaving in place the FDA\u2019s 2000 approval as well as its 2019 approval of the generic version (GenBioPro). and that &#8220;respondents\u2019 asserted injuries cannot remotely justify the disruptive alteration of the status quo&#8230;&#8221;<\/p>\n<p>Danco&#8217;s <a href=\"https:\/\/www.documentcloud.org\/documents\/23945087-danco-mifepristone-filing\" target=\"_blank\" rel=\"noopener\">brief<\/a> alleged the Appeal Court&#8217;s ruling was &#8220;flawed, and equally in conflict&#8221; with previous Supreme Court decisions. &#8220;This case presents a serious question: whether courts can disregard constitutional and statutory limits on judicial review of executive action in order to overrule an agency decision they dislike,&#8221; Danco&#8217;s <a href=\"https:\/\/www.documentcloud.org\/documents\/23945087-danco-mifepristone-filing\" target=\"_blank\" rel=\"noopener\">brief<\/a> claimed.<\/p>\n<p>Danco claimed their case was of &#8220;indisputable importance&#8221; because &#8220;women and teenage girls, health care providers, and States&#8221; allegedly &#8220;depend on FDA\u2019s actions to ensure safe and effective reproductive health care is available&#8221; and suggesting the Fifth Circuit&#8217;s ruling &#8220;will create tremendous negative effects, including pushing women to later gestational age surgical abortions or <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-failure-prone-abortion-drug\/\" target=\"_blank\" rel=\"noopener\">unapproved regimens<\/a> with more complications, and impeding access to miscarriage management.&#8221;<\/p>\n<p><strong>Issue of Standing<\/strong><\/p>\n<p>&#8220;The district court&#8230; rejected the government\u2019s arguments that respondents lack standing, and that their challenge to the 2000 approval of mifepristone was untimely,&#8221; the FDA acknowledged in its brief.<\/p>\n<p>&#8220;The Fifth Circuit first held that respondents have Article III standing to challenge FDA\u2019s decisions with respect to branded mifepristone&#8230; The court accepted respondents\u2019 contention that treating women who take mifepristone and experience complications constitutes a cognizable injury because doctors who treat such patients may provide care that violates their consciences, may be &#8216;forced to divert time and resources away from their regular patients,&#8217; and may be &#8216;expose[d] * * * to greater liability and increased insurance costs,&#8217;\u201d the court document explained.<\/p>\n<p>But the FDA went on to argue that &#8220;the Fifth Circuit erred in holding that the respondent associations have standing.&#8221;<\/p>\n<p>&#8220;Respondents oppose abortion and therefore oppose the use of mifepristone. But respondents &#8216;are not required to receive&#8217; or prescribe mifepristone, and &#8216;[t]hey do not have standing to challenge FDA\u2019s decision to allow other people to receive&#8217; or prescribe the drug because that decision does not impose any concrete, particularized, or imminent harm on them,&#8221; the Government claimed.<\/p>\n<p><strong>FDA\u2019s Actions Arbitrary and Capricious<\/strong><\/p>\n<p>&#8220;On the merits, the court held that FDA\u2019s actions were arbitrary and capricious under the Administrative Procedure Act. The court separately held that statutory provisions derived from the <a href=\"https:\/\/archive.liveaction.org\/news\/lawsuit-new-mexico-comstock-act\/\" target=\"_blank\" rel=\"noopener\">1873 Comstock Act<\/a> barred FDA from removing the in-person dispensing requirement,&#8221; the FDA noted.<\/p>\n<p>The FDA then argued that &#8220;FDA\u2019s actions were supported by an exhaustive review of a record including dozens of scientific studies and decades of safe use of mifepristone by millions of women in the United States and around the world. The Fifth Circuit swept aside the agency\u2019s expert judgments based on novel requirements that have no basis in the FDCA or the Administrative Procedure Act.&#8221;<\/p>\n<p>But the FDA failed to mention that many <a href=\"https:\/\/archive.liveaction.org\/news\/media-abortion-experts-payroll-manufacturers\/\" target=\"_blank\" rel=\"noopener\">authors<\/a> and organizations behind these &#8220;studies&#8221; had <a href=\"https:\/\/archive.liveaction.org\/news\/tangled-web-money-deception-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">direct ties<\/a> to abortion pill manufacturers Danco and GenBioPro, or to the <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-money-trail-abortion-pill-corruption\/\" target=\"_blank\" rel=\"noopener\">investors<\/a> that funded them.<\/p>\n<p>The FDA described any claim of harm by the pro-life doctors as a &#8220;speculative chain of possibilities,&#8221; also noting that &#8220;the Fifth Circuit held that respondents are likely to succeed on their claims that FDA\u2019s 2016 and 2021 actions were arbitrary and capricious,&#8221; according to the court document.<\/p>\n<p><strong>Complication Issues<\/strong><\/p>\n<p>&#8220;The Fifth Circuit relied on respondents\u2019 allegation that some of their members have treated complications from mifepristone in the past,&#8221; the FDA argued, adding that &#8220;respondents alleged only a handful of incidents.&#8221;<\/p>\n<p>&#8220;And in the rare cases where the result of those independent actions is a serious adverse event requiring medical treatment, FDA\u2019s actions neither require patients to seek treatment from respondents\u2019 members nor require respondents\u2019 members to provide it,&#8221; FDA claimed.<\/p>\n<p>But, again, the FDA&#8217;s brief failed to point out that the abortion industry (many who are approved by Danco to dispense the drug), <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-abortion-pill-fda-ectopic\/\" target=\"_blank\" rel=\"noopener\">openly defy<\/a> the FDA&#8217;s REMS safety regulations by not providing assistance to women with abortion pill complications and instead <a href=\"https:\/\/archive.liveaction.org\/news\/bad-actors-conceal-abortion-pill-complications\/\" target=\"_blank\" rel=\"noopener\">telling abortion clients<\/a> to simply present to emergency rooms and <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-groups-tell-women-lie-miscarriage\/\" target=\"_blank\" rel=\"noopener\">lie<\/a> when experiencing abortion pill complications.<\/p>\n<p><strong>2016 Adverse Events Reporting<\/strong><\/p>\n<p>In 2016, FDA removed requirements that all adverse events be reported, so there is no way to even know how many complications there have been. This point <a href=\"https:\/\/archive.liveaction.org\/news\/judges-abortion-pill-approval-pregnancy-illness\/\" target=\"_blank\" rel=\"noopener\">drew the attention<\/a> of Judge James Ho at the Fifth Circuit when he asked why the FDA would remove the non-fatal adverse events reporting \u201cright when you were expanding its use.\u201d<\/p>\n<p>\u201cWhy deprive the world of that information?\u201d he asked.<\/p>\n<p>&#8220;The court further held that FDA acted arbitrarily in changing the adverse-event reporting requirement in 2016&#8230;The court stated that, although FDA had determined that the risks associated with mifepristone were &#8216;well known&#8217; by 2016, FDA had &#8216;failed to account for&#8217; the possibility that the 2016 changes &#8216;might alter the risk profile,&#8217;\u201d the FDA noted about the Appeals Court&#8217;s ruling.<\/p>\n<p>&#8220;In any event, even if the Fifth Circuit were correct that FDA acted arbitrarily and capriciously in eliminating the special adverse-event reporting requirement that previously applied to mifepristone, the only relief that such an error could justify would be an order requiring FDA to reinstate that requirement or explain more fully why it is unnecessary. The asserted error would provide no basis for suspending the changes to mifepristone\u2019s approved conditions of use,&#8221; the FDA alleged.<\/p>\n<p><strong>The Record<\/strong><\/p>\n<p>The FDA claimed, &#8220;The court of appeals pointed to no studies or other reliable evidence suggesting that FDA\u2019s 2016 and 2021 actions have had a substantial effect on the likelihood of adverse events that would require women to seek emergency care from respondents or their members. In fact, the record demonstrates that serious adverse events remain extremely infrequent with the relevant actions in place,&#8221; FDA claimed.<\/p>\n<p>But the full &#8220;<a href=\"https:\/\/archive.liveaction.org\/news\/judge-fda-delay-documents-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">record<\/a>&#8221; <em>has not even been submitted to the Court<\/em> \u2014 something Court of Appeals Judge Jennifer Walker alluded to in her <a href=\"https:\/\/archive.liveaction.org\/news\/judge-fda-delay-documents-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">questioning<\/a> of the FDA\u2019s legal representative during oral arguments at the Appeals level. The missing documents could likely include correspondence, <a href=\"https:\/\/archive.liveaction.org\/news\/fda-hiding-names-experts-reviewed-abortion-pill\/\" target=\"_blank\" rel=\"noopener\">expert reviews<\/a>, studies,\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/doctor-tied-abortion-pill-trials-medicaid-fraud\/\" target=\"_blank\" rel=\"noopener\">trials<\/a>, or data surrounding the <a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-secrecy-women-deserve-truth\/\" target=\"_blank\" rel=\"noopener\">often<\/a>\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/media-secrecy-abortion-pill-transparency-needed-today\/\" target=\"_blank\" rel=\"noopener\">secretive<\/a>\u00a0abortion pill\u00a0<a href=\"https:\/\/archive.liveaction.org\/news\/abortion-pill-dangerous-safety-requirement\/\" target=\"_blank\" rel=\"noopener\">approval<\/a>\u00a0process.<\/p>\n<p>&#8220;Bits of the record were presented to the courts&#8230; but the full record remains unproduced,&#8221; Danco acknowledged in its brief. &#8220;Instead, the courts&#8230; rushed to award preliminary injunctive relief&#8230; lacking an administrative record,&#8221; Danco argued.<\/p>\n<p><strong>Consequences of Fifth Circuit Decision<\/strong><\/p>\n<p>&#8220;The Fifth Circuit\u2019s decision also has serious consequences for Danco. Mifeprex is Danco\u2019s only product.
