The court <a href=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/08\/Denies-defendants-release-pending-sentencing.pdf\">document<\/a> reads:<\/p>\n<p style=\"padding-left: 40px;\"><em>Defendants have now moved for reconsideration on an emergency basis.2 Defendants argue that 18 U.S.C. \u00a7 248, commonly called the Freedom of Access to Clinic Entrances Act (or FACE Act), is not categorically a crime of violence, because a defendant may violate the statute through nonviolent means.\u00a0<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>Though a point well taken, the Court concludes that the FACE Act creates distinct offenses, some of which are crimes of violence. Because the jury clearly convicted each Defendant on a sub-offense exclusively criminalizing violence against person or property, the Court shall DENY the [387] and [389] Emergency Motions for Reconsideration&#8230;.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>If the jury returned a guilty verdict only as to \u201cphysical obstruction,\u201d the Court would conclude that the jury convicted a Defendant under subsection (b)(2). Because the jury returned a guilty verdict as to \u201cforce,\u201d the jury convicted each Defendant of a crime of violence. The jury having done so, the Court has no choice but to order Defendants detained pending sentencing. Accordingly, and for the foregoing reasons, it is hereby ORDERED, that Defendant Handy\u2019s [387] Emergency Motion for Reconsideration and Defendant Idoni\u2019s [389] Emergency Motion for Reconsideration are DENIED. SO ORDERED. Dated: August 31, 2023.<\/em><\/p>\n<p><span style=\"font-weight: 400;\"><strong>8\/30\/23:<\/strong> Lauren Handy and her attorney from the Thomas More Society filed an emergency motion Wednesday, arguing that the judge in the case, Judge Colleen Kollar-Kotelly, improperly applied a law surrounding crimes of violence when <a href=\"https:\/\/archive.liveaction.org\/news\/defendants-dc-face-act-detained-convicted\/\">she sent Handy (and four other pro-lifers) to jail<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As Live Action News previously <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/defendants-dc-face-act-detained-convicted\/\"><span style=\"font-weight: 400;\">reported<\/span><\/a><span style=\"font-weight: 400;\">, the Justice Department argued after Tuesday\u2019s verdict that Handy and her co-defendants engaged in a \u201ccrime of violence,\u201d which led to their incarceration. But Handy\u2019s <\/span><a href=\"https:\/\/uploads-ssl.webflow.com\/63d954d4e4ad424df7819d46\/64ef5bbdce382b30a3d33286_%23387%20Emergency%20Motion%20for%20Reconsideration%20of%20Order%20of%20Detention%20Pending%20Imposition%20of%20Sentence.pdf\"><span style=\"font-weight: 400;\">filing<\/span><\/a><span style=\"font-weight: 400;\"> argues that such a determination requires a <\/span><i><span style=\"font-weight: 400;\">categorical<\/span><\/i><span style=\"font-weight: 400;\"> crime of violence, which, it argues, violations of the FACE Act aren\u2019t:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">The FACE Act\u2019s plain text explicitly prohibits using \u201cforce,\u201d \u201cthreat of force,\u201d \u201cor [] physical obstruction\u201d to intentionally injure, intimidate, \u201cor\u201d interfere with another because that person is or has been, or to intimidate such person from, obtaining or providing reproductive health services. 18 U.S.C. \u00a7 248(a)(1) (emphasis added). Thus, by its plain terms the FACE Act does not \u201calways require the government to prove\u2014\u2026 as an element of its case\u2014the use, attempted use, or threatened use of force.\u201d Taylor, 142 S. Ct. at 2020. <\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">Specifically, the government can prove a completed FACE violation by showing, in part, that the defendant engaged in \u201cphysical obstruction\u201d regardless of whether the person used actual or threatened force. The Act specifically distinguishes \u201cphysical obstruction\u201d from \u201cforce\u201d and \u201cthreat of force,\u201d defining \u201cphysical obstruction\u201d to mean \u201crendering impassable ingress to or egress from a\u201d reproductive health facility, or rendering such passage \u201cunreasonably difficult or hazardous.\u201d 18 U.S.C. \u00a7 248(e)(4).\u00a0 <\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">Additionally, to prove a FACE violation, the government also need not show that one intended to injure another. A person violates the FACE Act if he or she merely intended to \u201cinterfere with\u201d another, even if he does not intend or cause any injury. 18 U.S.C. \u00a7 248(a)(1) (emphasis added). Even acting with the mere intent to injure is not a categorical \u201ccrime of violence.\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">The jury found Handy and her co-defendants guilty of violating the FACE Act with provisions involving the use of force and physical obstruction.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">DOJ had argued the defendants committed a crime of violence under 18 U.S. Code \u00a7 3156, which defines a crime of violence as \u201can offense that has as an element of the offense the use, attempted use, or threatened use of physical force against the person or property of another\u201d and \u201cany other offense that is a felony and that, by its nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thomas More Society Senior Counsel Steve Crampton blasted the decision, saying, \u201cIn an unexpected twist, the Court found that because the violation of FACE \u2014 in this case \u2014 was a crime of \u2018violence,\u2019 all five defendants must be immediately incarcerated. So, the defendants were led out of the courtroom by an army of U.S. Marshals.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis is an outrage, and the one thing the defendants had really agreed upon was to remain non-violent. The real violence is what happens during the abortion procedure.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Wednesday\u2019s filing adds that Handy shouldn\u2019t be detained because she isn\u2019t a flight risk. \u201cMs. Handy also does not pose a flight risk,\u201dthe filing reads.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cOn March 30, 2022, this Court set conditions of release for Ms. Handy pending her trial. Since then, Ms. Handy had not violated any conditions of her release and had appeared for every scheduled court proceeding.
