{"id":29224,"date":"2013-03-24T14:13:55","date_gmt":"2013-03-24T18:13:55","guid":{"rendered":"\/news\/?p=29224"},"modified":"2013-03-25T09:22:58","modified_gmt":"2013-03-25T13:22:58","slug":"federal-judge-blocks-missouri-law-that-protects-the-religious-rights-of-pro-life-missourians","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/federal-judge-blocks-missouri-law-that-protects-the-religious-rights-of-pro-life-missourians\/","title":{"rendered":"Federal Judge blocks Missouri Law that protects the religious rights of pro-life Missourians"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p>A federal judge has struck down a Missouri law that protected pro-life Missourians. <a href=\"http:\/\/hosted.ap.org\/dynamic\/stories\/U\/US_HEALTH_INSURANCE_BIRTH_CONTROL?SITE=AP&amp;SECTION=HOME&amp;TEMPLATE=DEFAULT&amp;CTIME=2013-03-18-19-16-32\">According to the Associated Press<\/a>, U.S. District Judge Audrey Fleissing cited a portion in the U.S. Constitution to the effect that federal laws override contradictory state laws. The Missouri law contradicts President Obama\u2019s health care overhaul by allowing pro-life Missourians to object to providing contraception and some abortion-inducing drugs if they object on religious or moral grounds.<\/p>\n<p><a href=\"http:\/\/www.lifenews.com\/2012\/09\/12\/missouri-legislators-override-nixon-veto-of-pro-life-bill\/\">According to LifeNews.com<\/a>, the Missouri legislature overrode a veto by pro-choice Governor Jay Nixon last September that blocked the law. The House vote was 109 to 45, and the Senate vote was 26 to 6. In December, Fleissing issued an order restraining the law. In the recent ruling, the federal judge wrote that the state law \u201cis in conflict with, and pre-empted by, existing federal law\u201d and \u201ccould force health insurers to risk fines and penalties by choosing between compliance with state or federal laws.\u201d Fleissing did not issue a permanent injunction of the law because the Missouri state insurance department had agreed not to enforce it.<\/p>\n<p>An attorney for Our Lady\u2019s Inn, a St. Louis non-profit that provides housing and counseling for pregnant women, noted that \u201cthe point of the law was to tell health insurance companies that they\u2019re supposed to honor the wishes &#8211; pro or con \u2013 of people who have religious or ethical objections to what\u2019s in the policy.\u201d<\/p>\n<p>Planned Parenthood of Kansas and Mid-Missouri praised the ruling, with President and CEO Peter Brownlie saying it ensured \u201cthat all Missouri women \u2013 no matter who their boss is \u2013 have access to basic preventive health care without a co-pay, including birth control[.]\u201d<\/p>\n<p>Live Action will continue to cover this developing story.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&#8220;Protection&#8221;
