The case involved centers around an 1849 law that is believed to protect most preborn children in the state. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, as it outlaws killing \u201cfetuses\u201d but doesn\u2019t specifically state anything about medical \u201cabortions,\u201d <\/span><span style=\"font-weight: 400;\">Judge Diane Schlipper <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/07\/07\/us\/wisconsin-abortion-lawsuit.html#:~:text=In%20her%20preliminary%20ruling%20on,abortion%20ban'%20in%20Wisconsin.%E2%80%9D\"><span style=\"font-weight: 400;\">explained<\/span><\/a><span style=\"font-weight: 400;\"> that she does not believe doctors could be prosecuted for performing an abortion before viability. She wrote,\u00a0<\/span><span style=\"font-weight: 400;\">\u201cThere is no such thing as an \u20181849 abortion ban\u2019 in Wisconsin.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this 1800s law, <\/span><a href=\"https:\/\/www.plannedparenthoodaction.org\/uploads\/filer_public\/08\/20\/08209548-a06b-4dfc-9cd5-73cb4489955d\/wisconsin_abortion_statute_langugage.pdf\"><span style=\"font-weight: 400;\">Section 940.04 states<\/span><\/a><span style=\"font-weight: 400;\">: \u201cAny person, other than the mother, who intentionally destroys the life of an unborn child is guilty of a Class H felony.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2022, after the overturning of <em>Roe v. Wade<\/em>, Wisconsin went back to that statute, essentially eliminating abortion access in the state. This caused an uproar from a group led by Planned Parenthood \u2014 and days after the overturning of <em>Roe<\/em>, protestors stormed the capitol.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It didn\u2019t take more than a minute for <\/span><span style=\"font-weight: 400;\">Republicans\u00a0 to gavel in and out of a special session called at that time by Governor Tony Evers. \u201cWisconsin law has not changed, and our pro-life position has not changed,\u201d State Sen. Devin LeMahieu <\/span><a href=\"https:\/\/spectrumnews1.com\/wi\/madison\/politics\/2022\/06\/22\/gop-rejects-repealing-wisconsin-s-1849-abortion-ban\"><span style=\"font-weight: 400;\">said in a statement<\/span><\/a><span style=\"font-weight: 400;\">. \u201cKilling innocent babies is not health care.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/S-lQOooYAs8\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">Attorney General Joel Urmanski, however, opposes the 1849 law, and more than a year ago, directly after the overturning of <\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\">, mounted a challenge against the law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Gracie Skogman, Legislator and Pac Director for Wisconsin Right to Life, told Live Action News that Wisconsin Right to Life is extremely disappointed. \u201cThe attorney general, who is tasked with enforcing the law, is challenging the law. We [Wisconsin Right to Life] are disappointed to see the case moving forward.
