{"id":297057,"date":"2023-08-25T12:40:05","date_gmt":"2023-08-25T17:40:05","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=297057"},"modified":"2023-08-25T12:48:47","modified_gmt":"2023-08-25T17:48:47","slug":"planned-parenthood-admits-employees-spoke-words-videos","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/planned-parenthood-admits-employees-spoke-words-videos\/","title":{"rendered":"Planned Parenthood admits to SCOTUS that its employees &#8216;spoke the words recorded&#8217; in undercover videos"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>The Center for Medical Progress (CMP) has continued its years-long battle against Planned Parenthood, appealing a lawsuit in which the abortion giant was <a href=\"https:\/\/archive.liveaction.org\/news\/judge-ties-planned-parenthood-13-million-fees\/\" target=\"_blank\" rel=\"noopener\">awarded<\/a> $16 million in fees. David Daleiden and Sandra Merritt, the CMP investigators in the midst of the legal fight, are in the process of appealing the award with the <a href=\"https:\/\/archive.liveaction.org\/news\/pro-life-undercover-investigator-planned-parenthood-court\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> \u2014 and Planned Parenthood appears to have dropped a bombshell.<\/p>\n<p>In a <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22-1168\/275974\/20230822165715642_22-1168--CMP%20-%20FINAL%20BIO%2008-22%20rtf.pdf\" target=\"_blank\" rel=\"noopener\">filing<\/a> opposing CMP&#8217;s, Planned Parenthood admitted that its employees and executives, filmed in undercover CMP videos showing them discussing the sale of the body parts of aborted babies, actually &#8220;spoke the words recorded in the videos.&#8221;<\/p>\n<p>According to an emailed press release, &#8220;it is the first time Planned Parenthood has acknowledged the authenticity of the footage to the Supreme Court.&#8221; CMP&#8217;s videos, including full footage, can be found <a href=\"https:\/\/www.youtube.com\/@TheCenterforMedicalProgress\/videos\">here<\/a>.<\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/jjxwVuozMnU?si=G7WGAmyj3Z4-Oyob\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>Planned Parenthood argued in the filing that CMP should be forced to pay the $16 million \u2014 not because of any falsification of the videos or their content, but <em>because they gained access to the Planned Parenthood executives through deception<\/em> (emphases added):<\/p>\n<p style=\"padding-left: 25px;\"><em>When a plaintiff asserts defamation and nondefamation claims side-by-side, based on the same conduct and statements and alleging the same injury, the actual-malice standard plainly applies. Here, however, respondents did not assert defamation and non- defamation claims in parallel. Nor are respondents\u2019 claims based on facts that would have supported an unpled defamation claim. <strong>Respondents \u201cstipulated\u201d that the individuals in the videos \u201cspoke the words recorded in the videos,\u201d<\/strong> Planned Parenthood, 2022 WL 13613963, at *4, and <strong>petitioners violated the law not by publishing videos, but by producing and transferring fake IDs, lying to gain access to respondents\u2019 conferences, clinics, and staff, and recording surreptitious videos without consent<\/strong>.<\/em><\/p>\n<p>This is a marked difference from Planned Parenthood&#8217;s past statements.<\/p>\n<p>Planned Parenthood has long claimed the CMP videos are fake, calling Daleiden&#8217;s investigation a &#8220;<a href=\"https:\/\/www.plannedparenthood.org\/about-us\/newsroom\/press-releases\/david-daleidens-campaign-of-deception-against-planned-parenthood\" target=\"_blank\" rel=\"noopener\">campaign of deception<\/a>&#8221; and saying the videos were &#8220;<a href=\"https:\/\/www.plannedparenthood.org\/about-us\/newsroom\/press-releases\/daleiden-admits-to-deceptively-editing-videos\" target=\"_blank\" rel=\"noopener\">deceptively edited<\/a>.&#8221; Yet what Planned Parenthood says to the public and what they tell the courts are two different things; under oath, they will admit to the validity of the statements heard on the videos, <a href=\"https:\/\/archive.liveaction.org\/news\/bombshell-planned-parenthood-admits-oath-aborted-parts\/\">as can also be seen here<\/a>.<\/p>\n<p><a href=\"https:\/\/archive.liveaction.org\/news\/faked-criminal-videos-planned-parenthood-lies-again-on-twitter\/\" target=\"_blank\" rel=\"noopener\">Forensic analyses<\/a>, including from a firm hired by Planned Parenthood, found that the videos had not been faked.<\/p>\n<p>Judge William Orrick, who awarded Planned Parenthood the $16 million, <a href=\"https:\/\/archive.liveaction.org\/news\/center-medical-progress-files-motion-disqualify-judge\/\" target=\"_blank\" rel=\"noopener\">has ties<\/a> to the abortion giant, and was one of over 100 judges in a Wall Street Journal <a href=\"https:\/\/archive.liveaction.org\/news\/judge-planned-parenthood-pro-life-wsj-investigation\/\" target=\"_blank\" rel=\"noopener\">investigation<\/a> accused of violating U.S. law and judicial ethics by overseeing court cases involving companies in which the judges were involved.
