{"id":290880,"date":"2023-05-13T11:38:44","date_gmt":"2023-05-13T16:38:44","guid":{"rendered":"https:\/\/www.liveaction.org\/news\/?p=290880"},"modified":"2023-05-11T19:55:29","modified_gmt":"2023-05-12T00:55:29","slug":"texas-house-end-rule-patients-death","status":"publish","type":"post","link":"https:\/\/archive.liveaction.org\/news\/texas-house-end-rule-patients-death\/","title":{"rendered":"Texas House votes to end rule believed to allow patients to be unjustly killed"},"content":{"rendered":"<div style=\"margin-top: 0px; margin-bottom: 0px;\" class=\"sharethis-inline-share-buttons\" ><\/div><p><span style=\"font-weight: 400;\">On May 8, the Texas House of Representatives passed a bill that would amend a <a href=\"https:\/\/archive.liveaction.org\/news\/texas-10-day-rule-unethical-institutional-power\/\">notorious state law<\/a> that gives families and patients just 10 days to live while appealing doctors\u2019 decision to remove life support.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Currently, patients in Texas are vulnerable to the decisions of doctors and hospitals to have life-supporting care removed if it is deemed \u201cmedically inappropriate.\u201d Under the current Texas Advance Directives Act (TADA), there is no reporting of this decision, nor any process of appeal. Once this decision has been made, patients have 10 days to find continuing care elsewhere; otherwise, their life-sustaining treatment could be removed against their wishes.\u00a0\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/capitol.texas.gov\/tlodocs\/88R\/billtext\/pdf\/HB03162E.pdf#navpanes=0\"><span style=\"font-weight: 400;\">HB 3162<\/span><\/a><span style=\"font-weight: 400;\">, authored by Rep. Stephanie Klick, would implement pro-life changes to parts of TADA to include the \u201c10-Day Rule.\u201d Importantly, Rep. Klick\u2019s bill would also completely block \u201cquality of life\u201d from being used as a criteria to evaluate the need for continuing treatment. \u201cQuality of life\u201d is a false category frequently applied to other people \u2013 typically the <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/canada-deaths-suicide-increase\/\"><span style=\"font-weight: 400;\">elderly<\/span><\/a><span style=\"font-weight: 400;\"> or <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/leads-people-choose-abortion-due-disability\/\"><span style=\"font-weight: 400;\">disabled<\/span><\/a><span style=\"font-weight: 400;\"> or preborn babies with <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/girl-syndrome-thrives-proving-doctors-wrong\/\"><span style=\"font-weight: 400;\">Down syndrome<\/span><\/a><span style=\"font-weight: 400;\"> \u2013 in order to justify killing them via abortion or euthanasia.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, Rep. Klick\u2019s bill seeks to implement other significant pro-life protections: give families more notice of hospital ethics committee meetings and invite loved ones to sit in; extend the time period from 10 to 25 days for families to seek alternate treatment after the hospital has decided to stop treatment; prevent the process from being used on competent patients; and require hospitals to help loved ones find another point of care for the patient.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2019, the story of baby <a href=\"https:\/\/archive.liveaction.org\/news\/tinslee-texas-opens-eyes-arms-hospital-contrary\/\">Tinslee Lewis<\/a> exposed the unreasonable cruelty of the 10-Day Rule, bringing the issue to national attention and sending waves of shock and outrage worldwide. Tinslee was born prematurely and with a condition in which her heart pressed against her lungs, causing blood to flow partially backwards, making it difficult for her to breathe and requiring her to use a ventilator.<\/span><\/p>\n<p><a href=\"https:\/\/www.liveaction.org\/walgreens-cvs-petition\/\"><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-large wp-image-283198\" src=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg\" alt=\"Walgreens CVS banner\" width=\"700\" height=\"180\" srcset=\"https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--700x180.jpg 700w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--300x77.jpg 300w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--768x197.jpg 768w, https:\/\/archive.liveaction.org\/news\/wp-content\/uploads\/2023\/01\/Keep-Abortion-Pill-Out-Of-Walgreens-CVSLAN-Horizontal--500x128.jpg 500w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">Although she had no profound brain damage, her doctors at Cook Children\u2019s Medical Center argued again and again \u2013 even before the <\/span><a href=\"https:\/\/thetexan.news\/effort-to-end-life-support-for-texan-child-tinslee-lewis-fails-at-supreme-court\/\"><span style=\"font-weight: 400;\">Supreme Court<\/span><\/a><span style=\"font-weight: 400;\"> \u2013 that she had no quality of life, that she was in pain from her diagnosis, and that her condition would never improve. For these reasons, they argued she should be removed from her ventilator as it was medically inappropriate to continue to support her breathing. This meant that her parents had only 10 days to seek medical care elsewhere, which the hospital attempted to <\/span><a href=\"https:\/\/www.fox4news.com\/news\/cook-childrens-argues-out-of-state-doctor-performing-surgery-on-baby-tinslee-would-be-illegal\"><span style=\"font-weight: 400;\">block<\/span><\/a><span style=\"font-weight: 400;\">, before she would be removed from the ventilator. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fortunately the family was able to find continuing care for her. In 2022, defying her doctors\u2019 expectations, Tinslee <\/span><a href=\"https:\/\/archive.liveaction.org\/news\/baby-tinslee-10-day-rule-released-hospital\/\"><span style=\"font-weight: 400;\">went home in Ft. Worth to be with her family<\/span><\/a><span style=\"font-weight: 400;\">, needing only a portable ventilator.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When TADA was signed into law in 1999, as Texas Right to Life President Dr. John Seago explains in a <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=b6i9GPMdwuQ\"><span style=\"font-weight: 400;\">video<\/span><\/a><span style=\"font-weight: 400;\">, \u201cthe act was put in place to help Texas patients communicate their medical wishes to their doctors in the event that they become unable to make decisions on their own,\u201d and pro-lifers were assured the bill contained safeguards. However, \u201cit actually trumped advance directives and gave ultimate life and death decisions to hospitals regardless of the desires of the family or even the patients themselves.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;The toll taken by the 10-Day Rule cannot be understated since its enactment in 1999.
