The five defendants are charged with a felony count of conspiracy against civil rights as well as violations of the <\/span><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/248\"><span style=\"font-weight: 400;\">FACE Act<\/span><\/a><span style=\"font-weight: 400;\">. Each faces a grand total of 11 years in prison (10 years for conspiracy and one year for FACE Act violations). <\/span><\/p>\n<p><span style=\"font-weight: 400;\">During the proceedings, the judge further revealed a strong pro-abortion bias.<\/span><\/p>\n<p><b>LAUREN HANDY\u2019S DEFENSE<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The day began with attorney Martin Cannon presenting Lauren Handy\u2019s defense. Handy testified, giving general details about her background. \u201cMy parents taught me, if you see someone who needs help, it\u2019s your duty to help them,\u201d Handy stated. She said that she got into pro-life activism out of a desire to help mothers and babies, and emphasized her commitment to non-violence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although <a href=\"https:\/\/archive.liveaction.org\/news\/federal-judge-13th-amendment-right-abortion\/\">Judge Kollar-Kotelly<\/a> will not allow Live Action\u2019s <\/span><a href=\"https:\/\/youtu.be\/NxOWyumLufA\"><span style=\"font-weight: 400;\">InHuman<\/span><\/a><span style=\"font-weight: 400;\"> undercover investigation video \u2013 which she described at various points in the day as \u201cpropaganda\u201d and \u201cgossip from propagandists\u201d and which the prosecution described as \u201c<\/span><a href=\"https:\/\/youtu.be\/DHjclypoBD4\"><span style=\"font-weight: 400;\">heavily edited<\/span><\/a><span style=\"font-weight: 400;\">\u201d \u2013 to be played in the courtroom, Handy was allowed to describe its impact on her. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this video, Washington Surgi-Clinic abortionist Cesare Santangelo says that if a child was born alive in his facility during an abortion, \u201cwe would not help it.\u201d Handy testified that it was this video which shaped her belief that abortion survivors at Santangelo\u2019s facility would be left to die.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/NxOWyumLufA\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">Judge Kollar-Kotelly disallowed Handy from going into specifics \u2013 such as statistics \u2013 pulled from Handy\u2019s research on the types of later abortions committed by Santangelo at the Washington Surgi-Clinic. Specifically disallowed was discussion about the details of a Society of Family Planning <\/span><a href=\"https:\/\/www.contraceptionjournal.org\/article\/S0010-7824(11)00057-6\/fulltext\"><span style=\"font-weight: 400;\">study<\/span><\/a><span style=\"font-weight: 400;\"> (a pro-abortion group) showing that <\/span><a href=\"https:\/\/www.abortionprocedures.com\/induction\/?__hstc=61024563.1ab9addbb25769f4498e7dbae7999642.1680279399074.1692745596779.1692749078682.290&amp;__hssc=61024563.10.1692749078682&amp;__hsfp=227396315\"><span style=\"font-weight: 400;\">induction<\/span><\/a><span style=\"font-weight: 400;\"> abortions committed past 18 weeks\u2019 gestation and without the use of feticide (like those committed by Santangelo) have up to a 50% chance of \u201ctransient fetal survival.\u201d In other words, up to half of these abortions might involve a born-alive survivor. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Handy was only allowed to say that her research had influenced her beliefs about what could be happening at the Washington Surgi-Clinic in a general way.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Handy denied the prosecution\u2019s allegation that she blocked facility entrances during the rescue action on October 22, 2020.<\/span><\/p>\n<p><b>HEATHER IDONI\u2019S DEFENSE<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Next to take the stand in her own defense was Heather Idoni. She, too, gave general details about her background, both personally and professionally. She described her joy at being a mother to her own biological children as well as her many adopted children. She stated that she is a Messianic Jew, and that it is her faith that called her to go stand on the sidewalks in front of abortion facilities \u201chundreds of times\u201d to offer support and options to abortion-seeking women. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">She said she is \u201cpassionate about helping those who have no one to help them\u201d and those who have no voice.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Idoni cited Proverbs 24:10-12 as the foundation for her commitment to protecting the preborn, paraphrasing the text, which <\/span><a href=\"https:\/\/www.biblegateway.com\/passage\/?search=Proverbs+24%3A10-12&amp;version=RSVCE\"><span style=\"font-weight: 400;\">reads<\/span><\/a><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">If you faint in the day of adversity,<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0your strength is small.<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">Rescue those who are being taken away to death;<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0hold back those who are stumbling to the slaughter.<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">If you say, \u201cBehold, we did not know this,\u201d<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0does not he who weighs the heart perceive it?<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">Does not he who keeps watch over your soul know it,<\/span><\/i><\/p>\n<p style=\"padding-left: 40px;\"><i><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0and will he not requite man according to his work?<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Prosecution attorney Sanjay Patel\u2019s tone on Idoni\u2019s cross examination was condescending, even derisive. Patel repeatedly mocked Idoni over her statement that pro-life activist Joan Bell is one of her personal heroes, for example. When Idoni said she didn\u2019t recall a particular detail about which Patel was questioning her, Patel responded, \u201cThat\u2019s convenient.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Judge Kollar-Kotelly twice warned Patel about his sarcastic remarks.<\/span><\/p>\n<p><b>HERB GERAGHTY\u2019S DEFENSE<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Last to take the stand today was defendant Herb Geraghty, who, like the two defendants testifying earlier, emphasized a commitment to non-violence: \u201cI am totally and utterly opposed to violence in all its forms,\u201d Geraghty stated.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Also emphasized was Geraghty\u2019s non-participation in blocking the entrances to the Washington Surgi-Clinic. \u201cMy intention was to go to the Washington Surgi-Clinic and speak to patients going in and let them know there are other options,\u201d Geraghty said. Geraghty, in fact, left the facility before any arrests were made and was not arrested on that day.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Geraghty, like Handy, cited Live Action\u2019s InHuman video as informing the belief that abortion survivors were being left to die at Santangelo\u2019s abortion facility and as therefore being a motivating factor behind the rescue action in October 2020.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Upon cross-examination, government attorney Patel\u2019s tone was again condescending and mocking. Patel asked Geraghty to confirm that abortion is legal without limits in the District of Columbia. Geraghty clarified that <em>some<\/em> abortions are legal, but others are outlawed, including partial-birth abortion, or <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/partial-birth-abortion-horror-revisited-nurse-tells-grisly-tale-of-the-procedure\/\"><span style=\"font-weight: 400;\">D&amp;X<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There was a small argument between the judge and respective counsel for both sides following this. Judge Kollar-Kotelly seemed to dispute the fact that there is a federal law prohibiting D&amp;X nationwide, including in D.C. Such a <\/span><a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1857800\/\"><span style=\"font-weight: 400;\">law<\/span><\/a> <strong>does<\/strong><span style=\"font-weight: 400;\">, in fact, exist \u2013 it is called the <\/span><a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/senate-bill\/3\"><span style=\"font-weight: 400;\">Partial Birth Abortion Ban Act<\/span><\/a><span style=\"font-weight: 400;\">, and was passed in 2003 and upheld by the Supreme Court in 2007.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Judge Kollar-Kotelly nonetheless instructed the jury to ignore Geraghty\u2019s comments about the existence of such a law, saying Geraghty was \u201cnot a legal expert.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Geraghty testified to having no intention to break the law on the day of the rescue action.
