It allowed the pill to remain on the market while the case finished making its way through the court system. The Fifth Circuit is currently reviewing Texas judge Matthew Kacsmaryk\u2019s original <a href=\"https:\/\/archive.liveaction.org\/news\/fda-abortion-pill-timeline-events\/\" target=\"_blank\" rel=\"noopener\">decision<\/a> to upend the FDA\u2019s approval.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Democrats\u2019 <\/span><a href=\"https:\/\/www.murray.senate.gov\/wp-content\/uploads\/2023\/05\/Final_Amicus-Brief.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">brief<\/span><\/a><span style=\"font-weight: 400;\">, filed on May 1, included 203 members of the House and 50 senators. It urged the Fifth Circuit to overturn Kacsmaryk\u2019s decision, arguing that the judge had overstepped his authority by overriding the FDA&#8217;s assertion of expertise on the abortion pill\u2019s safety.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/gnEHZiud8dg\" width=\"640\" height=\"355\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe>\n<\/p>\n<p><span style=\"font-weight: 400;\">\u201cFor decades, the federal judiciary has respected Congress\u2019s delegation of the drug approval process to FDA\u2019s scientists and experts,\u201d the lawmakers\u2019 brief read.\u00a0 \u201cWhile courts have, on occasion, held against FDA on issues related to the market exclusivity that is afforded to a drug sponsor by the statute, it is an extraordinary and unprecedented step for the district court to invalidate on substantive grounds\u2014and over FDA\u2019s objection\u2014a longstanding approval for a drug with a history of safe and effective use.\u00a0 This Court should reverse that aberrant decision and order.\u201d<\/span><\/p>\n<p><a href=\"https:\/\/www.liveaction.org\/walgreens-cvs-petition\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" loading=\"lazy\" class=\"wp-image-283198 size-large aligncenter\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg\" alt=\"Walgreens CVS banner\" width=\"700\" height=\"180\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--300x77.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--768x197.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--500x128.jpg 500w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">They added that Kacsmaryk\u2019s decision would hinder abortion access as well as \u201cdisrupt industry expectations and could chill pharmaceutical research and development.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Republicans, meanwhile, filed in support of Kacsmaryk\u2019s decision and criticized the FDA for, among other things, not adequately considering the impacts of the abortion pill on minor patients. It also cited the Comstock Act, which prohibits mailing certain items like abortion pills.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cBy approving and then deregulating chemical abortion drugs, the FDA failed to follow Congress\u2019 statutorily prescribed drug approval process and subverted Congress\u2019 critical public policy interests in upholding patient welfare,\u201d read the brief, which was filed last week.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It continued, \u201cMoreover, the FDA in 2016 eliminated any requirement that adverse non-fatal medical events resulting from chemical abortion be reported to the FDA, then claimed in its 2021 revision that the absence of reported complications demonstrated that chemical abortion was safe. The FDA\u2019s lawless actions have endangered women and girls seeking chemical abortions, and the Court should affirm the District Court\u2019s ruling.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">From the House, 76 members joined the brief. In total, 18 senators signed on with Pro-Life Caucus Chair Cindy Hyde-Smith (R-Miss.) leading the charge. In April, Republicans <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/congressional-republicans-brief-texas-abortion-pill-ruling\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">filed another brief<\/span><\/a><span style=\"font-weight: 400;\"> with even fewer members signing.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Republicans\u2019 brief came as the party faced an <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/congressional-gop-retreats-federal-protections-preborn\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">internal debate<\/span><\/a><span style=\"font-weight: 400;\"> over how far they should go in restricting abortion. At least one Republican \u2013 Rep. Nancy Mace (R-S.C.) \u2013 went so far as to agree with Rep. Alexandria Ocasio-Cortez (D-N.Y.) in calling on the Biden administration to ignore Kacsmaryk\u2019s decision.
